2 When making a reservation under paragraph 1, a federal State may not apply the terms of such reservation to exclude or substantially diminish its obligations to provide for measures set forth in Chapter II. Overall, it shall provide for a broad and effective law enforcement capability with respect to those measures.
Ko država uveljavi pridržek iz prvega odstavka, zvezna država ne sme uporabiti pogojev tega pridržka tako, da izključi ali bistveno zmanjša svoje obveznosti za zagotavljanje ukrepov, predvidenih v II. poglavju. Nasploh mora zagotoviti obširno in učinkovito zakonsko prisilo v zvezi s temi ukrepi.

The Federal Republic of Germany, the Hellenic Republic, the Kingdom of the Netherlands and the Republic of Austria, reserve the right to make provision in their national law to the effect that, where a question relating to the interpretation of the Convention on the protection of the European Communities' financial interests and the first Protocol thereto is raised in a case pending before a national court or tribunal against whose decision there is no judicial remedy under national law, that court or tribunal will be required to refer the matter to the Court of Justice.
Zvezna republika Nemčija, Helenska republika, Kraljevina Nizozemska in Republika Avstrija si pridržujejo pravico, da v svoji notranji zakonodaji določijo, da bo sodišče, kadar se v zadevi, o kateri se odloča pred nacionalnim sodiščem, postavi vprašanje, ki se nanaša na razlago Konvencije o zaščiti finančnih interesov Evropskih skupnosti in prvega Protokola k tej konvenciji in zoper odločbo ni nobenega pravnega sredstva, zavezano zadevo predložiti Evropskemu sodišču.

When making the above declaration, the Kingdom of Belgium, the Federal Republic of Germany, the Grand Duchy of Luxembourg and the Republic of Austria reserved the right to make provisions in their national law to the effect that, where a question relating to the validity or interpretation of an act referred to in Article K.7(1) is raised in a case pending before a national court or tribunal against whose decision there is no judicial remedy under national law, that court or tribunal will be required to refer the matter to the Court of Justice`.
Ob zgornji izjavi si Kraljevina Belgija, Zvezna republika Nemčija, Veliko vojvodstvo Luksemburg in Republika Avstrija pridržijo pravico, da v nacionalnem pravu predvidijo določbe za primer, če se postavi vprašanje o veljavnosti ali razlagi akta iz člena K.7(1) v postopku, ki teče pred nacionalnim sodiščem, zoper odločitev katerega po nacionalnem pravu ni pravnega sredstva, zaradi česar je to nacionalno sodišče dolžno predložiti zadevo Sodišču."
