On account of the late publication of the guidelines for the various sectors and in particular for cut flowers and live plants, the first year's deadline for the presentation of programmes to the Member State concerned should be put back to 31 March.

Protocol 1 provides for the elimination of customs duties on imports into the Community of cut flowers and flower buds, fresh, falling within subheading 0603 10 of the Common Customs Tariff and originating in Israel, subject to a limit of 19 500 tonnes.

The current arrangements provide for the elimination of customs duties on imports into the Community of cut flowers and flower buds, fresh, falling within subheading 060310 of the Common Customs Tariff and originating in Jordan, subject to a limit of 100 tonnes.

Pending the entry into force of the Association Agreement, I have the honour to propose to you that the European Community and the Arab Republic of Egypt apply provisionally as from 1 January 2004, Articles 2, 6 to 28, 31, 33 to 37, 55, 82 to 84, 86 to 87, 90 and 91, the relevant Declarations( fn ), Annexes 1 to 6, Protocols 1 to 5 and the Exchange of Letters concerning fresh cut flowers and flowers and flower buds falling within subheading 0603 10 of the Common Customs Tariff.

The application of the tariff quotas for fresh cut flowers and flower buds may, by Commission Regulation, be suspended and the Common Customs Tariff duty re-established for large-flowered roses, small-flowered roses, uniflorous (bloom) carnations and multiflorous (spray) carnations if the price conditions laid down by Regulation (EEC) No 4088/87 are not being observed.

As none of the species or higher taxa of flora included in Annex A is annotated to the effect that its hybrids shall be treated in accordance with the provisions of Article 4.1 of the Regulation, this means that artifically propagated hybrids produced from one or more of these species or taxa may be traded with a certificate of artificial propagation, and that seeds and pollen (including pollinia ), cut flowers, seedling or tissue cultures obtained in vitro, in solid or liquid media, transported in sterile containers of these hybrids are not subject to the provisions of the Regulation.
