The complaint alleged that piracy of Community sound recordings was taking place on a massive scale in Thailand and that such piracy was causing injury to the Community industry, notably by affecting exports of Community sound recordings to Thailand as well as to other third markets.
Komisija je 5. junija 1991 prejela pritožbo v skladu z Uredbo (EGS) št. 2641/84 z dne 17. septembra 1984 o okrepitvi skupne trgovinske politike zlasti v zvezi z zaščito pred nedovoljenimi trgovinskimi praksami [3], kakor je bila nazadnje spremenjena z Uredbo (ES) št. 522/94 [4], od evropskega urada Mednarodne zveze fonografske industrije (IFPI), ki predstavlja dejansko vse proizvajalce posnetih nosilcev zvočnega zapisa v Skupnosti.

The "large-scale fraud" referred to in Article 94(7) means a situation where it is established that, in spite of the application of Article 384, Article 9 of the Code and, where appropriate, Article 94(6) of the Code, the comprehensive guarantee referred to in Article 94(2)(b) of the Code is no longer sufficient to ensure payment, within the time limit prescribed, of the customs debt arising when any of the goods listed in Annex 44c are removed from the Community transit procedure.

Once it appears that cost over-runs beyond the limit set in the financing agreement are likely to be incurred, the National Authorising Officer shall, through the Head of Delegation, notify the Chief Authorising Officer accordingly, as well as of the measures which the National Authorising Officer intends to take in order to cover such cost over-runs over the allocated appropriations, either by reducing the scale of the project or programme or by calling on national or other non-Community resources.

The overhaul of the current Staff Regulations of officials and Conditions of Employment of other servants of the European Communities, which were originally adopted in 1962, has led to the requirement to phase in certain reform measures: the annual adjustment of pay scales on the basis of the current method, a new special levy and a new pension contribution rate are to take effect as from 1 January 2004, by way of transitional measures, while the revised regulation amending the Staff Regulations is to enter into force on 1 May 2004.
Natančen pregled obstoječih Kadrovskih predpisov za uradnike in pogojev za zaposlitev drugih uslužbencev Evropskih skupnosti, ki so bili prvotno sprejeti leta 1962, je privedel do potrebe po postopni uvedbi nekaterih ukrepov za spremembe: letna prilagoditev plačne lestvice po obstoječi metodi, nova posebna dajatev in nova stopnja pokojninskih prispevkov začnejo veljati s prehodnimi ukrepi od 1. januarja 2004, popravljena uredba, ki spreminja Kadrovske predpise pa začne veljati od 1. maja 2004.

Since the objective of this Directive, namely ensuring an adequate level for the security of gas supply, in particular in the event of a major supply disruption, whilst contributing to the proper functioning of the internal gas market, cannot, in all circumstances, be sufficiently achieved by the Member States, particularly in light of the increasing interdependency of the Member States regarding security of gas supply, and can therefore, by reason of the scale and effects of the action, be better achieved at Community level, the Community may adopt measures, in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty.
Ker cilja te direktive, in sicer zagotavljati ustrezno raven zanesljivosti oskrbe s plinom, zlasti v primerih večjih motenj oskrbe, in hkrati prispevati k pravilnemu delovanju notranjega trga s plinom, v vseh okoliščinah države članice ne morejo doseči v dovolj veliki meri, zlasti glede na vedno večjo medsebojno odvisnost držav članic glede zanesljivosti oskrbe s plinom, ter je torej ta cilj zaradi obsega in učinkov delovanja laže doseči na ravni Skupnosti, lahko Skupnost sprejme ukrepe v skladu z načelom subsidiarnosti, določenim v členu 5 Pogodbe.

The High-Level Group on the trans-European transport network chaired by Mr Karel Van Miert expressed concern that the delays in the cross-border sections of the priority projects on the trans-European transport network (TEN) were having an adverse effect on the profitability of the investments made by the Member States in the sections in their own country, denying them the benefit of economies of scale, and recommended that the rate of Community financing should be differentiated, according to the benefits to other countries, in particular the neighbouring countries, stressing that such modulation should in the first instance benefit the cross-border projects used by long-distance transport services.
