Paragraph 3 is intended to ensure the necessary consistency between the Charter and the ECHR by establishing the rule that, insofar as the rights in the present Charter also correspond to rights guaranteed by the ECHR, the meaning and scope of those rights, including authorised limitations, are the same as those laid down by the ECHR.

In accordance with Article 52(3), this right has the same meaning and scope as the right guaranteed by the ECHR.

Therefore, the "negative" definitions appearing in the ECHR must be regarded as also forming part of the Charter:

The provisions of Article 2 of the Charter correspond to those of the above Articles of the ECHR and its Protocol.

In any event, the level of protection afforded by the Charter may never be lower than that guaranteed by the ECHR.

By virtue of Article 52(3) of the Charter, it therefore has the same meaning and the same scope as the ECHR Article.

Articles of the Charter where both the meaning and the scope are the same as the corresponding Articles of the ECHR:

This right is thus similar to that afforded by the ECHR, but its scope may be wider when national legislation so provides.

The sensitivity for detection of endocarditic lesions is much greater by transesophageal than by transthoracic echocardiography.

Role 2. In general, Role/Echelon 2 medical support will be prepared to provide evacuation from Role/Echelon 1 facilities, triage and resuscitation, treatment and holding of patients until they can be returned to duty or evacuated, and emergency dental treatment.

In accordance with Article 52(3), the meaning and scope of this right are the same as those of the corresponding article of the ECHR.
