The Joint Supervisory Body shall determine its rules of procedure.

A foreign natural person that fulfils the conditions specified in the previous paragraph and acts as the responsible supervisor for demanding works must be entered in the appropriate register at the relevant professional chamber.

The responsible supervisor shall supervise whether all changes and additions arising during construction are being constantly entered in the project for execution, and whether such changes have been approved by the investor and project designer.

18. During construction it acts as the auditor and also acts as the project designer, contractor or supervisor on the works for which it audited the project documentation (seventh paragraph of Article 34)

(6) When a nominated surveyor or recognized organization determines that the condition of the equipment does not correspond substantially with the particulars of the certificate, they shall ensure that corrective action is taken and shall in due course notify the Administration.

Evaluation of the Efficiency of Work of Supervisory Boards

A fine of SIT 1,000,000 to 4,000,000 for a misdemeanour shall be imposed upon a sole trader that when acting as the supervisor pursuant to the provisions of this act commits any of the offences specified in the previous paragraph.

If the responsible supervisor finds that the contractor is breaching the agreed deadlines for construction, he must immediately notify the investor of such, and record the findings and proposals of how to rectify the situation in the construction diary without delay.

The monitoring committee may decide its own procedural rules.

HOMOGENEITY, SURVEILLANCE PROCEDURE AND SETTLEMENT OF DISPUTES

Legal and natural persons that, pursuant to the provisions of this act, act as the project designer, the contractor, the supervisor and the auditor must harmonise their founding and other acts with the provisions of this act within one year of its entry into force.

Monitoring of the commitment and disbursement of expenditure and of the establishment and collection of income shall be carried out by a financial controller from an official audit body of one of the Member States who shall be appointed by the Management Board, acting unanimously, and shall be accountable to it.

The term »Supervisory Board« may also mean the Board of Directors.

The bodies of a municipality shall be a municipal council, a mayor and a supervisory board.

When an officer of the Administration, a nominated surveyor or recognized organization has notified the appropriate authorities of the port State, the Government of the port State concerned shall give such officer, surveyor or organization any necessary assistance to carry out their obligations under this Regulation.

The contractor shall be deemed to have done everything that is required for the project of works executed to be formulated after construction is completed if all changes and additions to the project for execution that arose during construction are documented in the construction diary and the changes and additions were immediately approved by the supervisor and the responsible project designer.

The existence of specific state control procedures does not substitute for an independent external audit.

The quality and implications of evaluations shall be assessed by the Managing Authority, the Monitoring Committee and the Commission.

(3) The Joint Supervisory Body shall examine and decide the appeal at its next meeting.

A fine of SIT 150,000 to 500,000 for a misdemeanour shall be imposed upon an individual that pursuant to the provisions of this act acts as an authorised engineer but that despite having been deleted from the IZS register participates in project design as the responsible project designer, in auditing as the responsible auditor, or in construction as the responsible works manager or responsible supervisor (second paragraph of Article 132).

10 The Monitoring Committee shall consider and approve, where appropriate, any proposal to the Commission to amend the Programme.

The joint supervisory body shall draw up activity reports at regular intervals.

The EC Commission and the EFTA Surveillance Authority shall receive any complaints concerning the application of this Agreement.

In the event of any difficulty, the joint supervisory body shall refer the matter to the Management Board.
