'geographical indication' means an indication, including an 'Appellation of Origin', as defined in Article 22(1) of the TRIPs Agreement, which is recognised in the laws and regulations of a Contracting Party for the purpose of the identification of a wine originating in the territory of that Contracting Party;

To that end, each Party shall make use of the appropriate legal means referred to in Article 23 of the WTO TRIPS Agreement to ensure an effective protection and prevent protected designations from being used to describe a spirit drink or an aromatised drink not covered by the indications or descriptions concerned.

Detailed rules for auditing by the Court of Auditors are set out in the Tripartite Agreement.

whereas the Agreement on Trade-Related Aspects of Intellectual Property Rights (hereinafter, the 'TRIPs Agreement'), annexed to the WTO Agreement, contains detailed provisions on the protection of intellectual property rights whose purpose is the establishment of international disciplines in this area in order to promote international trade and prevent trade distortions and friction due to the lack of adequate and effective intellectual property protection;

Chile shall amend its internal legislation in respect of any of the terms listed in Appendix I of Annex VI (Agreement on trade in spirits drinks and aromatised drinks), as may be necessary so as no longer to assert that they are terms customary in common language as the common name for certain spirits drinks and aromatised drinks in its territory, as foreseen in Article 24(6) of the WTO TRIPs Agreement.

Whereas Article 23 (2) of the TRIPs Agreement provides for the refusal or invalidation of trade marks which contain or consist of false geographical indications for wines and spirits without the condition that they are of such a nature as to deceive the public, a new subparagraph (j) has to be added to Article 7 (1) of Regulation (EC) No 40/94,

whereas in order to comply with the national treatment obligation in Article 3 of the TRIPs Agreement, these provisions should be modified to ensure that nationals of all WTO Members, even if the Member in question is not a party to the Paris Convention, receive a treatment no less favourable than that accorded to nationals of Community Member States;

Without prejudice to Articles 22 and 23 of the Agreement on Trade-related Aspects of Intellectual Property Rights set out in Annex 1C to the Agreement establishing the World Trade Organisation (hereinafter called "the TRIPs Agreement"), the Parties shall take all the necessary measures, in accordance with this Annex, to ensure reciprocal protection of the names referred to in Article 4 and used to describe spirit drinks and aromatised drinks originating in the territory of the Parties.

Without prejudice to Articles 22 and 23 of the Agreement on Trade-Related Aspects of Intellectual Property Rights (hereinafter referred to as 'the TRIPs Agreement') set out in Annex 1C to the Agreement establishing the World Trade Organisation, the Parties shall take all the necessary measures, in accordance with that Annex, to ensure reciprocal protection of the designations referred to in Article 5 and used to describe spirits and aromatised drinks originating in the territory of the Parties.

Each Party shall ensure that the intellectual property rights of the legal entities of the other Party participating in the activities undertaken under this Agreement and the rights and obligations resulting from such participation are treated in a manner compatible with the relevant international conventions applicable to the Parties, notably the TRIPS Agreement (Agreement on Trade-Related Aspects of Intellectual Property Rights administered by the World Trade Organisation), the Berne Convention (Paris Act 1971) and the Paris Convention (Stockholm Act 1967).

Without prejudice to its commitments under the trade-related aspects of intellectual property rights (TRIPs) agreement, Bangladesh shall accede to the relevant international conventions on intellectual, industrial and commercial property referred to in Paragraph 1 of Annex II not later than 1 January 2006. The Joint Commission may decide, upon duly motivated request by either Party, to modify this period.

Each Party shall ensure that the intellectual property rights of legal entities of the other Party participating in activities carried out pursuant to this Agreement and the related rights and obligations arising from such participation, shall be consistent with the relevant international conventions that are applicable to the Parties, including the TRIPS Agreement (Agreement on trade-related aspects of intellectual property Rights administered by the World Trade Organisation) as well as the Berne Convention (Paris Act 1971) and the Paris Convention (Stockholm Act 1967).

Whereas the TRIPs Agreement provides for the possibility that members of the World Trade Organisation may exclude from patentability inventions, the prevention within their territory of the commercial exploitation of which is necessary to protect ordre public or morality, including to protect human, animal or plant life or health or to avoid serious prejudice to the environment, provided that such exclusion is not made merely because the exploitation is prohibited by their law;

The Parties apply the WTO Agreement on Trade Related Aspects of Intellectual Property Rights (TRIPs) from 1 January 1996 and undertake to improve, where appropriate, the protection provided for under that Agreement.

Without prejudice to the obligations arising from the WTO Agreement on TRIPs, South Africa could favourably consider accession to the multilateral conventions referred to in paragraph 3.

The provisions concerning scrutiny by the Court of Auditors of the resources managed by the EIB comply with the contractual nature of the Tripartite Agreement provided for in Article 248 of the Treaty.

All Community vessels fishing pursuant to the Agreement shall forward to the Argentinian enforcement authority a catch declaration in accordance with the model given in Annex VII within 48 hours of the end of each trip.

The Parties agree that the provisions of Annex V (Agreement on trade in wines), Title I, fulfil their respective obligations under Article 24(1) of the TRIPs as far as the individual terms referred to in Appendices I and II are concerned.

The Community declares that the names listed in Annex III(a) and Annex IV(a) to the Agreement are geographical indications within the meaning of Article 22(1) of the TRIPs Agreement, are in use and protected in the Community.

The Doha Declaration on the Agreement on trade-related aspects of intellectual property rights (TRIPs) and Public Health affirmed that "the TRIPs Agreement does not and should not prevent members from taking measures to protect public health" and that it "can and should be interpreted and implemented in a manner supportive of WTO members' right to protect public health and, in particular, to promote access to medicines for all" and reaffirmed "the right of WTO members to use, to the full, the provisions in the TRIPs Agreement which provide flexibility for this purpose".

RECALLING their obligations as parties to the Agreement establishing the World Trade Organisation (hereinafter referred to as the "WTO Agreement"), and in particular the provisions of the Agreement on the Trade Related Aspects of Intellectual Property Rights (hereinafter referred to as "the TRIPs Agreement"),

"intellectual property" shall have the meaning defined in Article 2 of the Convention establishing the World Intellectual Property Organisation, done at Stockholm, 14 July 1967 and the TRIPS Agreement;

South Africa hereby declares that it maintains its position in principle that the majority of names of Member States of the Community cannot be protected as geographical indications in terms of the TRIPs Agreement.

Nothing in this Agreement shall oblige a Contracting Party to protect a geographical indication of the other Contracting Party under the circumstances foreseen in the second sentence of Article 24(6) and Articles 24(7), 24(8) and 24(9) of the TRIPs Agreement.

The Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS Agreement 1994, contained in Annex 1C to the Agreement establishing the World Trade Organisation) contains detailed provisions on the existence, acquisition, scope, maintenance and enforcement of intellectual property rights.

They also agree on the need to accede to all relevant international conventions on intellectual, industrial and commercial property as referred to in Part I of the TRIPS Agreement, in line with their level of development.

Article 24(5) of the TRIPS Agreement applies not only to trademarks registered or applied for but also those to which rights have been acquired through use before a specified date, notably that of protection of the name in the country of origin.

with respect to intellectual property rights, the Agreement on TRIPS.

However, in case the use of a geographical indication listed in Annexes III(a) or IV(a) is asserted in Canada under the first sentence of Article 24(6) of the TRIPs Agreement as foreseen in paragraph 1, the Community may terminate this Agreement by giving three months' written notice to Canada.

The obligations imposed by this Directive shall apply only insofar as they are compatible with the provisions of international agreements on the protection of intellectual property rights, in particular the Berne Convention and the TRIPS Agreement.
