Article 4 of the Agreement on TRIPS.

The Contracting Parties hereby waive their right to invoke Article 24(4) to (7) of the TRIPS Agreement in order to refuse to grant protection to designations from the other Party.

The Contracting Parties hereby waive their right to invoke Article 24(4) to (7) of the TRIPS Agreement in order to refuse to grant protection to a name, from the other Party, for products covered by this Agreement.

(iii) with respect to intellectual property rights, the Agreement on TRIPS.

The Council for TRIPS shall oversee the functioning of the Agreement on Trade-Related Aspects of Intellectual Property Rights (hereinafter referred to as the "Agreement on TRIPS").

Without prejudice to Articles 22 and 23 of the TRIPS Agreement set out in Annex 1C of the Agreement establishing the World Trade Organisation, the Contracting Parties shall take all necessary measures, in accordance with that Annex, to ensure reciprocal protection of the names referred to in Article 5 which are used for the description and presentation of wines originating in the territory of the Contracting Parties.

Without prejudice to Articles 22 and 23 of the Agreement on Trade-Related Aspects of Intellectual Property Rights set out in Annex 1C of the Agreement establishing the World Trade Organisation (hereinafter called ` the TRIPS Agreement` ), the Parties shall take all the necessary measures, in accordance with that Annex, to ensure reciprocal protection of the designations referred to in Article 5 and used to describe spirit and aromatised drinks originating in the territory of the Parties.

(b) ` geographical indication` means any indication, including an ` Appellation of origin` , as defined in Article 22(1) of the Agreement on Trade Related Aspects of Intellectual Property Rights (hereinafter referred to as ` the TRIPS agreement` ), that is recognised by the laws or regulations of a Contracting Party for the purpose of describing and presenting a wine originating in the territory of that Contracting Party;

b. Analyze the reports submitted to the IRP, regarding all tuna-fishing trips made by vessels covered by this Agreement;

To facilitate industrial cooperation the Parties shall grant and ensure adequate and effective protection of intellectual property rights in the fields and sectors relevant to the development and operation of GALILEO/EGNOS, in accordance with the relevant international standards set by the TRIPS Agreement and international conventions to which both parties are signatories, including effective means of enforcing such standards.

Item 5.1.b of the Agreement requires the receiving Contracting Party to cover the costs of trips within its territory and board and lodging for the visiting scientists.

Each Party shall require its vessels with a carrying capacity greater than 363 metric tons (400 short tons) and that operate in the Agreement Area, to carry an observer during each fishing trip in the Agreement Area.

Members shall notify the laws and regulations referred to in paragraph 1 to the Council for TRIPS in order to assist that Council in its review of the operation of this Agreement.

The Council for TRIPS shall keep under review the application of the provisions of this Section; the first such review shall take place within two years of the entry into force of the WTO Agreement.

Notwithstanding the other provisions of this Article, amendments to the Agreement on TRIPS meeting the requirements of paragraph 2 of Article 71 thereof may be adopted by the Ministerial Conference without further formal acceptance process.

(a) The temporary importation and the re-exportation of service vehicles of a force or civilian component under their own power shall be authorized free of duty on presentation of a triptyque in the form shown in the Appendix to this Agreement.

The Council for TRIPS shall monitor the operation of this Agreement and, in particular, Members' compliance with their obligations hereunder, and shall afford Members the opportunity of consulting on matters relating to the trade-related aspects of intellectual property rights.

(iii) with respect to trade-related intellectual property rights, each of the categories of intellectual property rights covered in Section 1, or Section 2, or Section 3, or Section 4, or Section 5, or Section 6, or Section 7 of Part II, or the obligations under Part III, or Part IV of the Agreement on TRIPS;

The Council for TRIPS shall review the implementation of this Agreement after the expiration of the transitional period referred to in paragraph 2 of Article 65. The Council shall, having regard to the experience gained in its implementation, review it two years after that date, and at identical intervals thereafter.

During the time period referred to in paragraph 2, the Council for TRIPS shall examine the scope and modalities for complaints of the type provided for under subparagraphs 1(b) and 1(c) of Article XXIII of GATT 1994 made pursuant to this Agreement, and submit its recommendations to the Ministerial Conference for approval.

(b) A request for a waiver concerning the Multilateral Trade Agreements in Annexes 1A or 1B or 1C and their annexes shall be submitted initially to the Council for Trade in Goods, the Council for Trade in Services or the Council for TRIPS, respectively, for consideration during a time-period which shall not exceed 90 days.

The partners agree that it is necessary to define, by means of a tripartite dialogue within the period of validity of this agreement, the common orientations as well as the criteria to be followed in the formation and implementation of the wage policy at the levels of industries, companies, institutions and other organised forms.

(d) deriving from international agreements related to the protection of intellectual property which entered into force prior to the entry into force of the WTO Agreement, provided that such agreements are notified to the Council for TRIPS and do not constitute an arbitrary or unjustifiable discrimination against nationals of other Members.

Amendments merely serving the purpose of adjusting to higher levels of protection of intellectual property rights achieved, and in force, in other multilateral agreements and accepted under those agreements by all Members of the WTO may be referred to the Ministerial Conference for action in accordance with paragraph 6 of Article X of the WTO Agreement on the basis of a consensus proposal from the Council for TRIPS.

The Conference invites the Court of Auditors, the European Investment Bank and the Commission to maintain in force the present Tripartite Agreement.

Joint declaration related to article 24 (1) of the WTO TRIPs agreement

It is understood that this obligation is consistent with Article 14(4) of the TRIPS Agreement.

Whereas Article 34 of the TRIPs Agreement contains detailed provisions on the burden of proof which is binding on all Member States;

The Parties shall not deny the protection provided for by this Article in the circumstances specified in Article 24(4), (5), (6) and (7) of the TRIPs Agreement.

The Parties hereby waive their right to invoke Article 24(4) to (7) of the TRIPs Agreement in order to refuse to grant protection to a name from the other Party.

Copyright belonging to the Parties or to their participants shall be accorded treatment consistent with the Berne Convention (Paris Act 1971) and the TRIPS Agreement.

RECALLING their obligations as parties to the Agreement establishing the World Trade Organisation (hereinafter referred to as the 'WTO Agreement'), and in particular the provisions of the Agreement on the Trade Related Aspects of Intellectual Property Rights (hereinafter referred to as 'the TRIPs Agreement'),

This Directive shall be without prejudice to the obligations of the Member States pursuant to international agreements, and in particular the TRIPs Agreement and the Convention on Biological Diversity.

`intellectual property` shall have the meaning defined in Article 2 of the Convention establishing the World Intellectual Property Organisation, done at Stockholm, 14 July 1967 and the TRIPS Agreement;

South Africa hereby declares that it maintains its position in principle that the majority of names of Member States of the Community can not be protected as geographical indications in terms of the TRIPs Agreement.

The scope of protection for computer programs under Article 4 of this Treaty, read with Article 2, is consistent with Article 2 of the Berne Convention and on a par with the relevant provisions of the TRIPS Agreement.

The Parties agree that the provisions of Annex VI, Title I, fulfil their respective obligations under Article 24 (1) of the WTO TRIPs Agreement as far as the individual terms referred to in Appendix I of that Annex are concerned.

The scope of protection for compilations of data (databases) under Article 5 of this Treaty, read with Article 2, is consistent with Article 2 of the Berne Convention and on a par with the relevant provisions of the TRIPS Agreement.

(b) 'geographical indication' means the indication defined in Article 22(1) of the WTO TRIPs Agreement, which is protected under the laws and regulations of a Party for identifying a wine originating in a region or locality within that Party;

Whereas in order to ensure that all relevant Community legislation is in full compliance with the TRIPs Agreement, the Community must take certain measures in relation to current Community acts on the protection of intellectual property rights;

Chile shall amend its internal legislation in respect of any of the terms listed in Annex V (Agreement on trade in wines), Appendix I, as may be necessary so as no longer to assert that they are terms customary in common language as the common name for certain wines in Chile, as foreseen in Article 24(6) of the WTO TRIPs Agreement.

To that end, each Party shall make use of the appropriate legal means referred to in Article 23 of the WTO TRIPS Agreement to ensure an effective protection and prevent geographical indications from being used to describe wine not covered by the indications or descriptions concerned.

From the entry into force of this Agreement, the Parties shall grant, in accordance with the TRIPS Agreement, to each others companies and nationals, in respect of the recognition and protection of intellectual, industrial and commercial property, treatment no less favourable than that granted by them to any third country under bilateral agreements.
