If, after further consultation of the national authorities concerned, Eurostat finds statistical anomalies in the information obtained or finds it impossible to draw up indicators which measure with statistical accuracy the changes in the real income of civil servants in a given Member State, it shall report to the Commission and provide it with all the material it needs to make an assessment.

On the basis of information supplied by the Member States, and having consulted the STECF, the Commission shall present to the European Parliament and the Council, at three-yearly intervals and for the first time by 31 December 2003, a report evaluating the measures taken by each Member State, the appropriateness of the methods used and the results achieved as regards the data collection and management referred to in this Regulation.

(2) Public invitation to tender shall contain information on the contractor, the contract object, conditions to participate, criteria, time and place of receipt of tender documentation, time and place of submission of tenders, approximate date of the decision on the award of contract, and reference of a contact person providing additional information. If contractors estimate that any other information is also necessary, it shall be included as well.

Such tasks shall include the collection, recording and evaluation of technical data in the fields of maritime safety, maritime security and maritime traffic, as well as in the field of marine pollution, both accidental and deliberate, the systematic exploitation of existing databases, including their cross-fertilisation, and, where appropriate, the development of additional databases.

In addition within the same timescale, the Member State shall provide Eurostat with the calculated figures of percentage standard error (95 % confidence) of the estimates for tonnes transported, tonne-kilometres performed and total kilometres travelled loaded for total goods road transport, for national goods road transport and for total international goods road transport.

Whereas the best method of assessing the situation as regards labour costs and earnings is to compile Community statistics using harmonised methods and definitions as has been done on earlier occasions, most recently for 1996 in the case of the level and composition of labour costs pursuant to Regulation (EC) No 23/97 (1) and for 1995 in the case of the structure and distribution of earnings pursuant to Regulation (EC) No 2744/95 (2);

Where the parties subsequently modify the proposed commitments, the Commission may only accept these modified commitments(44) where it can clearly determine - on the basis of its assessment of information already received in the course of the investigation, including the results of prior market testing, and without the need for any other market test - that such commitments, once implemented, resolve the competition problems identified and allow sufficient time for proper consultation of Member States.

In order to assess the degree of incapacity in the case referred to in Article 61 (5) of the Regulation, a worker shall supply the competent institution of the Member State to whose legislation he was subject at the time when the accident at work was sustained or the occupational disease was first diagnosed, with all information on previous accidents at work sustained or occupational diseases contracted by him when he was subject to the legislation of any other Member State, whatever the degree of incapacity caused by those previous cases.

For example, the assessment of behavioural responses to trapping and of aversive-ness should be done in particular by a trained person who is familiar with the interpretation of such data.

Member States shall evaluate the specific information on toxicology as provided for in Annex II and in particular:

Pursuant to Directive 95/46/EC, the level of data protection should be assessed in the light of all the circumstances surrounding the data transfer operation or set of data transfer operations.

The questionnaire shall be designed to establish all information useful for the conduct of the evaluation.

However, given the variability of the data, it is difficult to assess to what extent the reduction takes place.

These data may also be assessed for value band 45-49 before the date laid down in Article 11(1).

With this background, the profitability figures listed below could be overstated.
