Articles 2 to 7 and 10 to 19 of the Treaty establishing a single Council and a single Commission of the European Communities, signed in Brussels on 8 April 1965, are hereby repealed.

TREATY AMENDING CERTAIN FINANCIAL PROVISIONS OF THE TREATIES ESTABLISHING THE EUROPEAN COMMUNITIES AND OF THE TREATY ESTABLISHING A SINGLE COUNCIL AND A SINGLE COMMISSION OF THE EUROPEAN COMMUNITIES

In Article 50, the adapted text of paragraphs 2 and 3 of Article 20 of the Treaty establishing a Single Council and a Single Commission of the European Communities shall be inserted as new paragraphs 4 and 5;

In order to provide for the efficient and orderly functioning of financial markets, and to ensure the uniform application of paragraphs 1 and 2, the Commission shall, in accordance with the procedure referred to in Article 64(2) adopt implementing measures in respect of:

Before the end of the period of application of the single area payment scheme, the Commission shall assess the state of preparedness of the new Member State concerned to apply fully the support schemes referred to in Article 1.

Before 31 December 1986, the Council shall examine for the first time whether the fourth subparagraph of Article 14 of the Treaty establishing a single Council and a single Commission of the European Communities should be applied.

Commission veterinary experts may, where it is necessary for the uniform application of this Directive, carry out on-site inspections in conjunction with the competent authorities.

The Commission shall set up a body of specific officials to collaborate with the competent authorities of the Member States in on-the-spot checks in order to ensure the uniform application of the rules in the wine sector.

In the event of ECSC unified tariff duties being amended or suspended, or the Kingdom of Spain applying Article 40, the Commission may take the necessary measures for the maintenance of Community preference.

In Article 21 of the Protocol on the Statute of the European Monetary Institute, the words 'annexed to the Treaty establishing a Single Council and a Single Commission of the European Communities` shall be deleted.

The Communication of the Commission on the creation of the single European sky of 30 November 2001 calls for structural reform to permit the creation of the single European sky by way of a progressively more integrated management of airspace and the development of new concepts and procedures of air traffic management.

The Protocol on the Privileges and Immunities of the European Communities, annexed to the Treaty establishing a Single Council and a Single Commission of the European Communities, shall be supplemented by the following provisions:

In the application of competition rules the Commission endeavours to avoid the adopting of State measures or undertakings erecting or maintaining artificial barriers incompatible with the single market.

The Commission shall be assisted by the Single Sky Committee, hereinafter referred to as "the Committee", composed of two representatives of each Member State and chaired by a representative of the Commission.

In order to take account of developments on financial markets, and to ensure the uniform application of this Directive, the Commission, acting in accordance with the procedure referred to in Article 64(2), may clarify the definitions laid down in paragraph 1 of this Article.

whereas these harmonized standards should be established by common agreement by bodies to be notified by each Member State to the other Member States and to the Commission and should be publicized as widely as possible;

The Member States, acting in accordance with their national legislation, and the Commission shall establish consultation mechanisms for appropriate involvement of stakeholders in the implementation of the single European sky.

The definitive value and number shall be established, by 31 December of the first year of application of the single payment scheme at the latest, after the checks made pursuant to Commission Regulation (EC) No 795/2004 are carried out.

In order to assess the application of the single payment scheme, it is appropriate to establish the modalities and deadlines for the exchange of information between the Commission and the Member States and to inform the Commission of the areas for which the aid has been paid, at national, and, where the case may be, at regional level.

The Council, acting by a qualified majority of the said Member States, on a proposal from the Commission and after consulting the ECB, shall take the other measures necessary for the rapid introduction of the ECU as the single currency of those Member States.

It is therefore necessary to specify what is included in the overall amount of Community support fixed for each rural development plan under the single programming document approved by the Commission.

Where the Commission finds that divergence at national level in regulations aimed at implementing Article 10(4) creates a barrier to the single market, the Commission may, acting in accordance with the procedure referred to in Article 22(3), take the appropriate technical implementing measures.

Upon accession, the office of President of the Council shall be held by the member of the Council who would have held that office in accordance with the original text of Article 2 of the Treaty establishing a Single Council and a Single Commission of the European Communities.

In Article 40 of the Protocol on the Statute of the European System of Central Banks and of the European Central Bank, the words 'annexed to the Treaty establishing a Single Council and a Single Commission of the European Communities` shall be deleted.

Whereas, with a view to the practical application of Directive 70/311/EEC, it is necessary to ensure that uniform provisions are laid down which are also aligned with the latest version of UN-ECE Regulation No 79 in all Member States;

In order to ensure the protection necessary for investors, the fair and orderly functioning of markets, and to ensure the uniform application of paragraphs 1, 3 and 4, the Commission shall, in accordance with the procedure referred to in Article 64(2), adopt implementing measures concerning:

Until the adoption by the Commission of the uniform system referred to in Article 15 (2), the European Co-ordination Office shall propose any measures likely to be of use in drawing up and circulating the returns referred to in Article 15 (1).

With a view to facilitating the progressive introduction of the Common Customs Tariff and the ECSC unified tariff by the Hellenic Republic, the Commission shall determine, if necessary, the implementing provisions whereby the Hellenic Republic alters its customs duties.

In order to bring its tariff into line with the Common Customs Tariff and the ECSC unified tariff, the Kingdom of Spain shall remain free to alter its customs duties more rapidly than is provided for in Article 36. It shall inform the other Member States and the Commission thereof.

In order to bring its tariff into line with the Common Customs Tariff and the ECSC unified tariff, the Portuguese Republic shall remain free to alter its customs duties more rapidly than is provided for in Article 197. It shall inform the other Member States and the Commission thereof.

The position shall be the same as regards the repeal of the Convention of 25 March 1957 on certain institutions common to the European Communities and the repeal of the Treaty of 8 April 1965 establishing a Single Council and a Single Commission of the European Communities.

HAVE DECIDED to amend certain financial provisions of the Treaties establishing the European Communities and of the Treaty establishing a single Council and a single Commission of the European Communities, and to this end have designated as their Plenipotentiaries:

Such amendments to rural development programming documents or single programming documents under Objective 2 which are limited to bringing the document into line with new Community legislation shall be sent to the Commission for information.

Whereas it is necessary to establish general rules to allow Community inspectors appointed by the Commission to ensure the uniform application of Community rules and to verify the control carried out by the competent authorities of Member States;

The Commission and the Member States shall design the EUIR in accordance with a progressive harmonisation of airspace classification, designed to ensure the seamless provision of air navigation services within the framework of the single European sky.

In order to ensure the uniform application of paragraphs 2, 3 and 4 in the light of changing market practice and to facilitate the effective operation of the single market, the Commission may adopt, in accordance with the procedure referred to in Article 64(2), implementing measures which define:

In order to bring its tariff into line with the Common Customs Tariff and the ECSC unified tariff, the Hellenic Republic shall remain free to alter its customs duties more rapidly than is provided for in Articles 31, 32 and 64. It shall inform the other Member States and the Commission thereof.

whereas, accordingly, it is essential that that single list, accompanied by its introductory notes, should be used also for the generalised system of preferences as established in Commission Regulation (EEC) No 2454/93 (3), as last amended by Regulation (EC) No 1677/98 (4);

Whereas, in order to secure uniform application of Articles 85 and 86 in the common market, rules must be made under which the Commission, acting in close and constant liaison with the competent authorities of the Member States, may take the requisite measures for applying those Articles;

Representatives shall enjoy the privileges and immunities applicable to members of the Assembly by virtue of the Protocol on the privileges and immunities of the European Communities annexed to the Treaty establishing a single Council and a single Commission of the European Communities.

This Decision shall enter into force on the same date as the Treaty of 22 July 1975 amending certain financial provisions of the Treaties establishing the European Communities and the Treaty establishing a Single Council and a Single Commission of the European Communities.

To assess the state of their labour markets, the Member States shall use uniform criteria established by the Commission in accordance with the results of the work of the Technical Committee carried out in pursuance of Article 33 (d), after having obtained the Opinion of the Advisory Committee.

Without prejudice to the publication by Member States of aeronautical information and in a manner consistent with this publication, the Commission, in close cooperation with Eurocontrol, shall coordinate the development of a single aeronautical information publication relating to the EUIR, taking account of relevant ICAO requirements.

In particular the Commission shall specify the contents of the various headings in the forms of accounts shown in Annex I and lay down common criteria for determining the proportion attributable to the transport function of expenditure common to that function and to other functions of infrastructure.

The European Parliament and Council invite the Commission to evaluate whether conformity assessment procedures for industrial products are properly applied and, where appropriate, to propose amendments in order to ensure consistent certification.

SUBJECT TO THE PRECEDING PROVISIONS , THIS DECISION SHALL NOT AFFECT THE PROVISIONAL PLACES OF WORK OF THE INSTITUTIONS AND DEPARTMENTS OF THE EUROPEAN COMMUNITIES , AS DETERMINED BY PREVIOUS DECISIONS OF THE GOVERNMENTS , NOR THE REGROUPING OF DEPARTMENTS OCCASIONED BY THE ESTABLISHING OF A SINGLE COUNCIL AND A SINGLE COMMISSION.

Before 1 January 1973 the Council shall, on a proposal from the Commission, re-examine the whole problem of payment of family benefits to members of families who are not residing in the territory of the competent State, in order to reach a uniform solution for all Member States.
