An application or claim shall be authorised only after sufficient checks have been made to verify that it complies with this Agreement.

For the purpose of checking the Goods declaration, the Customs shall take only such action as they deem essential to ensure compliance with Customs law.

The responsibilities and obligations of the other bodies, in particular concerning the control and verification of compliance with this Agreement shall be clearly defined.

This framework should include a system of inspection of nuclear facilities and transport to verify compliance with applicable requirements and conditions of the license or other authorizing document, and to establish a means to enforce applicable requirements and conditions, including effective sanctions.

(4) A certificate of airworthiness referred to in the previous paragraph shall be issued by the Administration on the basis of the inspection for airworthiness carried out which shall cover checking airworthiness requirements, such as ascertaining the compliance of the aircraft construction with the corresponding type certificate of the aircraft, verifying the meeting of requirements of approved regular and extra-ordinary systems of maintenance for the aircraft type, checking the functional capacity of the aircraft and its systems in relation to approved instructions for use of the aircraft, checking whether there has been any change in the operating properties of the aircraft and its systems because of possible events that the aircraft has suffered and checking other requirements of the Administration in relation to possible special conditions and properties for the aircraft type in question, which shows that the aircraft meets the appropriate airworthiness demands.

In order to supervise the implementation of this Agreement, to examine all measures taken under this Agreement and their conformity therewith, and to take the actions specifically required of it by this Agreement, the Textiles Monitoring Body ("TMB") is hereby established.

The normal frequency of these verifications must be consistent with the arrangements (if any) accepted under paragraph 1.2. or 1.3. of this Appendix and be such as to ensure that the relevant controls are reviewed over a period consistent with the climate of trust established by the approval authority.

When, as a result of any enquiry, the Commission considers that expenditure has not been effected in compliance with this Agreement, it shall, before a conformity clearance Decision is taken, notify in writing the National Authorising Officer of the results of its checks and indicate the corrective action to be taken to ensure future compliance.

(b) the effectiveness of the Community's safeguards, including the extent to which the operators of facilities are functionally independent of the Community's safeguards; the extent to which the measures specified in Article 32 have been implemented by the Community; the promptness of reports provided to the Agency; their consistency with the Agency's independent verification; and the amount and accuracy of the material unaccounted for, as verified by the Agency;

the objective of this function is the establishment of the amount that shall be paid to a claimant or to their assignee(s) in compliance with this Agreement, in particular those concerning the eligibility of applications for approval and claims for payment, compliance with commitments entered into concerning project approvals, tendering and contracting procedures, and verification of the work carried out or services supplied.

The approval authority of a Contracting Party granting a type approval pursuant to a Regulation annexed to this Agreement must verify the existence of adequate arrangements and documented control plans, to be agreed with the manufacturer for each approval, to carry out at specified intervals those tests or associated checks necessary to verify continued conformity with the approved type, including, specifically, where applicable, tests specified in the said Regulation.

If the aeronautical authorities of one Party, after carrying out a ramp inspection, find that an aircraft or the operation of an aircraft does not comply with the minimum standards established at that time pursuant to the Convention or there is a lack of effective maintenance and administration of safety standards established at that time pursuant to the Convention, the aeronautical authorities of that Party shall notify the aeronautical authorities of the other Party that are responsible for the safety oversight of the airline operating the aircraft of such findings and the steps considered necessary to conform with these minimum standards.

Should an applicable agreement regarding security of information between the European Community and the United States be concluded in the future, it shall govern the access, maintenance, use and release of Part 1, Part 2 and Part 3. For the time being, representatives of the European Commission and staff members of the GALILEO Joint Undertaking and European Space Agency shall be granted oral and visual access to Part 2 for the purposes of implementation of and compliance with this Agreement, on the basis of an established security clearance with a Member State that has a GSOMIA or GSOIA with the United States, in accordance with the national security procedures and laws of the Member State, and with the GSOMIA or GSOIA with the United States.

This would also make it possible to verify compliance with quality and safety standards.

Each Member State shall adopt provisions to verify compliance with the objectives referred to in Article 24.

For subsequent marketing years, provision should be made for the gradual application of the system for examining compliance with the threshold.

SPECIFICATIONS OF REFERENCE FUEL PRESCRIBED FOR APPROVAL TESTS AND TO VERIFY CONFORMITY OF PRODUCTION

The analytical result corrected for recovery is used for checking compliance (see Annex I, point 5).

The quantity obtained when examining compliance with the national threshold shall be added to the amounts for all the other Member States for the purposes of examining compliance with the Community threshold.

TECHNICAL CHARACTERISTICS OF REFERENCE FUEL PRESCRIBED FOR APPROVAL TESTS AND TO VERIFY CONFORMITY OF PRODUCTION

This Appendix describes the procedure to be used to verify, at the manufacturer's request, production conformity for the emissions of pollutants.

In the circumstances referred to in paragraph 5, the procedure for checking conformity shall be initiated by the Commission, which, where appropriate, may act at the request of a Member State.

In order to check compliance with the requirement in item 2.2.1.2 above, the vehicle shall describe a spiral movement at a speed of 10 kilometres per hour, starting from the dead ahead position.

CONTROLS RELATING TO CROSS-COMPLIANCE

There must be an opportunity of making independent analyses, in particular for the purposes of checking that the sulphur and phosphorus contents correspond to the requirements of 2.1.2.

The mechanism for examining compliance with the national processing thresholds provided for in Article 5 of Regulation (EC) No 2201/96 does not apply immediately to the new Member States.

The security measures included in the SSP should be in place when the initial verification for compliance with the requirements of chapter XI-2 and part A of this Code will be carried out.

Since the aid for tomatoes is published in the January preceding the marketing year concerned, transitional measures should also be laid down for examining compliance with the threshold for the purposes of fixing the level of aid for the 2007/08 marketing year.

This Appendix describes the procedure to be used to verify production conformity for the emissions of pollutants when the manufacturer's production standard deviation is either unsatisfactory or unavailable.

conduct tests in approved laboratories on all raw and finished products to verify their compliance with the requirements of Annex C to Directive 92/46/EEC, including the microbiological criteria for milk-based products.

These conformity checks shall be carried out in cooperation with the managing body of the airport and with the air traffic control authorities and shall take into account the time and other relevant parameters relating to the airport concerned.

Article 15(4)(c) shall be replaced by the following: "(c) make financial provision for the technical and human resources required to ensure the monitoring of compliance with the standards referred to in Article 2, with plant-health rules and with maximum permitted levels of residues."

The procedure for checking conformity may be used solely to make amendments to this Regulation in the fields expressly covered by the procedure referred to in Article 11(2) and strictly within the framework of exercise of implementing powers conferred on the Commission.

1.Administrative and on-the-spot checks provided for in this Regulation shall be made in such a way as to ensure effective verification of compliance with the terms under which aids are granted and of the requirements and standards relevant for cross-compliance.

The Member State which has granted EEC component type-approval shall take the measures required in order verify that production models conform to the approved type, in so far as this is necessary and if need be in cooperation with the competent authorities in the other Member States.

Whereas that Directive requires that official controls of feedingstuffs be carried out using Community methods of sampling and analysis for the purpose of checking compliance with requirements arising under the provisions laid down by law, regulation or administrative action concerning the quality and composition of feedingstuffs;

Animals which have satisfied the import control prescribed in paragraph 1 shall undergo any further inspections necessary in the country of destination in order to verify whether the provisions of this directive, including the special conditions defined in accordance with the procedure laid down in Article 29 pursuant to Article 3, have been complied with.
