če država članica gostiteljica zahteva za opravljanje nekega poklica diplomo, kakršno določa Direktiva 89/48/EGS, za katere pridobitev je potreben uspešen zaključek posrednješolskega študijskega programa, ki traja več kakor tri leta ali v enakem trajanju ob delu, in ima prosilec bodisi diplomo, kakršno določa ta direktiva, bodisi enega ali več dokazov o izobrazbi v smislu točke (b) prvega pododstavka člena 3 te direktive, ki niso zajeti členu 3 (b) Direktive 89/48/EGS.
where the host Member State makes access to the profession or its pursuit subject to the possession of a diploma as defined in Directive 89/48/EEC, one of the conditions for the award of which is the completion of a post-secondary course of at least three years' duration or an equivalent period on a part-time basis and the applicant holds either a diploma as defined in this Directive or evidence of education and training within the meaning of point (b) of the first subparagraph of Article 3 and not covered by Article 3 (b) of Directive 89/48/EEC.

When a Member State cannot or can no longer be held responsible in accordance with paragraph 1, and where it is established, on the basis of proof or circumstantial evidence as described in the two lists mentioned in Article 18(3), that the asylum seeker - who has entered the territories of the Member States irregularly or whose circumstances of entry cannot be established - at the time of lodging the application has been previously living for a continuous period of at least five months in a Member State, that Member State shall be responsible for examining the application for asylum.
