The declaration of conformity is the part of the procedure whereby the manufacturer who fulfils the obligations imposed by Section 1 ensures and declares that the products concerned conform to the type described in the EC type-examination certificate and meets the provisions of this Directive which apply to them.

In the light of practical experience in the application of Commission Regulation (EC) No 542/95 of 10 March 1995 concerning the examination of variations to the terms of a marketing authorisation falling within the scope of Council Regulation (EEC) No 2309/93(3), as amended by Regulation (EC) No 1069/98(4), it is appropriate to simplify the procedure for varying the terms of a marketing authorisation.

(1) In the light of practical experience in the application of Commission Regulation (EC) No 542/95 of 10 March 1995 concerning the examination of variations to the terms of a marketing authorisation falling within the scope of Council Regulation (EEC) No 2309/93(3), as amended by Regulation (EC) No 1069/98(4), it is appropriate to simplify the procedure for varying the terms of a marketing authorisation.

If, after examination of the criteria adopted or following the checks carried out in accordance with Article 17, the Commission considers that these criteria might jeopardize the uniform application of this Directive, such criteria may be amended or supplemented in accordance with the procedure laid down in Article 31. The conditions under which the competent authority of the Member State shall reclassify the establishments in question shall be laid down by the same procedure.

As the complaint provided sufficient evidence, within the meaning of Article 6 (1) of Regulation (EEC) No 2641/84, of the existence of an illicit commercial practice attributable to Thailand and of consequent injury, the Commission announced in a notice published in the Official Journal of the European Communities (*) the initiation of an examination procedure concerning piracy of Community sound recordings in Thailand.

Products listed in the Annex may be placed under the customs procedure "processing under customs control" in accordance with the first subparagraph of Article 551(1) of Regulation (EEC) No 2454/93 only where the examination of the economic conditions has taken place in the Customs Code Committee unless the products and operations are mentioned in Annex 76, Part A of that Regulation.

Brazil has not yet notified part of the relevant legislation (Comunicado Decex 37, of 17 December 1997); the remaining part has been notified with a delay of more than one year, only after the initiation by the Commission of the present examination under the Regulation and in this notification some essential information was omitted (for example: the list of products subject to licensing procedures).

Where such agreements imply the modification of existing procedural rights or obligations or establish new procedural rights or obligations for Members or bodies of Parliament, or otherwise imply modification or interpretation of the Rules of Procedure, the matter shall be referred to the committee responsible for examination in accordance with Rule 180 (2) to (6) before the agreement is signed.

This module describes the procedure whereby a notified body carries out an examination of the design of an interoperability constituent and the manufacturer or his authorised representative established within the Community who satisfies the obligations of point 2 ensures and declares that the interoperability constituent concerned satisfies the requirements of Directive 96/48/EC and of the TSI that apply to it.

Where there is no such system or procedure, where it is not reasonable, or where it is instituted and considered reasonable but is found not to be applied or not to be applied effectively, a further examination by the exporting country based on the actual inputs involved will normally need to be carried out in the context of determining whether an excess payment occurred.

The sampling and diagnostic mediods to be carried out, including the techniques, examination procedures and media used, their standardisation and the interpretation of the results, for the detection and confirmation of bonamiosis (Bonamia ostreae) and marteiliosis (Marteilia rejringens) in molluscs in the case of abnormal mortality and for the recognition of approved (free) zones and farms must conform to those specified in the OIE Diagnostic Manual for Aquatic Animal Diseases Third Edition, 2000, Part 3 Diseases of molluscs:
