The lump sums refunded to the German institutions of the place of residence by the competent institutions of other Member States shall be regarded as receipts which must be taken into account in the aforementioned financial equalization.

In order to attain the objectives of consistency and complementarity laid down in the Treaty and with the aim of guaranteeing optimum efficiency for all these activities, the Commission shall, in liaison with Member States, take all coordination measures necessary, including in particular:

Whereas the Convention should nonetheless be accepted with a reservation reflecting certain constraints pertaining to the customs union and to the current level of harmonization with regard to the import and export of spare parts for repairs and of container accessories and equipment;

The Commission shall monitor the use of the networks and the evolution of the framework conditions in the rail sector, in particular infrastructure charging, capacity allocation, safety regulation and licensing and the degree of harmonisation that evolves.

Achieving consistency between the two sets of designations is predicated on having an overall picture of the various instruments involved so that they can converge on this common goal, on the basis of a timetable that will ensure it is attained.

An adequate number of appliances must be examined and appropriate tests as set out in the applicable standards referred to in Article 5 or equivalent tests must be carried out in order to ensure conformity with the corresponding essential requirements of this Directive.

Accordingly the Parties, in the grant of licences for the export of items pursuant to this Agreement, will refrain from requiring additional confirmation from the other Party and its relevant persons, undertakings or authorities about full compliance with these commitments.

Harmonisation and comparability will be kept under review in order to provide the institutional decision-makers with high quality and comparable statistical instruments so as not to create any distortions in the judgements made of the budgetary situation in each Member State.

They may require only non-systematic notification of these conditions and other documents, for the purpose of verifying compliance with laws, regulations and administrative provisions in respect of such commitments, although this requirement may not constitute a prior condition in order for an undertaking to carry on its activities.

The 'Department of Fisheries Resources (DFR) of the Ministry of Agriculture, Animal Industries and Fisheries' shall be the competent authority in Uganda for verifying and certifying compliance of fishery and aquaculture products with the requirements of Directive 91/493/EEC.

whereas the procedures adopted comply with Council Decision 93/465/EEC of 22 July 1993 concerning the modules for the various phases of the conformity assessment procedures and the rules for the affixing and use of the CE conformity marking which are intended to be used in the technical harmonization Directives (1);

Pursuant to and within the limits of Article 30 of the Treaty and pending a greater degree of harmonisation, Member States will retain the right to carry out controls on transfers of certain dual-use items within the European Community in order to safeguard public policy or public security.

(iv) information on the basic features contained in the fundamental Nuclear Material Control Plan or the compliance with the Department of Energy Order referred to above, and such non-confidential information as is available to the United States on the IAEA safeguards approach; and

The percentages of water absorption which are technically unavoidable and which shall not be exceeded during the preparation of fresh, frozen and quick-frozen carcases and cuts thereof as well as the uniform methods of verifying compliance therewith shall be determined in accordance with the procedure laid down in Article 17 of Regulation (EEC) No 2777/ 75'.

for controlled substances under Annex A, either the average of its annual calculated level of consumption for the period 1995 to 1997 inclusive or a calculated level of consumption of 0,3 kilograms per capita, whichever is the lower, as the basis for determining its compliance with the control measures;

for controlled substances under Annex B, the average of its annual calculated level of consumption for the period 1998 to 2000 inclusive or a calculated level of consumption of 0,2 kilograms per capita, whichever is the lower, as the basis for determining its compliance with the control measures.

Any such Party shall be entitled to use either the average of its annual calculated level of consumption for the period 1995 to 1997 inclusive or a calculated level of consumption of 0,3 kilograms per capita, whichever is the lower, as the basis for its compliance with the control measures.

However, should the statistical information concerned be necessary in order to demonstrate compliance with minimum reserve requirements, the verification should be carried out in accordance with Article 6 of Council Regulation (EC) No 2531/ 98 of 23 November 1998 concerning the application of minimum reserves by the European Central Bank (1).

Before the end of the third month following receipt of the draft programmes, the competent authority shall forward to the Commission those which may, in its opinion, be approved under Article 6 of Regulation (EEC) No 1991/92, together with a general assessment of their compliance with the criteria referred to in the third indent of the second subparagraph.

Despite the advantages of an integrated system based on the balance, both overall and by industry, of transactions in goods and services, it has to be acknowledged that the price and volume indices thus obtained do not meet all needs or answer all possible questions on the subject of change in prices or volume.

In accordance with Article 12 of this Agreement, the Parties in particular provide each other at least annually with a list of the test facilities which, in the light of the results of the inspections and study audits, conform to Good Laboratory Practice, as well as of the dates of inspection or audit and their compliance status.

In the absence of the complete harmonisation of copyright law, it is important to establish the principle of cumulation of protection under the Community design and under copyright law, whilst leaving Member States free to establish the extent of copyright protection and the conditions under which such protection is conferred.

Conformity of toys with the national standards which transpose the harmonized standards the reference numbers of which have been published in the Official Journal of the European Communities shall result in a presumption of conformity to the essential safety requirements referred to in Article 3. Member States shall publish the reference numbers of such national standards.

The Commission shall examine the new plans communicated to it in accordance with Article 3 (2) for the purpose of determining whether, on the basis of the conformity of those plans with Directive 77/391/EEC, Directive 78/52/EEC and this Directive, and having due regard to the objectives of those Directives, the conditions for financial participation by the Community are met.

Conformity of vessels with the national standards which transpose the harmonized standards the reference numbers of which have been published in the Official Journal of the European Communities shall result in a presumption of conformity to the essential safety requirements referred to in Article 3. Member States shall publish the reference numbers of such national standards.

'Standardised' means that all data stream information, including all fault codes used, shall be produced only in accordance with industry standards which, by virtue of the fact that their format and their permitted options are clearly defined, provide for a maximum level of harmonisation in the motor vehicle industry, and whose use is expressly permitted in this Directive.

Whereas, in order to remain in accordance with the provisions of the Berne Convention for the Protection of Literary and Artistic Works, the term of protection should be the life of the author and fifty years from the first of January of the year following the year of his death or, in the case of an anonymous or pseudonymous work, 50 years from the first of January of the year following the year in which the work is first published;

(11) In order to ensure harmonisation, safety assessments should be carried out by the European Food Safety Authority ("the Authority"), established by Regulation (EC) No 178/2002 of the European Parliament and of the Council of 28 January 2002 laying down the general principles and requirements of food law, establishing the European Food Safety Authority and laying down procedures in matters of food safety fn.

There are various stages remaining to be gone through and many different actors involved, but the Commission has laid its groundwork for ensuring consistency between the two designation lists as from the year 2000. With this communication, the Commission would like to call on the national governments to do their part, both for their own account and collectively within the competent bodies of the Council.

Work will be pursued in the coming years in order to ensure that data on cross-border trade in services (both geographical breakdown and detail by components), foreign direct investment, and foreign affiliated trade maintain the quality standards, the level of detail, and the degree of harmonisation required by the Commission services in charge of conducting the commercial policy.

Persistent failure to comply arises where an organization that has self-certified to the Department of Commerce (or its designee) refuses to comply with a final determination by any self-regulatory or government body or where such a body determines that an organization frequently fails to comply with the Principles to the point where its claim to comply is no longer credible.

For reasons of consistency, the ECB's requirements in the field of quarterly euro area financial accounts should be based as much as possible on the Community statistical standards laid down by Council Regulation (EC) No 2223/96 of 25 June 1996 on the European System of National and Regional Accounts in the Community fn, as last amended by Regulation (EC) No 359/2002 of the European Parliament and of the Council fn (the "ESA 95").

Where the costs of benefits in kind which are granted by German institutions of the place of residence to pensioners or members of their family who are insured with competent institutions of other Member States must be refunded on the basis of monthly lump sums, such costs shall, for the purpose of financial equalization among German institutions of sickness insurance for pensioners, be treated as expenditure on the German sickness insurance scheme for pensioners.

The statistical units called upon by the Member States to cooperate in the collection or provision of basic information are obliged to give honest and complete information at the time it is requested and allow the organisations and institutions responsible for compiling official statistics at their request to obtain information at the level of detail necessary to evaluate compliance with the comparability requirements and the quality of the HICP sub-indices.

Within three years of the entry into force of this Regulation the Commission shall produce a report on whether the level of harmonization achieved by this Regulation and by Council Directive 90/167/EEC of 26 March 1990 laying down the conditions governing the preparation, placing on the market and use of medicated feedingstuffs in the Community (2) is equivalent to that provided for in Council Directive 70/524/EEC, accompanied if necessary by the proposals to modify the status of the coccidiostats and other medicinal substances covered by that Directive.

Whereas Article 2 (1) of Commission Regulation (EC) No 577/97 of 1 April 1997 laying down certain detailed rules for the application of Council Regulation (EC) No 2991/94 laying down standards for spreadable fats and of Council Regulation (EEC) No 1898/87 on the protection of designations used in the marketing of milk and milk products (3), as amended by Regulation (EC) No 1278/97 (4), lays down the rules for the indication of the fat content of spreadable fats; whereas Article 2 (3) of that Regulation provides for the establishment of a method verifying compliance with those rules;

(d) with regard to the single payment scheme, detailed rules relating in particular to the establishment of national reserve, the transfer of entitlements, the definition of permanent crops, permanent pastures, agricultural land and grassland, the options provided for in Chapter 5 of Title III and the list of crops allowed on the set-aside land as well as detailed rules relating to compliance with the Memorandum of Understanding on certain oil seeds between the European Economic Community and the United States of America within the framework of the GATT approved by Decision 93/355/EEC(39);

Whereas Article 2(1) of Commission Regulation (EC) No 577/97 of 1 April 1997 laying down certain detailed rules for the application of Council Regulation (EC) No 2991/94 laying down standards for spreadable fats and of Council Regulation (EEC) No 1898/87 on the protection of designations used in the marketing of milk and milk products (3), as last amended by Regulation (EEC) No 1298/98 (4), lays down the rules concerning indication of the fat content of spreadable fats with the exception of the products referred to in Regulation (EC) No 2991/94 having a minimum fat content of 80 %; whereas a method for verifying compliance with those rules is laid down in Article 2(3) of Regulation (EC) No 577/97 and in Annex II thereto; whereas the date of application of that method has been deferred to 1 January 1999 in order to allow users to gain experience with it and, on the basis of results forwarded to the Commission, to allow a thorough examination of its viability;

it provides not only for harmonisation in their respective fields but also promotes consistency between the three related areas.
