ACP States

ACP States undertaking or contemplating reform at the macroeconomic or sectoral level shall be eligible for structural adjustment assistance, giving consideration to the regional context, their effectiveness and the likely impact on the economic, social and political dimension of development and on economic and social hardships being experienced.

Resources allocated for the ACP States

(i) the national indicative programmes of the ACP States in accordance with Articles 1 to 5 of Annex IV to the ACP-EC Partnership Agreement;

(b) EUR 2 700 million to finance intra-ACP and inter-regional cooperation with many or all of the ACP States, including, in accordance with Articles 12, 13(2) and 14 of Annex IV to the ACP-EC Partnership Agreement concerning implementation and management procedures.

(ii) the regional indicative programmes of support for regional and interregional cooperation and integration of ACP States in accordance with Articles 6 to 11, 13(1) and 14 of Annex IV to the ACP-EC Partnership Agreement.

(2) The ACP-EC Council of Ministers, meeting in Port Moresby (Papua New Guinea) on 1 and 2 June 2006, adopted Annex Ib to the ACP-EC Partnership Agreement and agreed therein to set the aggregate amount of Community aid to the ACP States under the multi-annual financial framework for the period 2008-2013, within the framework of the ACP-EC Partnership Agreement, at EUR 21 966 million from the 10th European Development Fund (hereinafter referred to as the »10th EDF«) contributed by Member States.

The Council shall, in accordance with paragraph 7 of the Financial Protocol of the ACP-EC Partnership Agreement, together with the ACP States, conduct a performance review, assessing the degree of realisation of commitments and disbursements, and the results and impact of the aid provided.

(i) EUR 21 966 million shall be allocated to the ACP Group of States;

REAFFIRMING their commitment to working together towards the achievement of the Cotonou Agreement objectives, in particular the eradication of poverty, sustainable development and the progressive integration of the African, Caribbean and Pacific (ACP) States into the world economy;

Payments made to the EIB in respect of special loans granted to the ACP States, the OCTs and the French overseas departments, together with the proceeds and income from risk capital operations, under the EDFs prior to the 9th EDF shall be credited to the Member States in proportion to their contributions to the EDF to which the sums relate, unless the Council decides unanimously, on a proposal from the Commission, to place them in reserve or allocate them to other purposes.

Any Member State may, without prejudice of the decision making rules and procedures set out in Article 8, provide to the Commission or the EIB voluntary contributions to support the objectives of the ACP-EC Partnership Agreement.

(5) In order to implement the ACP-EC Partnership Agreement and the Association Decision, a 10th EDF should be established and a procedure should be laid down for the allocation of funds and for contributions from Member States to those funds.

INTERNAL AGREEMENT BETWEEN REPRESENTATIVES OF THE GOVERNMENTS OF THE MEMBER STATES, MEETING WITHIN THE COUNCIL, ON THE FINANCING OF COMMUNITY AID UNDER THE MULTI-ANNUAL FINANCIAL FRAMEWORK FOR THE PERIOD 2008-2013 IN ACCORDANCE WITH THE ACP-EC PARTNERSHIP AGREEMENT AND ON THE ALLOCATION OF FINANCIAL ASSISTANCE FOR THE OVERSEAS COUNTRIES AND TERRITORIES TO WHICH PART FOUR OF THE EC TREATY APPLIES

(1) Paragraph 3 of Annex Ia of the Partnership Agreement between the members of the African, Caribbean and Pacific Group of States, of the one part and the European Community and its Member States, of the other part, signed in Cotonou on 23 June 2000(7) (hereinafter referred to as »the ACP-EC Partnership Agreement«), states that »any required amendments to the multiannual financial framework or relative parts of the Agreement shall be decided by the Council of Ministers by derogation from Article 95 of this Agreement«.

The Member States shall undertake to act as guarantor for the EIB, waiving any right to object and in proportion to their contributions to its capital, in respect of all financial commitments arising for borrowers under contracts concluded by the EIB for loans from its own resources pursuant to Article 1 of Annex II to the ACP-EC Partnership Agreement and the corresponding provisions of the Association Decision.

(9) On 12 September 2000, the Representatives of the Governments of the Member States, meeting within the Council adopted an Internal Agreement on the financing and administration of Community Aid under the Financial Protocol to the ACP-EC Partnership Agreement and the allocation of financial assistance for the Overseas Countries and Territories to which Part Four of the EC Treaty applies (hereinafter referred to as the »Internal Agreement for the 9th EDF«)(10).

ACP States:

Resources reserved for the ACP States

ECU 12 967 million for the ACP States, comprising:

EUR 13500 million shall be allocated for the ACP States;

the amount of ECU 1 658 million for financing operations to be carried out in the ACP States;

an amount of up to EUR 1700 million for financing operations to be carried out in the ACP States;

The process of programming of support for regional cooperation and integration of the ACP States shall be undertaken in accordance with Articles 6 to 14 of Annex IV to the ACP-EC Agreement.

up to EUR 1300 million reserved for the financing of support for regional cooperation and integration of the ACP States in accordance with Articles 6 to 14 of Annex IV to the ACP-EC Agreement.

Whereas Regulation (EC) No 1706/98 implements the amendments to the arrangements for imports from the ACP States introduced as a result of the mid-term review of the fourth ACP-EC Convention of Lomé;

Before the expiry of the 9th EDF, the Member States shall, in accordance with paragraph 7 of the Financial Protocol of the ACP-EC Agreement, together with the ACP States assess the degree of realisation of commitments and disbursements.

The Commission and the Bank will ensure close coordination and cooperation in supporting private sector development in the ACP States.

Out of the total amount stated in Article 1(2)(a), an amount of up to EUR 13500 million shall be reserved for the ACP States and allocated as follows:

The Partnership Agreement between the African, Caribbean and Pacific States and the European Community and its Member States signed in Cotonou, Benin on 23 June 2000 (hereinafter referred to as "the ACP-EC Agreement") sets the aggregate amount of Community aid to the ACP States for the five-year period 2000-2005 at EUR 15200 million.

the procedures applying in the award of contracts must be sufficiently flexible to adapt to the normal administrative and commercial procedures in the ACP States concerned;

the eligibility of the ACP States for resources to support structural adjustment, except in cases where, under Article 246(2) of the Convention, such eligibility is automatic;

The Bank shall regularly and confidentially inform the representatives of the Member States and of the Commission designated by name of any projects for the benefit of the ACP States which it intends to appraise.

Each year the Commission shall draw up a comprehensive report for the Member States on the operation of the system for the stabilisation of export earnings and the use made by the ACP States of the funds transferred.

The Commission and the Bank shall ascertain, each to the extent to which it is concerned, how the Community aid they administer is used by the ACP States, the OCT or any other recipients.

Whereas the fourth ACP-EC Convention, signed in Lomé on 15 December 1989 (hereinafter referred to as 'the Convention`), as amended by the Agreement amending the fourth ACP-EC Convention of Lomé, signed in Mauritius on 4 November 1995, set the aggregate amount of Community aid to the ACP States for a five-year period beginning on 1 March 1995 at ECU 14 625 million, comprising ECU 12 967 million from the European Development Fund and ECU 1 658 million the European Investment Bank (hereinafter referred to as 'the Bank`);

Mid-term and end-of-term reviews for each ACP State shall be carried out by the Commission and the ACP State concerned in close coordination with the Member States represented in that ACP State.

The Commission and the Bank shall monitor, each to the extent to which it is concerned, the use of 9th EDF assistance by the ACP States, the OCT or any other recipients, and the implementation of projects financed by 9th EDF assistance, having particular regard to the relevant objectives referred to in Articles 55 and 56 of the ACP-EC Agreement and in the corresponding provisions of the Decision.

Whereas, in order to implement Community financial and technical cooperation with the developing countries, and in particular with the ACP States, the Commission has set up overseas delegations and provided them with staff;

be open to participation by Member States that are not permanently represented in the ACP State concerned and by other donors which are active in that ACP State.
