the format, content and frequency of submission of the inspection reports from the Member States must be harmonised and it is important to collect information on the quantity as well as the quality of the inspections in order to evaluate if compliance with Council Directive 98/58/EC is ensured in the Member States;

Council Directive 94/57/EC (5) established a system of Community-wide recognition of organisations that, in compliance with the international conventions, may be authorised to a various extent to inspect ships and issue the relevant safety certificates on behalf of the Member States.

Whereas these establishments are regularly inspected in the framework of the Community missions carried out in the south of Africa pursuant to Article 5 of Directive 72/462/EEC and Article 2 (1) of Commission Decision 86/474/EEC on the implementation of the on-the-spot inspections to be carried out in respect of the importation of bovine animals and swine and fresh meat from non-member countries (3);

- the provisions regarding test facility inspection and study audits shall be in conformity with those adopted by the Council of the OECD in Annexes I to III to the 1989 Decision-Recommendation (C(89)87(final)), that has been modified by its Decision-Recommendation of 9 March 1995 (C(95)8(final)), and all amendments made thereto,

Member States shall ensure, at least by check sampling, compliance with the maximum levels referred to in paragraph 1. The necessary inspections and monitoring shall be carried out in accordance with Council Directive 89/397/EEC of 14 June 1989 on the official control of foodstuffs (*), except for Article 14 thereof, and Directive 93/99/EEC of 29 October 1993 on the subject of additional measures concerning the official control of foodstuffs (**) except for Articles 5, 6 and 8 thereof.

Member States shall ensure, at least by check sampling, compliance with the maximum levels referred to in paragraph 1. The necessary inspections and monitoring shall be carried out in accordance with Council Directive 89/397/EEC of 14 June 1989 on the official control of foodstuffs (*), except for Article 14 thereof, and Council Directive 93/99/EEC of 29 October 1993 on the subject of additional measures concerning the official control of foodstuffs (**), except for Articles 5, 6 and 8 thereof.

Whereas Member States might find it useful to be assisted in the performance of their tasks by recognised organisations which meet the requirements of Council Directive 94/57/EC of 22 November 1994 on common rules and standards for ship inspection and survey organisations and for the relevant activities of marine administrations (1);

Whereas, in order to guarantee compliance with this Directive when products are put into circulation, Member States must take suitable control measures; whereas the necessary inspections should be programmed, carried out and their results reported in accordance with Council Directive 89/397/EEC of 14 June 1989 on the official inspection of foodstuffs (1);

Certain parts of the territory of China listed in Annex I of Decision 94/984/EC were allowed to use the model B certificate until an inspection revealed problems with certification; because of this, imports of fresh poultrymeat from China from 1 August 1996 were suspended by Commission Decision 96/456/EC.

Commission Regulation (EEC) No 3457/92 of 30 November 1992 laying down detailed rules concerning the inspection certificate for imports from third countries into the Community provided for in Council Regulation (EEC) No 2092/91 on organic production of agricultural products and indications referring thereto on agricultural products and foodstuffs (OJ L 350, 1.12.1992, p. 56)

Products intended for animal feed that satisfy the requirements of this Directive may not be subject to restrictions on entry into circulation, as regards the level of undesirable substances they contain, other than those provided for in this Directive and in Council Directive 95/53/EC of 25 October 1995 fixing the principles governing the organisation of official inspections in the field of animal nutrition (1).

Whereas a further inspection carried out pursuant to Article 5 of Directive 72/462/EEC and Article 2 (1) of Commission Decision 86/474/EEC on the implementation of the on-the-spot inspections to be carried out in respect of the importation of bovine animals and swine and fresh meat from non-member countries (4) has shown that the standard of hygiene in two establishments has been raised and can thus be regarded as satisfactory;

Whereas a routine inspection under Article 5 of Directive 72/462/EEC and Article 3 (1) of Commission Decision 83/196/EEC of 8 April 1983 concerning on-the-spot inspections to be carried out in respect of the importation of bovine animals and swine and fresh meat from non-member countries (6), has revealed that the level of hygiene of certain establishments has altered since the last inspection;

Whereas a routine inspection under Article 5 of Directive 72/462/EEC and Article 3 (1) of Commission Decision 83/196/EEC of 8 April 1983 concerning on-the-spot inspections to be carried out in respect of the importation of bovine animals and swine and fresh meat from non-member countries (5) has revealed that the level of hygiene of certain establishments has altered since the last inspection;

Whereas a further inspection carried out pursuant to Article 5 of Directive 72/462/EEC and Article 3 (1) of Commission Decision 83/196/EEC of 8 April 1983 concerning the on-the-spot inspections to be carried out in respect of the importation of bovine animals and swine and fresh meat from non-member countries (4) has shown that the standard of hygiene in one establishment has been raised and can thus be regarded as satisfactory;

Whereas a routine inspection under Article 5 of Directive 72/462/EEC and Article 3 (1) of Commission Decision 86/474/EEC of 11 September 1986 concerning the on-the-spot inspections to be carried out in respect of the importation of bovine animals and swine and fresh meat from non-member countries (5) has revealed that the level of hygiene of one establishment has altered since the last inspection;

Whereas a routine inspection pursuant to Article 5 of Directive 72/462/EEC and Article 2 (1) of Commission Decision 86/474/EEC of 11 September 1986 on the implementation of the on-the-spot inspections to be carried out in respect of the importation of bovine animals and swine and fresh meat from non-member countries (8) has revealed that the level of hygiene of some establishments has altered since the last inspection;

Whereas a routine inspection under Article 5 of Directive 72/462/EEC and Article 3 (1) of Commission Decision 83/196/EEC of 8 April 1983 concerning on-the-spot inspections to be carried out in respect of the importation of bovine animals, swine and fresh meat from non-member countries (6) has revealed that the level of hygiene of certain establishments has altered since the last inspection;

(5) The competent authority of each Member State should carry out on- the- spot inspections, which should in general be unannounced, as provided for by Council Regulation (EEC) No 3508/92 of 27 November 1992 establishing an integrated administration and control system for certain Community aid schemes fn, as last amended by Commission Regulation (EC) No 495/2001 fn.

Member States shall supplement their plans for measures to detect residues referred to in Article 4 of Council Directive 86/469/EEC of 16 September 1986 concerning the examination of animals and fresh meat for the presence of residues (1) in order, where necessary, to subject wild game meat to the inspections provided for in that Directive in order to make spot checks on the presence of contaminants in the environment.

(5) A financial contribution by the Community may be granted in respect of the pilot projects carried out by the Member States, under the conditions set out in Council Decision 2001/431/EC of 28 May 2001 on a financial contribution by the Community to certain expenditure incurred by the Member States in implementing the control, inspection and surveillance systems applicable to the common fisheries policy(2).

The provisions for the inspection and verification of GLP which are contained in parts A and B are those contained in Annexes I (Guides for compliance monitoring procedures for good laboratory practice) and II (Guidance for the conduct of test facility inspections and study audits) respectively of the OECD Council Decision-Recommendation on compliance with principles of good laboratory practice [C(89)87(Final)] of 2 October 1989 as revised by the OECD Council Decision amending the Annexes to the Council Decision-Recommendation on compliance with principles of good laboratory practice of 9 March 1995 [C(95)8(Final)].

(9) Non-clinical (pharmaco-toxicological) studies shall be carried out in conformity with the provisions related to Good Laboratory Practice laid down in Council Directives 87/18/EEC on the harmonisation of regulations and administrative provisions relating to the application of the principles of good laboratory practice and the verification of their application for tests in chemical substances(4) and 88/320/EEC on the inspection and verification of good laboratory practice (GLP)(5).

Member States shall ensure, at least by check sampling, compliance with the maximum levels referred to in paragraph 1. The necessary inspections and monitoring shall be carried out in accordance with Council Directive 89/397/EEC of 14 June 1989 on the official control of foodstuffs (*), except for Article 14 thereof, and Council Directive 93/99/EEC of 29 October 1993 on the subject of additional measures concerning the official control of foodstuffs (**), except for Articles 5, 6 and 8 thereof and any other relevant legal provisions for the monitoring of residues in foodstuffs of animal origin.

Whereas a further inspection carried out pursuant to Article 5 of Directive 72/462/EEC and Article 2 (1) of Commission Decision 86/474/EEC of 11 September 1986 on the implementation of the on-the-spot inspections to be carried out in respect of the importation of bovine animals and swine and fresh meat from non-member countries (4) has shown that the standard of hygiene in one establishment has been raised and can thus be regarded as satisfactory;

Whereas a further inspection carried out pursuant to Article 5 of Directive 72/462/EEC and Article 2 (1) of Commission Decision 86/474/EEC of 11 September 1986 concerning the implementation of the on-the-spot inspections to be carried out in respect of the importation of bovine animals and swine and fresh meat from non-member countries (3) has shown that the standard of hygiene in one establishment has been raised and can thus be regarded as satisfactory;

Whereas on the basis of a first inspection no establishments were judged satisfactory and Commission Decision 84/325/EEC (3) prohibited Member States, on a Community basis, from importing fresh meat from establishments in Morocco, while still allowing those Member States whose national legislation so permitted not to interrupt existing trade flows with the establishments proposed by the Moroccan authorities, for a period of seven months;

Whereas the system of observation and inspection applies without prejudice to the obligation of the Member States under Article 1 of Council Regulation (EEC) No 2241/87 of 23 July 1987 establishing certain control measures for fishing activites as amended by Regulation (EEC) No 3483 / 88 to inspect and control Community vessels which have been engaged in fishing and related activities in the Convention area;

Whereas on the basis of two inspections in 1983 and 1984 no establishments were judged satisfactory and Commission Decision 83/470/EEC (3) prohibited Member States, on a Community basis, from importing fresh meat from establishments in Mexico, while still allowing those Member States whose national legislation so permitted not to interrupt existing trade flows with the establishments proposed by the Mexican authorities, for a period of seven months;

Whereas a routine inspection made in application of Article 5 of Directive 72/462/EEC and Article 3 (1) of Commission Decision 80/15/EEC of 21 December 1979 concerning the on-the-spot inspections to be carried out in respect of the importation of bovine animals, swine and fresh meat from non-member countries (3), has revealed that the level of hygiene of certain establishments may be considered to be satisfactory; whereas these establishments may therefore be kept or entered on the Community list;

Whereas the veterinary checks on imported bivalve molluscs, echinoderms, tunicates and marine gastropods have to be carried out in accordance with Council Directive 90/675/EEC of 10 December 1990, laying down the principles governing the organization of veterinary checks on products entering the Community from third countries (2), as last amended by Directive 95/52/EC (3); whereas those checks entail the presentation of a health certificate accompanying the imported products;

Where, as a result of inspection activities carried out in accordance with the CCAMLR inspection system, there is evidence of breach of the measures adopted under the Convention, the flag Member State shall ensure that appropriate measures are taken against the natural or legal persons responsible for the breach of the measures adopted under the Convention in accordance with Article 25 of Council Regulation (EC) No 2371/2002 of 20 December 2002 on the conservation and sustainable exploitation of fisheries resources under the Common Fisheries Policy.

It should, moreover, be noted that the secrecy of proceedings is also protected by the code of conduct on public access to Commission and Council documents as set out in Commission Decision 94/90/ECSC, EC, Euratom (13), as amended by Decision 96/567/ECSC, EC, Euratom (14) as are internal documents relating to inspections and investigations and those whose disclosure could jeopardize the protection of individual privacy, business and industrial secrets or the confidentiality requested by a legal or natural person.

Without prejudice to the auditing of the accounts and to checks that they are lawful and regular and as laid down in Article 206a of the Treaty establishing the European Economic Community, such auditing and checks being mainly concerned with the reliability and effectiveness of national systems and procedures for determining the base for own resources accruing from VAT and GNP and without prejudice to the inspection arrangements made pursuant to Article 209 (c) of that Treaty, the Council shall, acting unanimously on a proposal from the Commission and after consulting the European Parliament, adopt the provisions necessary to apply this Decision and to make possible the inspection of the collection, the making available to the Commission and payment of the revenue referred to in Articles 2 and 5.

In order to ensure that the aid scheme is properly applied, producer organisations and processors must forward the necessary information and keep up-to-date suitable documentation and should, in particular, specify the areas under tomatoes, peaches and pears, on the basis of Council Regulation (EEC) No 3508/92 of 27 November 1992 establishing an integrated administration and control system for certain Community aid schemes (1), as last amended by Regulation (EC) No 1593/2000 (2), and Commission Regulation (EEC) No 3887/92 of 23 December 1992 laying down detailed rules for applying the integrated administration and control system for certain Community aid schemes (3), as last amended by Regulation (EC) No 2721/2000 (4), for the purposes of all inspections and controls deemed necessary.

The Commission shall report every three years to the European Parliament and to the Council on the functioning of the inspection arrangements.

IMPORT INSPECTION CERTIFICATE FOR FRESH MEAT/MEAT PRODUCTS (1) IMPORTED FROM THIRD COUNTRIES

HEALTH INSPECTION OF FRESH MEAT HELD IN THE ESTABLISHMENTS REFERRED TO IN PARAGRAPH 46 AND INTENDED FOR INTRA-COMMUNITY TRADE ,

upon inspection by a national fisheries inspection service, the vessel is found to be in contravention of the provisions of Council Regulation (EC) No 850/98;

Council Directive 88/320/EEC of 7 June 1988 on the inspection and verification of Good Laboratory Practice (GLP)(3) has been significantly amended several times.

The Member States shall ensure that importers are obliged to give at least two working days' notice to the local service responsible for the import inspection at the post where the freh meat or meat products are to be submitted for inspection, specifying the quantity and nature of the meat or the meat products and the time from which the inspection may be carried out.
