Thus, the Court has stated that a benefit may be regarded as a social security benefit in so far as it is granted, without any individual and discretionary assessment of personal needs, to recipients on the basis of a legally defined position and provided that it concerns one of the risks expressly listed in Article 4(1) of Regulation No 1408/71 (see, inter alia, Case 249/83 Hoeckx [1985] ECR 973, paragraphs 12 to 14, and Case C-78/91 Hughes [1992] ECR I-4839, paragraph 15).

(4) The Court ruled in this case that when a Member State concludes a bilateral international convention on social security with a non-member country which provides for account to be taken of periods of insurance completed in that non-member country for acquisition of entitlement to old-age benefits, the fundamental principle of equal treatment requires that that Member State grant nationals of the other Member States the same advantages as those which its own nationals enjoy under that convention unless it can provide objective justification for refusing to do so (paragraph 34).

V zvezi z drugim pa je Sodišče Evropskih skupnosti presodilo, da so organizacije, zadolžene za upravljanje s sistemi socialnega varstva - ki jih nalaga država, kot je obvezno zdravstveno zavarovanje, in ki temeljijo na načelu solidarnosti - nepridobitne, ter da imajo, kadar plačane dajatve niso sorazmerne znesku obveznih prispevkov, izključno družbeno funkcijo in ne opravljajo gospodarske dejavnosti [13].
With regard to the latter, the European Court of Justice held that organisations charged with the management of State-imposed social security schemes, such as compulsory sickness insurance, which are based on the principle of solidarity, non-profit making and where the benefits paid are not proportional to the amount of the compulsory contributions, fulfil an exclusively social function and do not exercise an economic activity(13).

This Directive is based on Court of Justice case-law, in particular case-law on award criteria, which clarifies the possibilities for the contracting authorities to meet the needs of the public concerned, including in the environmental and/or social area, provided that such criteria are linked to the subject-matter of the contract, do not confer an unrestricted freedom of choice on the contracting authority, are expressly mentioned and comply with the fundamental principles mentioned in recital 2.

Whereas in its judgment of 9 July 1987 handed down in joined cases 281, 283, 284, 285 and 287/85 (Federal Republic of Germany, French Republic, Kingdom of the Netherlands, Kingdom of Denmark, United Kingdom v Commission), the Court of Justice ruled that cooperation between Member States in the social field, provided for in the first paragraph of Article 118 of the Treaty, extends to migration policies in relation to non-member countries in that the power to arrange consultation granted to the Commission under the second paragraph of Article 118 authorizes it to adopt rules of a binding nature;
