(c) Poland in the course of the restructuring period has granted additional incompatible State aid to the steel industry and to the benefiting companies in particular, the transitional arrangements contained in this Title shall not have effect.

In many circumstances, such arrangements require approval under the State aid rules.

If no similar aid was granted under the previous national arrangements, and subject to the following provisions, no aid shall be granted in Spain on 1 March 1986.

If no similar aid was granted under the previous national arrangements, and subject to the following provisions, no aid shall be granted in Portugal on 1 March 1986.

For the purposes of these inspection arrangements, recipients of the flat-rate aid shall keep stock records which meet criteria to be determined.

however, a distinction should be maintained, as a transitional arrangement, for the 2000/2001 and 2001/2002 marketing years, with regard to fixing the amounts of aid applicable in the Community and a variation of the said aid;

the transitional arrangements set out in (a) to (f) above shall only come into effect if Poland grants aid in accordance with the conditions set out above.

The Member States concerned shall introduce inspection arrangements ensuring that products for which the flat-rate aid is applied do in fact qualify for it.

When a trade organization under the control of the Member State concerned is entrusted with the management of the consumption aid arrangements, the Member State in question may authorize such body to levy from the recipients of the aid a fee to cover the expenses incurred in managing such arrangements. The following are not included: labour working on the holding but employed by a third party or under mutual-aid arrangements (e.g. labour of agricultural contractors or cooperatives).

Member States shall, in so far as they are concerned, take the necessary measures to provide for sanctions in the event of breaches of the aid arrangements laid down in Articles 5 and 11.

Council Regulation (EC) No 2792/1999 of 17 December 1999 laying down the detailed rules and arrangements regarding Community structural assistance in the fisheries sector(3) covers modernisation of fishing vessels with public aid and public aid for the renewal of fishing vessels.

The arrangements regarding the existing aid schemes set out in Chapter 3 (Competition policy) of Annex IV to the Act of Accession of 16 April 2003 shall apply between the Contracting Parties.".

The quantities of the forecast supply balance under the specific supply arrangements for products which benefit from exemption from duties on imports from third countries or which benefit from Community aid, and the amounts of aid granted for the supply of Community products, shall be as set out for each product in:

However, on expiry of the arrangements under Regulation (EEC) No 1320/85, no compensatory amount shall be levied where it is proved that the Portuguese product has not benefited from Community aid granted to Portugal.

These arrangements shall, in particular, take into account that capacity, other than that of vessels of less than 12 metres overall length excluding trawlers, which has been withdrawn with public aid, cannot be replaced.

For the products benefiting from the aid arrangements provided for in Article 3 of Regulation (EEC) No 516/77 on the common organization of the market in fruit and vegetable processed products, the following provisions shall apply in Spain:

To take account of these new arrangements, Commission Regulation (EEC) No 2921/90 of 10 October 1990 on aid for the production of casein and caseinates from skimmed milk(6), as last amended by Regulation (EC) No 2501/1999(7), must be amended.

For the products benefiting from the aid arrangements provided for in Article 3 of Regulation (EEC) No 516/77 on the common organization of the markets in fruit and vegetable processed products, the following provisions shall apply to Portugal:

As new general rules for fleet capacity management and public aid have been introduced in Regulations (EC) No 2371/2002 and (EC) No 2792/1999 with effect from 1 January 2003, the specific arrangements for the outermost regions should also apply from that date.

For the purposes of applying Article 2 of Regulation (EC) No 1452/2001, Article 2 of Regulation (EC) No 1453/2001 and Article 2 of Regulation (EC) No 1454/2001, supply balances must be drawn up for the products covered by specific supply arrangements and the quantities of products covered by the specific supply arrangements must be laid down, together with the aid for supplies from the Community.

The level of Community aid to be granted for a given product in Spain from 1 March 1986 shall be equal to an amount defined on the basis of aids granted by the Kingdom of Spain, during a representative period to be determined, under the previous national arrangements.

The level of Community aid to be granted for a given product in Portugal from 1 March 1986 shall be equal to an amount defined on the basis of aids granted by the Portuguese Republic, during a representative period to be determined, under the previous national arrangements.

Commission Regulation (EEC) No 2958/93(2) laid down common detailed rules for implementing Regulation (EEC) No 2019/93 as regards the specific arrangements for the supply of certain agricultural products to the smaller Aegean islands and, pursuant to Article 3 of Regulation (EEC) No 2019/93, the amount of aid for this supply.

Undertakings benefiting from Article 21(7), (10) or (11) of Act LXXXI of 1996 on Corporate Tax and Dividend Tax or Article 93 of Act CXXV of 1999 on the Budget of 2000 of the Republic of Hungary, or from aid schemes that are not compatible with Articles 87 and 88 of the EC Treaty, shall not be entitled to the transitional arrangement under (a) above.

Whereas Commission Regulation (EC) No 659/97(3), as last amended by Regulation (EC) No 729/1999(4), lays down detailed rules for applying Regulation (EC) No 2200/96 as regards intervention arrangements in the fruit and vegetables sector and especially the free distribution of products withdrawn from the market as humanitarian aid outside the Community;

Community aid granted pursuant to Council Regulation (EC) No 3699/93 of 21 December 1993 laying down the criteria and arrangements regarding Community structural assistance in the fisheries and aquaculture sector for the processing and marketing of its products will, however, be implemented in accordance with the provisions in force of that Regulation.

Council Regulation (EC) No 1260/1999 of 21 June 1999 laying down general provisions on the Structural Funds(4) defines the general objectives and tasks of the Structural Funds and the Financial Instrument for Fisheries Guidance ("FIFG"), their organisation, the assistance methods, the programming and general organisation of the aid provided by the Funds and the general financial arrangements;

To take account of the special features of the various products in each sector, detailed arrangements for granting aid and establishing quantities for the supply of Community products to the outermost regions, as provided for in Article 3 of Regulation (EC) No 1452/2001, Article 3 of Regulation (EC) No 1453/2001 and Article 3 of Regulation (EC) No 1454/2001 respectively, should be laid down as required.

However, for products other than tomato products, in cases where the processing costs recorded in Spain for a product during a representative period to be determined, under the previous national arrangements, are lower by at least 10 % than the processing costs obtaining in the Community as at present constituted, the aid granted in Spain for this product shall be derived bearing in mind also the difference in the processing costs recorded.

Notwithstanding Article 3 (3), the principles concerning the general arrangements for regional aid, elaborated within the framework of the application of Articles 92 to 94 of the EEC Treaty and contained in the communication of the Commission of 23 June 1971 and also in the resolution of the Representatives of the Governments of the Member States, meeting in Council, of 20 October 1971, shall apply to the new Member States on 1 July 1973 at the latest.

whereas Council Regulations (EEC) No 98/69 of 16 January 1969 laying down general rules for the disposal of frozen beef and veal by intervention agencies(11), (EEC) No 989/68 of 15 July 1968 laying down general rules for granting private storage aid for beef and veal(12) and (EEC) No 1892/87 of 2 July 1987 on the recording of market prices in the beef and veal sector(13), the legal base of which was Regulation (EEC) No 805/68, are replaced by new arrangements in this Regulation and should therefore be repealed;

Operators in the new Member States are free to choose not to make use of these transitional provisions and apply the normal rules contained in Regulations (EC) No 1432/2003 and (EC) No 1433/2003 in Commission Regulation (EC) No 1943/2003 of 3 November 2003 laying down rules for the application of Council Regulation (EC) No 2200/96 as regards aid to producer groups granted preliminary recognition(4) and in Commission Regulation (EC) No 103/2004 of 21 January 2004 laying down detailed rules for implementing Council Regulation (EC) No 2200/96 as regards intervention arrangements and market withdrawals in the fruit and vegetable sector(5).

the rules governing aid to SMEs fn, while applicable in any part of the territory, offer only limited possibilities, in terms of aid intensity, outside areas assisted under regional aid arrangements,

Pursuant to Article 93(3), Member States are required to notify to the Commission for approval all plans to grant aid or to alter existing aid arrangements.

Lastly, arrangements should be made for allocating the quantities qualifying for aid where the limits are overrun.
