Whereas inspection measures should be introduced to ensure that only starch produced in accordance with the provisions of this Regulation gives rise to compensatory payments or to payment of the premium;

Only areas sown with rice that have been included by the Member State in the notification referred to in paragraph 1 or in the corrections referred to in paragraph 2 may qualify for compensatory payments.

Article 5(1) of Regulation (EC) No 2799/98 states that compensatory payments may be made in cases where the exchange rate applicable on the date of the operative event is below that previously applicable.

The crop-specific payment for rice replaces the compensatory payments whose detailed rules where provided for in Commission Regulation (EC) No 613/97 of 8 April 1997 laying down rules for the application of Council Regulation (EC) No 3072/95 as regards the conditions for granting compensatory payments under the aid scheme for rice producers(4).

Whereas Annex II to Commission Regulation (EC) No 97/95 (5) fixes the minimum prices, compensatory payments and premiums corresponding to the underwater weight of 5 050 g of potatoes on the basis of their starch content;

This article covers the flat-rate allowances and payments at hourly rates for overtime worked by relevant staff in categories C and D who could not be given compensatory leave in accordance with the procedures laid down.

COMMISSION REGULATION (EC) No 613/97 of 8 April 1997 laying down rules for the application of Council Regulation (EC) No 3072/95 as regards the conditions for granting compensatory payments under the aid scheme for rice producers

In cases where means of production are imported directly by agricultural producer units, the import duties, non-deductible VAT and monetary compensatory amounts (receipts or payments) should also appear in the purchaser price used for EAA purposes.

COMMISSION REGULATION (EC) No 1127/98 of 29 May 1998 amending Regulation (EC) No 613/97 laying down rules for the application of Council Regulation (EC) No 3072/95 as regards the conditions for granting compensatory payments under the aid scheme for rice producers

Whereas the arable areas converted to extensive livestock farming must cease to be eligible for compensatory payments under the scheme set up by Council Regulation (EEC) No 1765/92 of 30 June 1992 establishing a support system for producers of certain arable crops (4);

During the on-site investigation at Republica's premises it was found that certain domestic sales, which were wrongly reported as having been made subject to standard cash payment terms, were found in fact to have been settled by means of compensation in a compensatory agreement.

The final subparagraph of Article 6(3) of Council Regulation (EC) No 3072/95 of 22 December 1995 on the common organisation of the market in rice(4) lays down that compensatory payments are to be paid between 16 October and 31 December following the beginning of the current marketing year.

whereas, in order to avoid excessive production of potato starch, such compensatory payments should be paid only in respect of the quantity of potatoes delivered by a potato producer to an undertaking producing potato starch which does not lead to that undertaking exceeding its quota limit;

This Regulation lays down the detailed rules for implementing the compensatory payments provided for in Article 6 of Regulation (EC) No 3072/95, without prejudice to the provisions laid down as part of the integrated administration and control system provided for by Regulations (EEC) No 3508/92 and (EEC) No 3887/92.

The release for free circulation of goods in the unaltered state or main compensating products is possible where the person concerned declares that he is unable to assign those products or goods to a customs-approved treatment or use under which import duties would not be payable, subject to payment of compensatory interest in accordance with Article 589 (1).

Whereas, following the extension of the system of compensatory payments to rice for sowing and in order to ensure balance on the market for rice seed, in particular to safeguard possibilities of disposal in line with the base area established in Article 6 of Regulation (EC) No 3072/95, it seems justified to introduce a mechanism to stabilise production of rice seed;

Without prejudice to Article 609, the release for free circulation of goods in the unaltered state or main compensating products shall be allowed where the person concerned is unable to assign those goods or products to a customs-approved treatment or use under which import duties would not be payable, subject to payment of compensatory interest in accordance with Article 589 (1).'

Whereas the adoption of Council Regulation (EEC) No 565/80 of 4 March 1980 on the advance payment of export refunds in respect of agricultural products (11), and of Commission Regulation (EEC) No 798/80 of 31 March 1980 laying down general rules on the advance payment of export refunds and positive monetary compensatory amounts in respect of agricultural products (12), makes it desirable to replace the references to the legal instruments repealed on that occasion by references to those now applicable;

Payments arising from commitments, including compensatory allowances relating, at the latest, to the year 1999, made by Member States before 1 January 2000 and for which expenditure is incurred by Member States before 1 January 2002 shall continue to be financed by the Guidance Section of the EAGGF in accordance with the conditions laid down in the Regulations referred to in paragraph 1 and subject to the availability of funds."

Payments arising from commitments, including compensatory allowances relating, at the latest, to the year 1999, made by Member States before 1 January 2000 and for which the application for payment is received by the Commission before 1 January 2002 shall continue to be financed by the Guidance Section of the EAGGF in accordance with the conditions laid down in the Regulations referred to in paragraph 1 and subject to the availability of funds.

whereas, to prevent income losses for producers resulting from the aforementioned reduction in institutional prices, it is appropriate to establish a system of compensatory payments for production granted per hectare and intended to maintain present profitability levels for the crop, the amount of which is fixed on the basis of the envisaged price reduction and the agronomic yields recorded in the various Member States over a period considered to be representative;

Areas of the holding of the farmer on which plants have been grown, but which are land set aside, on a temporary or permanent basis, in the marketing year starting on 1 July and ending on 30 June of the subsequent calendar year ('the marketing year`), in which the payment of the remuneration would be due, shall be considered to be areas on which plants are still grown, if subsidies or compensatory payments are granted by the Community or by the Member State concerned in respect of that set aside.
