The EC verification is the procedure whereby a notified body checks and attest that instruments concerned are, where appropriate, in conformity with the type as described in the EC type-approval certificate and satisfy the requirements of this Directive that apply to them.

Whereas, in order to apply the said type-approval procedure correctly, control of the conformity of production should include verification of the arrangements which have been made by the manufacturer to ensure that vehicles, separate technical units or components in production conform to the approved type;

describe the specific conformity assessment procedures involving, where appropriate, notified bodies as referred to in Article 8, based on the modules defined in Decision 93/465/EEC to be used to assess either the conformity or the suitability for use of constituents as well as the verification of systems;

state, in each case under consideration, which of the modules defined in Decision 93/465/EEC or, where appropriate, which specific procedures are to be used in order to assess either the conformity or the suitability for use of the interoperability constituents, as well as EC verification of the subsystems.

During the conformity assessment procedure for a device, the manufacturer and, if involved, the notified body shall take account of the results of any assessment and verification operations which, where appropriate, have been carried out in accordance with this Directive at an intermediate state of manufacture.

The general rules for implementing this Article, especially as regards the frequency and method of carrying out the verifications referred to in the first subparagraph of paragraph 1 (including cooperation with the competent authorities), shall be determined in accordance with the procedure laid down in Article 33.

Finally, the general rules applying to anti-dumping investigations, regarding in particular the conduct of investigations, verification visits, non-cooperation, confidentiality, and the procedural rights of the parties concerned, should apply to the procedures laid down in this Regulation, HAS ADOPTED THIS REGULATION:

the term 'type-approval pursuant to a Regulation` indicates an administrative procedure by which the competent authorities of the Contracting Party declare, after carrying out the required verifications, that a vehicle, equipment or parts submitted by the manufacturer conform to the requirements of the given Regulation.

Whereas the purpose of Directive 71/316/EEC (4) is to ensure the free movement of measuring instruments within the Community by harmonizing the divergent national laws relating to metrological control and by establishing for this purpose adequate EEC pattern approval and initial verification procedures and EEC methods of metrological control;

Without prejudice to Article 74, where the conditions for placing the goods under the procedure in question are fulfilled and provided the goods are not subject to any prohibitive or restrictive measures, the customs authorities shall release the goods as soon as the particulars in the declaration have been verified or accepted without verification.

Any verification by the Registry of the validity of registration applications shall take place subsequently to the registration at the initiative of the Registry or pursuant to a dispute for the registration of the domain name in question, except for applications filed in the course of the phased registration procedure under Articles 10, 12, and 14.

EC unit verification is the procedure whereby the manufacturer or his authorized representative established within the Community ensures and declares that the instrument, generally designed for a specific application, which has been issued with the certificate referred to in paragraph 4.2 conforms to the requirements of this Directive that apply to it.

Whereas Council Regulation (EEC) No 858/72 of 24 April 1972 on certain administrative and financial procedures for the operation of the European Social Fund provides in Article 5 (3) that the Commission may request Member States to carry out verifications or inquiries in which it may, in certain circumstances, invite administrative authorities of other Member States to participate;

Characteristics of product(s) and methods of verificationIndicate precise and measurable characteristics and parameters of the product(s) and its (their) constituents and components, where appropriate, with due consideration of the ETA Guideline mandate for the relevant product family, prepared by the Commission or, when dealing with product(s) based on the procedure under Article 9 (2) of the CPD, directly with the relevant essential requirements (Annex I to the CPD) and interpretative documents (IDs) and levels or classes of performance according to clause 1.2 of IDs, in so far as is relevant.

Comments should for example cover the selection procedure of these models (i.e. why a given model has been chosen in preference to alternative ones), if relevant the associated estimation error of the corresponding estimates, elements on the verification of the assumptions underlying the model, the test of the predictive power of the model using historical data, the comparison of the results generated by the model with other related sources of data, the use of screening and cross-validation studies, the tests of sensitivity of the model to parameters' estimation, the validation of the data inputs to the model.

The provisions for the inspection and verification of GLP which are contained in Parts A and B are those contained in Annexes I (Guides for compliance monitoring procedures for good laboratory practice) and II (Guidance for the conduct of test facility inspections and study audits) respectively of the OECD Council Decision-Recommendation on compliance with principles of good laboratory practice (C(89)87(Final)) of 2 October 1989 as revised by the OECD Council Decision amending the Annexes to the Council Decision-Recommendation on compliance with principles of good laboratory practice of 9 March 1995 (C(95)8(Final)).

Should the result of the verification of the declaration and accompanying documents or examination of the goods not be in accordance with the particulars given in the declaration, the customs authorities shall specify, at least in the copy of the declaration retained by the said authorities, or in a document attached thereto, the particulars to be taken into account for the purposes of the application of charges on the goods in question and, where appropriate, calculating any refunds or other amounts payable on exportation, and for applying the other provisions governing the customs procedure for which the goods are entered.

Whereas enquiries and further verifications, carried out both in the Community and elsewhere with the assistance of third countries' authorities, in accordance with the procedures established in Annex IV to Regulation (EEC) No 3030/93 have led the Commission to conclude that 5 408 295 pieces of textile products pertaining to category 4 (T-shirts) have been imported into the European Community in circumvention of the provisions of Regulation (EEC) No 3030/93 in the years 1995 and 1996 in that evidence shows that they physically emanated from the territory of the People's Republic of China before having been imported into the European Community without Chinese origin being declared or under false declarations of origin;
