must perform or have performed the appropriate examinations and necessary tests to check whether, where the European specifications referred to in Article 2(2) of this Directive have not been applied, the solutions adopted by the manufacturer meet the essential requirements of this Directive;

REQUIREMENTS RELATING TO INCANDESCENT ELECTRIC FILAMENT LAMPS FOR HEADLAMPS WHICH FUNCTION AS DIPPED-BEAM AND/OR MAIN-BEAM HEADLAMPS (DEFINITION, GENERAL SPECIFICATIONS, NOMINAL VALUES, MANUFACTURE, WATTAGE AND LIGHT-FLUX VALUES, COLOUR, OPTICAL QUALITY CHECK, NOTE CONCERNING COLOUR, CONFORMITY OF PRODUCTION)

For the purposes of Article 24c of Regulation (EC) No 1257/1999, «fixed costs» means the costs incurred for entering a quality scheme and the annual contribution for participating in such a scheme, including, where necessary, expenditure on checks required to verify compliance with the specifications of the scheme.

In this context, one solution would be to provide checkpoints specifically for persons covered by Community law, so that these travellers, who are generally subject only to minimal checks, are not delayed on account of having to go to the same counter as third-country nationals who must undergo thorough and lengthy checks.

After completion of the veterinary checks specified in Article 4 of Directive 91/496/EEC, part 2 of the CVED shall be completed under the responsibility of the official veterinarian responsible for the border inspection post and shall be signed by him/her or by another official veterinarian operating under his/her authority.

Without prejudice to specific Community rules relating to certain products, the products referred to in Article 16(1)(a), (b), and (d) of Directive 97/78/EC shall not be subject to the systematic veterinary checks set out in Chapter 1 of that Directive if they are less than 1 kg in weight only and destined for personal human consumption.

For motor vehicles equipped with on-board diagnostic systems in accordance with Directive 98/69/EC, Member States may as an alternative to the test specified in item (a) establish the correct functioning of the emission system through the appropriate reading of the OBD device and simultaneous checking of the proper functioning of the OBD system."

To enable the Estonian authorities to carry out such checks, provision should be made for the obligation when importing the products in question to present to the Estonian authorities, on the one hand, a certified copy of the export licence, bearing specific indications guaranteeing that no export refund has been granted on the products referred to therein and, on the other, a certified copy of the export declaration bearing certain specific references to the export licence.

The notified body must carry out the appropriate examinations and tests in order to check the conformity of the interoperability constituent with the type as described in the type-examination certificate and with the requirements of the TSI either by examination and testing of every interoperability constituent as specified in point 4 or by examination and testing of interoperability constituents on a statistical basis, as specified in point 5, at the choice of the manufacturer.

The notified body must carry out the appropriate examinations and tests in order to check the conformity of the subsystem with the type as described in the EC type-examination certificate and with the requirements of Directive 96/48/EC and the TSI by examination and testing of every subsystem, manufactured as a serial product, as specified under point 4.

The competent authorities of the Member States shall forward to the Commission and the other Member States the list of points of entry. However, in these particular cases, plant-health checks may be carried out at the place of destination as long as specific guarantees as regards the transport of the plants, plant products and other objects are provided.

Council Regulation (Euratom, EC) No 2185/96 of 11 November 1996 concerning on-the-spot checks and inspections carried out by the Commission in order to protect the European Communities' financial interests against fraud and other irregularities(4) applies to all areas of the Communities' activity without prejudice to the provisions of Community rules specific to different policy areas.

Where the checks specified in Articles 13 and 14 do not confirm the figures in the stock records of an approved mill, the Member State concerned shall, without prejudice to any sanctions which may be imposed on the mill, determine, for each producer who is a member of an organization which has had its olive crop pressed in the mill in question, the quantity of oil for which aid shall be given.

It is for the Competent Authority of Member States to authorise the establishments carrying out the specific preparation of these bivalve molluscs and to check the satisfactory application of the "own health checks" procedures set out in Article 6 of Council Directive 91/493/EEC of 22 July 1991 laying down the health conditions for the production and the placing on the market of fishery products(3), as last amended by Directive 97/79/EC.

Where the subsystem meets the requirements of the TSI, the notified body must then, based on the tests, verifications and checkings carried out as required in the TSI and in the European specifications referred to in the TSI, draw up the certificate of EC verification intended for the adjudicating entity or its authorised representative established within the Community, which in turn draws up the EC declaration of verification intended for the supervisory authority in the Member State where the subsystem is located and/or operates.

the following subparagraph is inserted after the first subparagraph:"Processors who have exported the products referred to in the preceding subparagraph in the context of regional trade to one of the third countries listed in Annex II must present the documents referred to in Article 16 of Regulation (EC) No 800/1999 with a view to possible checks by the competent authorities which shall, if necessary, recover the benefit granted under the specific supply arrangements and temporarily suspend the processor's registration, or revoke it.";

Where the subsystem meets the requirements of Directive 96/48/EC and the TSI, the notified body must then, based on the tests, verifications and checkings carried out on all serial products as indicated in point 7 and required in the TSI and in the European specification referred to in Article 10 of Directive 96/48/EC, draw up the certificate of EC verification intended for the adjudicating entity or its authorised representative established within the Community, which in turn draws up the EC declaration of verification intended for the supervisory authority in the Member State where the subsystem is located and/or operates.

To take account of those new rules, Council Directive 90/425/EEC of 26 June 1990 concerning veterinary and zootechnical checks applicable in intra-Community trade in certain live animals and products with a view to the completion of the internal market(5) and Council Directive 92/118/EEC of 17 December 1992 laying down animal health and public health requirements governing trade in and imports into the Community of products not subject to the said requirements laid down in specific Community rules referred to in Annex A(I) to Directive 89/662/EEC and, as regards pathogens, to Directive 90/425/EEC(6), should therefore be amended,
