This Article shall apply to all Council documents, provided that they are not classified and without prejudice to the possibility of making a written application in accordance with Article 6 of Regulation (EC) No 1049/2001.

After adoption of one of the decisions referred to in paragraph 5(c) or final adoption of the act concerned, the General Secretariat shall make available to the public any legislative documents relating to this act which were drawn up before one of such decisions and which are not covered by any of the exceptions laid down in Article 4(1), (2) and (3), second subparagraph, of Regulation (EC) No 1049/2001, such as information notes, reports, progress reports and reports on the state of discussions in the Council or in one of its preparatory bodies (outcomes of proceedings), excluding Legal Service opinions and contributions.

In order to carry out their task the Council and the Commission shall, in accordance with the provisions of this Treaty, make regulations, issue directives, take decisions, make recommendations or deliver opinions.

The Council, acting by a qualified majority on a proposal from the Commission and after consulting the European Parliament, may make any appropriate regulations for the application of Articles 87 and 88 and may in particular determine the conditions in which Article 88(3) shall apply and the categories of aid exempted from this procedure.

'As soon as this Treaty enters into force, the Council shall, acting in accordance with the procedure referred to in Article 189b and after consulting the Economic and Social Committee, issue directives or make regulations setting out the measures required to bring about, by progressive stages, freedom of movement for workers, as defined in Article 48, in particular:'

Once the budget has been declared finally adopted, each Member State shall, from 1 January of the following financial year or from the date of the declaration of final adoption of the budget if that is after 1 January, be bound to make over to the Community the payments due as specified in the Council Regulation implementing the Decision on the system of the Communities' own resources.

The Council shall review the effectiveness of the Regulation after a period of application of three years and, acting on a proposal from the Commission, make any necessary adaptations.

7 Upon receipt of the texts of the adopted domestic regulations under paragraph 6 above, the Secretary General of the Council of Europe shall make them available, where practicable by electronic means, and shall keep this information in a single database within the Council of Europe.

The Commission shall again report to the European Parliament and the Council by 31 December 2001 on the operation of this Regulation and make appropriate proposals concerning the new arrangements to apply after 31 December 2002.

For the purpose of compliance with the provisions on production potential laid down in Title II of Regulation (EC) No 1493/1999 Member States shall make use of the vineyard register or reference charts, as applicable, in accordance with Council Regulation (EEC) No 2392/86(14).

When a recovery plan which involves management of fishing effort in all or part of the areas or divisions referred to in Article 1 is adopted by the Council, this plan shall at the same time make any necessary adjustment to this Regulation.

The Commission, in accordance with the procedure provided for in Article 24 of Regulation (EEC) No 2759/75, shall make the necessary adaptations to Council or Commission acts concerning the common organization of the markets in pigmeat which result from the application of Article 1.

The Commission, in accordance with the procedure provided for in Article 17 of Regulation (EEC) No 2771/75, shall make the necessary technical adjustments to Council or Commission Regulations concerning the common organization of the markets in eggs which result from the application of Article 1.

The Council shall decide on the existence of an excessive deficit in accordance with Article 104c (6), within three months of the reporting dates established in Article 4 (2) and (3) of Regulation (EC) No 3605/93. When it decides, in accordance with Article 104c (6), that an excessive deficit exists, the Council shall at the same time make recommendations to the Member State concerned in accordance with Article 104c (7).

Until 31 December 1996, the Commission shall ensure that the portion set aside for other applicants makes due and fair allowance for the situation created by the existence of national restrictions applied under Council Regulation (EEC) No 288/82 of 5 February 1982 on common rules on imports (1) and Council Regulation (EEC) No 3420/83 of 14 November 1983 on import arrangements for products originating in State-trading countries, not liberalized at Community level (2).

The council shall have the authority to make recommendations to the parties and the commissions on matters concerning salmon stocks subject to this Convention, including the enforcement of laws and regulations, provided that no recommendation shall be made concerning the management of salmon harvests within the area of fisheries jurisdiction of a party.

Without prejudice to Article 23, the Single Administrative Document which, pursuant to Article 205 of Commission Regulation (EEC) No 2454/93 of 2 July 1993 laying down provisions for the implementation of Council Regulation (EEC) No 2913/92 establishing the Community Customs Code (1), is used to make the declaration regarding one of the customs-approved treatments or uses referred to in Article 6, shall be used as the statistical data medium.

4. These weightings could be adjusted by a Council regulation before 31 December 2004 establishing new weightings with effect from 1 July 2004. In this event the institutions shall make the corresponding positive or negative adjustment to the remuneration and pensions of the officials, former officials and other persons concerned with retroactive effect for the period between the effective date and the date of entry into force of the decision on the 2004 adjustment.

In accordance with Annex XI to the Staff Regulations, these weightings could be adjusted before 31 December 1995 by a Council regulation establishing new weightings with effect from 1 July 1995. In this event, the institutions shall make the corresponding positive or negative adjustment to the remuneration and pensions of the officials, former officials and other persons concerned with retroactive effect for the period between the effective date and the adoption date of the decision on the 1995 adjustment.

In accordance with Annex XI to the Staff Regulations these weightings could be adjusted by a Council Regulation before 31 December 2002 establishing new weightings with effect from 1 July 2002. In this event the institutions shall make the corresponding positive or negative adjustment to the remuneration and pensions of the officials, former officials and other persons concerned with retroactive effect for the period between the effective date and the date of entry into force of the decision on the 2002 adjustment.

Whereas Article 7 (4) of Council Regulation (EC) No 685/95 of 27 March 1995 on the management of the fishing effort relating to certain Community fishing areas and resources 0 provides that Member States shall take the necessary steps to make it compulsory for vessels flying their respective flags to declare on entry into, and exit from, an area, on-board catches as from the date of implementation - not later than 1 January 1998 - of Community infrastructure for the management of data on fishing catches in Community waters;

The ECB shall, in accordance with the provisions of the Treaty establishing the European Community (herein- after referred to as the `Treaty` ) and under the conditions laid down in the Statute of the European System of Central Banks and of the European Central Bank (herein- after referred to as the `Statute` ), make regulations to the extent necessary to implement the tasks of the ESCB as defined in the Statute and in some cases laid down in the provisions adopted by the Council referred to in Article 107(6) of the Treaty.

In accordance with Annex XI to the Staff Regulations these weightings could be adjusted by a Council Regulation by 31 December 1996 at the latest establishing new weightings with effect from 1 July 1996. In this event the institutions shall make the corresponding positive or negative adjustment to the remuneration and pensions of the officials, former officials and other persons concerned with retroactive effect for the period between the date of application and the date of entry into force of the decision on the 1996 adjustment.

Producers making direct sales shall keep available for the competent authority of the Member State, for at least three years from the end of the year in which the documents are drawn up, stock records drawn up by 12-month period and giving details, per month and per product, of the quantities of milk and/or milk products sold directly for consumption and/or to wholesalers, cheese maturers or the retail trade, together with registers of livestock held on holdings and used for milk production, in accordance with Article 7 of European Parliament and Council Regulation (EC) No 1760/2000 (2), and supporting documents enabling such stock records to be verified.

The Commission shall submit to the Council, before 1 January 1971, a general report on the operation of this Regulation and, before 1 July 1971, a proposal for a Regulation to make the necessary amendments to this Regulation.

If such confirmation is not received six months before the date of application of this Regulation, the Commission shall make appropriate proposals to the Council.

the Council, on a proposal from the Commission, shall make any amendments to this Regulation which may prove necessary in the light of the obligations arising out of the Revised Convention for the Navigation of the Rhine.

The conditions and procedures for making the financial contribution and for its payment and control shall be in accordance with Council Regulation (EC, Euratom) No 1605/2002 of 25 June 2002 on the Financial Regulation applicable to the general budget of the European Communities(5).

When the purchasers of the goods make payment to the intervention agency, the selling prices, minus the duty referred to in the first subparagraph, shall correspond to revenue from sales within the meaning of Annex I to Council Regulation (EEC) No 3492/90 (1).

Any Council decision to make public its recommendations, where it is established that no effective action has been taken in accordance with Article 104c (8), shall be taken immediately after the expiry of the deadline set in accordance with Article 3 (4) of this Regulation.

Whereas, pursuant to Article 94 of the Treaty, the Council may make any appropriate regulations for the application of Articles 92 and 93 and may, in particular, determine the conditions in which Article 93(3) shall apply and the categories of aid exempted from this procedure;

The Commission, in accordance with the procedure provided for in Article 24 of Regulation (EEC) N° 2759/75, shall make the necessary adaptations to Council or Commission acts concerning the common organization of the markets in pigmeat which result from the application of Article 1.

make recommendations to the Council regarding the direction and supervision of a staff of inspectors who shall inspect activities in the area to determine whether the provisions of this part, the rules, regulations and procedures of the Authority, and the terms and conditions of any contract with the Authority are being complied with;

Whereas Council Directive 67/548/EEC of 27 June 1967 on the approximation of the laws, regulations and administrative provisions of dangerous substances (4), as last amended by Commission Directive 92/21/EEC (5) and in particular Article 27 thereof, provides that the Commission shall make general rules for the elaboration distribution, contents and format of safety data sheets in relation to dangerous substances;
