The procedure for checking conformity, including, if applicable, the procedures set up in Article 5(6) of Decision 1999/468/EC, shall be completed at least one month before the expiration of the period established internationally for the tacit acceptance of the amendment concerned or the envisaged date for the entry into force of said amendment.

IN ADDITION TO THE TESTING STANDARDS SPECIFICALLY MENTIONED, A NUMBER OF PROVISIONS, WHICH MUST BE CHECKED DURING TYPE-EXAMINATION (TYPE APPROVAL) AS REFERRED TO IN THE MODULES FOR CONFORMITY ASSESSMENT IN ANNEX B, ARE TO BE FOUND IN THE APPLICABLE REQUIREMENTS OF THE INTERNATIONAL CONVENTIONS AND THE RELEVANT RESOLUTIONS AND CIRCULARS OF THE IMO

This module describes the procedure whereby a manufacturer or his authorized representative established within the Community checks and attests that the products subject to the provisions of point 3 [are in conformity with the type as described in the EC-type examination certificate and] satisfy the requirements of the directive that apply to them.

As soon as the contract has been awarded the Commission shall inform the supplier of the agency which will be responsible for carrying out the checks referred to in Article 16, issuing the certificate of conformity or the certificate of delivery, and generally coordinating all stages of the supply operation (hereinafter referred to as 'the monitor`).

A procedure for checking conformity is hereby established in order to exclude from the scope of this Regulation any amendment to an international instrument only if, on the basis of an evaluation by the Commission, there is a manifest risk that such an amendment will lower the standard of maritime security or be incompatible with Community legislation.

For the purposes of Community maritime legislation, the applicable international instruments shall be those which have entered into force, including the most recent amendments thereto, with the exception of the amendments excluded from the scope of the Community maritime legislation resulting from the conformity checking procedure established by Article 5.

Whereas, while taking due account of the nature of a highly perishable product and of the marketing practices and inspection procedures used in the trade, it should be laid down that checks on conformity are to be carried out in principle at the stage to which the standards apply as laid down in the second paragraph of Article 1 of Regulation (EC) No 2257/94;

The notified body must carry out the appropriate examinations and tests in order to check the conformity of the appliance to the requirements of this Directive by examination and testing of every appliance, as specified in point 5.4, or by examination and testing of appliances on a statistical basis, as specified in point 5.5, at the choice of the manufacturer.

In particular, when checks are carried out in accordance with Appendix 1 to Annex V in order to check the conformity of production, if the noise level of the tyre tested does not exceed the limit values set out in section 4.2. of Annex V by more than 1 dB(A), the production shall be deemed to conform to the requirements of section 4 of the abovementioned Annex V.

The applicable international instruments referred to in Article 2, which are applied in accordance with Article 3(1), shall be those which have entered into force, including the most recent amendments thereto, with the exception of the amendments excluded from the scope of this Regulation resulting from the conformity checking procedure established by paragraph 5.

The notified body must carry out the appropriate examinations and tests in order to check the conformity of the product with the requirements of the directive either by examination and testing of every product as specified in point 4 or by examination and testing of products on a statistical basis, as specified in point 5, at the choice of the manufacturer (23)(). 3a.

For the checking of production conformity of vehicles which were type-approved before 1 October 1984 as far as their emissions of pollutants are concerned, in accordance with the provisions of Directive 70/220/EEC, as amended by Directive 78/665/EEC, the provisions of the abovementioned Directive remain applicable until the Member States make use of Article 2 (3) of this Directive.

For a period of five years following the payment by the Commission of the final balance in respect of any project, the responsible authorities shall keep available for the Commission all the supporting documents, i.e. the originals or versions certified to be in conformity with the originals on commonly accepted data carriers, regarding expenditure and checks on the project concerned.

The manufacturer must have access to a quality control laboratory having adequate staff and equipment to guarantee and check, before the release of the 'products' concerned with a view to putting them into circulation, that they comply with the specifications defined by the manufacturer and are in conformity with the provisions laid down in Directive 70/524/EEC or Directive 82/741/EEC.

For the purposes of applying the first subparagraph, the inspection body shall lay down in advance the criteria for assessing the risk of lots not conforming and, on the basis of a risk analysis, for each type of import it has defined, the minimum proportions of consignments and quantities which will be subject to a conformity check by the competent inspection body at the import stage.

EC verification is the procedure whereby the manufacturer or his authorized representative established within the Community ensures and declares that the instruments which have been checked in accordance with paragraph 3.3 are, where applicable, in conformity to the type described in the EC type-examination certificate and satisfy the requirements of the Directive which apply to them. 3.2.

in Article 9(1), the final subparagraph is replaced by the following: "In the case of a supply operation concerning the production of wholly-milled rice or the mobilisation of pigmeat on the Community market, the removal certificate drawn up in accordance with Annex V and checked and signed by the control agency shall certify conformity of the product with the rules laid down for its supply.";

The control attestation referred to in the second indent of Article 1 (2) (a) shall be issued in respect of each consignment by the competent authorities of the Member States after a check has been made for conformity with the minimum marketing requirements set out in the Annex to Regulation (EEC) No 890/78 in accordance with the methods laid down in Article 3 (2) and (3) of the said Regulation.

Financing decisions and any financing agreements and contracts resulting therefrom shall provide, inter alia, for supervision and financial control by the Commission (including the European Anti-fraud Office (OLAF)), including on-the-spot checks and inspection in conformity with Regulation (Euratom, EC) No 2185/96(8), and audits by the Court of Auditors, where appropriate, to be carried out on the spot.

For the type-approval and checking of production conformity of vehicles other than those of category M1 as well as of vehicles of category M1 designed to carry more than six occupants including the driver, the limits for the combined emissions of hydrocarbons and oxides of nitrogen are those resulting from the multiplication of the values L2 given in the tables in 5.2.1.1.4 and 7.1.1.1 by a factor of 1,25.

This module describes that part of the procedure whereby a manufacturer or his authorised representative established within the Community checks and attests that the interoperability constituent concerned, subject to the provisions of point 3 is in conformity with the type as described in the EC type-examination certificate and satisfies the requirements of Directive 96/48/EC and of the TSI that apply to it.

Financing decisions and any financing agreements and contracts resulting therefrom shall provide, inter alia, for supervision and financial control by the Commission (including the European Anti-Fraud Office (OLAF)), including on-the-spot checks and inspections in conformity with Council Regulation (Euratom, EC) No 2185/96(6) and audits by the Court of Auditors, where appropriate, to be carried out on the spot.

The coordinating authority shall communicate to the Commission each quarter, by the end of the quarter following that quarter at the latest, for each third country and product concerned, the number of lots and total quantities imported in accordance with paragraph 1, the number of lots and the quantities which have been checked for conformity as referred to in paragraph 5 and, of those lots, those which the inspection bodies found not to conform with the data mentioned in the conformity certificates issued by the third country inspection body, specifying the quantities for each of those lots and the type of defects giving rise to that finding.

To verify whether any strategy or measure should be considered a defeat device or an irrational emission control strategy according to the definitions given in sections 2.28 and 2.30, the type-approval authority and/or the technical service may additionally request a NOx screening test using the ETC which may be carried out in combination with either the type-approval test or the procedures for checking the conformity of production

For the type-approval and verification of conformity of - vehicles other than those of category M1, - passenger vehicles of category M1 designed to carry more than six occupants including the driver or whose maximum mass exceeds 2 500 kg, - off-road vehicles as defined in Annex I to Directive 70/156/EEC as last amended by Directive 87/403/EEC , the limit values shown in the tables in sections 5.2.1.1.4 (type-approval) and 7.1.1.1 (conformity check) of Directive 70/220/EEC, as last amended by Directive 83/351/EEC, are applicable as from 1 October 1989 in the case of new vehicle types and from 1 October 1990 in the case of vehicles entering into service for the first time.

"EC type-approval authority" means the authority in a Member State which is responsible for all aspects of the approval of a type of vehicle, system, component or separate technical unit, and which issues and, where appropriate, withdraws EC type-approvals, serves as the contact point for the EC type-approval authorities in the other Member States and checks the measures taken by the manufacturer in order to ensure product conformity;

Commission Regulation (EC) No 1148/2001 of 12 June 2001 on checks on conformity to the marketing standards applicable to fresh fruit and vegetables(3), as amended by Regulation (EC) No 2379/2001(4), lays down the conditions under which the Commission may approve checking operations performed by certain third countries which so request prior to import into the Community, in compliance with the conditions laid down in Article 7 of Regulation (EC) No 1148/2001.

For a period of three years, unless otherwise decided in the bilateral administrative arrangements, following the payment by the Commission of the final balance in respect of a project, the responsible body and authorities shall keep available for the Commission all the supporting documents (either the originals or versions certified to be in conformity with the originals on commonly accepted data carriers) regarding expenditure and checks on the project concerned.

A specific conformity checking procedure should, however, be set up to enable the Commission, after consulting COSS, to take whatever measures may be necessary to exclude the risk of amendments to the international instruments being incompatible with the aforesaid legislation or Community policy on maritime safety, the prevention of pollution from ships and the protection of shipboard living and working conditions in force or with the objectives pursued by that legislation.

The notified body must carry out the appropriate examinations and tests in order to check the conformity of the interoperability constituent with the type as described in the EC type-examination certificate and with the requirements of Directive 96/48/EC and of the TSI either by examination and testing of every interoperability constituent as specified in point 4 or by examination and testing of interoperability constituents on a statistical basis, as specified in point 5, at the choice of the manufacturer.

The fourth subparagraph of paragraph 2 is replaced by the following: "For the purposes of the approval referred to in paragraph 1, the Commission may use the special corps of inspectors in the fruit and vegetable sector set up under Article 40 of Regulation (EC) No 2200/96 to make on-the-spot visits to check that the inspection operations carried out in the third country concerned comply with the provisions of this Article and, where appropriate, make recommendations for improving the degree of conformity of goods exported to the Community by that third country."

Whereas all pure-bred breeding animals entering the Community are checked for veterinary and zootechnical reasons at the first point of entry, according to Council Directive 91/496/EEC (5), as last amended by Directive 96/43/EC (6), and when these animals are put into free circulation in a customs office other than the first point of entry, it is necessary that an authenticated copy of the health certificate, since the original will be kept at the first point of entry, and a certificate drawn up in conformity with Commission Decision 92/527/EEC (7), shall accompany the animal;

A conformity checking procedure is hereby established in order to exclude from the scope of the Community maritime legislation any amendment to an international instrument only if, on the basis of an evaluation by the Commission, there is a manifest risk that the international amendment, within the scope of the Regulations or the Directives referred to in Article 2(2), will lower the standard of maritime safety, of prevention of pollution from ships or of protection of shipboard living and working conditions established by Community maritime legislation, or be incompatible with the latter.

Without prejudice to other penalties which may be imposed, vehicles in respect of which one or more infringements of the rules on the transport of dangerous goods, in particular infringements listed in Annex II, are established may be immobilized either on-the-spot or at a place designated for this purpose by the authorities carrying out the check and required to be brought into conformity before continuing their journey or may be subject to other appropriate measures, depending on the circumstances or the requirements of safety including, where appropriate, refusal to allow such vehicles to enter the Community.

Whereas a harmonized component type-approval procedure for roll-over protection structures and their attachment to the tractor makes it possible for each Member State to check compliance with the common construction and testing requirements and to inform the other Member States of its findings by sending them copies of the component type-approval certificate completed for each type of roll-over protection structure and its attachment to the tractor; whereas the placing of an EEC component type-approval mark on all structures manufactured in conformity with the approved type obviates any need for technical checks on those structures in the other Member States;

If the final certificate of conformity is not issued after the first checks or second inspection have been carried out, the supplier shall be obliged to replace the goods.

Pre-financing, including in cases where it is split into a number of payments, shall be paid either on the basis of the contract, the agreement or the basic act, or on the basis of supporting documents which make it possible to check the conformity of the actions financed with the terms of the contract or agreement in question.
