Following the approval by the Commission of the Programme and conclusion of the present Agreement, an Annual Financing Agreement shall be concluded each year.

after signing this Agreement, ratify, accept or approve it by the deposit of an instrument to that effect with the depositary.

The provisions of Articles 15 and 16 above shall not prevent the BOD from delegating to an individual the performance of the executive act of signing an agreement or a contract appropriately approved.

Subject to the approval of the Conference of the Parties to the Convention, an Agreement secretariat shall be established within the Secretariat of the Convention.

Before the conclusion by NAMO of any agreement or contract with a country not a member of NATO or a PfP State not a participant or with an international organisation(1) or any international agreement requiring parliamentary approval by a NATO member State, the BOD shall submit any such agreement or contract to the NAC for advance approval in principle.

When concluding an agreement, the Council may, by way of derogation from paragraphs 5, 6 and 9, authorise the negotiator to approve on the Union's behalf modifications to the agreement where it provides for them to be adopted by a simplified procedure or by a body set up by the agreement.

(g) The approval of an agreement with the United Nations under Articles 57 and 63 of the Charter of the United Nations shall require a majority of nine-tenths of the votes cast.

The Court shall be brought into relationship with the United Nations through an agreement to be approved by the Assembly of States Parties to this Statute and thereafter concluded by the President of the Court on its behalf.

Any amendments to this Agreement agreed by the Contracting Parties shall come into force when approved in accordance with the constitutional requirements of both Contracting Parties and as confirmed by an exchange of diplomatic notes.

(d) ` Regional Economic Integration Organisation` means an organisation constituted by sovereign States to which this Agreement applies and which has competence in matters covered by this Agreement and has been duly authorised, in accordance with its internal procedures, to sign, ratify, accept, approve or accede to it;

Before a revised agreement enters into force, the General Assembly of the Organisation shall define, under conditions determined by the present Agreement and by the Internal Rules in Article 10, to what extent the members party to the present Agreement, who have not deposited an instrument of acceptance, approval, ratification or accession may participate in the O.I.V's activities after it has entered into force.

(2) Subject to the prior approval of the Administrative Council, the European Patent Office shall also act as an International Searching Authority for any other applicant, in accordance with an agreement concluded between the Organisation and the International Bureau of the World Intellectual Property Organization.

(b) Appointment shall be conditional on the consent of the national Office or intergovernmental organization to be appointed and the conclusion of an agreement, subject to approval by the Assembly, between such Office or organization and the International Bureau.

To this end and to the extent required by the Board of Governors of the Agency, the Agency's safeguards rights and responsibilities provided for in paragraph A of Article XII of its Statute shall be implemented and maintained with respect to a project subject to this Agreement pursuant to an applicable safeguards agreement which is in force between the Government and the Agency or, in the absence of such an agreement, pursuant to a safeguards agreement to be concluded between the Government and the Agency prior to the implementation of the assistance approved for the project.

(2) Subject to the prior approval of the Administrative Council, the European Patent Office shall also act as an International Preliminary Examining Authority for any other applicant, in accordance with an agreement concluded between the Organisation and the International Bureau of the World Intellectual Property Organization.

Fifth freedom traffic rights shall be exercised between such points and the territory of the other Contracting Party after an agreement to that effect is reached between the designated airlines and approved by the respective Aeronautical Authorities of the two Contracting Parties.

(3) Subject to the prior approval of the Administrative Council, the European Patent Office may also act as a receiving Office for any other applicant, in accordance with an agreement concluded between the Organisation and the International Bureau of the World Intellectual Property Organization.

Such States Parties, as well as States Parties whose domestic law requires an act in furtherance of the agreement for purposes of the offences established in accordance with paragraph 1 (a) (i) of this article, shall so inform the Secretary-General of the United Nations at the time of their signature or of deposit of their instrument of ratification, acceptance or approval of or accession to this Convention.

Any State which does not have in service warships, military aircraft or other government ships or aircraft operated for non-commercial purposes, which would enable it to become an intervening State under this Agreement may, at the time of signature or when depositing its instrument of ratification, acceptance, approval or accession, by a declaration addressed to the Secretary General of the Council of Europe declare that it will not apply paragraphs 2 and 3 of this Article.

5 The Committee shall: a) establish its rules of procedure; b) conclude the Headquarters Agreement; c) establish the staff regulation for the Organisation; d) appoint, taking account of the ability of the candidates and an equitable geographical distribution, the senior officers of the Organisation; e) establish a regulation concerning the finances and book-keeping of the Organisation; f) approve the work programme, budget, management report and accounts of the Organisation;

In the event of the Secretary-General of the Council being designated as depositary of an agreement concluded in accordance with Article 24 of the Treaty on European Union or concluded by the Community and one or more States or international organisations, of a convention concluded between Member States or of a convention established pursuant to Article 34 of the Treaty on European Union, the acts of ratification, acceptance or approval of those agreements or conventions shall be deposited at the address of the Council.

Notwithstanding other provisions of this Annex, if the Director determines that the placement of an observer from the On-Board Observer Program is not practical, a vessel subject to the jurisdiction of a Party that fishes in the Agreement Area without setting on dolphins may use a trained observer from another international program, provided such program is approved by the Parties, to collect pertinent information for the On-Board Observer Program, and to confirm to the Director that such vessel does not set on dolphins.

These firms have already received PLN 37 160 000 of restructuring aid in the period 1997-2001; they shall receive further restructuring aid of no more than PLN 210 210 000 depending on the requirements set out in the approved restructuring plan (of which PLN 182 170 000 in 2002 and PLN 27 380 000 in 2003 if the extension of the grace period under Protocol 2 of the Europe Agreement establishing an association between the European Communities and their Member States, of the one part, and Poland, of the other part, is granted by the end of 2002, or otherwise PLN 210 210 000 in 2003).

(a) as regards Polskie Huty Stali (hereinafter referred to as "PHS"), the restructuring aid already granted or to be granted from 1997 until the end of 2003 shall not exceed PLN 3 140 360 000. PHS has already received PLN 62 360 000 of restructuring aid in the period 1997-2001; it shall receive further restructuring aid of no more than PLN 3 078 000 000 in 2002 and 2003 depending on the requirements set out in the approved restructuring plan (to be entirely paid out in 2002 if the extension of the grace period under Protocol 2 of the Europe Agreement establishing an association between the European Communities and their Member States, of the one part, and Poland, of the other part, is granted by the end of 2002, or otherwise in 2003);

“Loan-loss Cover Account” or “LLCA” means an account in euros to be constituted by the Bank in the name of the Guarantors, which is intended to mitigate risks assumed by the Member States under the Guarantee and shall be managed in accordance with the terms and conditions laid down by the Bank's governing bodies from time to time, as most recently approved on 12 June 2007. The LLCA shall be funded from (i) the income resulting from the application of risk-pricing on EIB Financing Operations, excluding ASLAs (as defined in the Guarantee) as approved by the Bank's governing bodies in accordance with its internal rules from time to time, (ii) Recovered Amounts and (iii) credit interest to be calculated at a daily interest rate, to be determined and notified by the Bank in accordance with the applicable principles from time to time laid down by the Bank's governing bodies, payable on a monthly basis. The LLCA shall be debited with (i) Guarantee Payments, pursuant to this Agreement, and (ii) the Recovery Administration Fee, provided there are sufficient funds in the account.

“Member State Call Account” or “MSCA” means an account in euros to be constituted by the Bank in the name of each Guarantor, which shall be managed in accordance with the terms and conditions laid down by the Bank's governing bodies from time to time, as most recently approved on 12 June 2007. The MSCAs shall be debited with (i) Guarantee Payments, pursuant to this Agreement, (ii) debit interest to be calculated at a daily interest rate, payable on a monthly basis, to be determined and notified by the Bank in accordance with the applicable principles from time to time laid down by the Bank's governing bodies and (iii) the Recovery Administration Fee. The MSCAs shall be credited by the Guarantors with (i) amounts equivalent to expected Guarantee Payments under the Guarantee and (ii) amounts in respect of any negative balance and accrued debit interest, and credited by the Bank with (i) Recovered Amounts and (ii) credit interest to be calculated at a daily interest rate, payable on a monthly basis, to be determined and notified by the Bank in accordance with the applicable principles from time to time laid down by the Bank's governing bodies.

Whereas it is appropriate to approve an Agreement in the form of an exchange of letters between the European Economic Community, the States referred to in Protocol 7 and Saint Christopher and Nevis on the accession of that country to Protocol 7,

The Agreement in the form of an Exchange of Letters concerning this extension should be approved,

It is in the Community's interest to approve the Agreement in the form of an Exchange of Letters,

Pending negotiations on changes to be made to the existing Protocol approved by Regulation (EC) No 722/2001(3), the two parties have decided to extend its validity for one year by means of an Agreement in the form of an Exchange of Letters.

Article 7 of the Agreement between the European Economic Community and Macao on trade in textile products(2), initialled on 19 July 1986 and approved by Council Decision 87/497/EEC, as last amended by an Agreement in the form of an Exchange of Letters, initialled on 22 December 1994 and approved by Council Decision 95/131/EC(3), provides that transfers may be agreed between categories and quota years.

On 9 July 2002 the ECSC and the Government of the Russian Federation concluded such an Agreement on trade in certain steel products(2), approved on behalf of the ECSC by Commission Decision 2002/603/ECSC(3).

Each Member State in which an application has been submitted in accordance with paragraph 1 shall adopt a decision in conformity with the approved assessment report, the summary of product characteristics and the labelling and package leaflet as approved, within 30 days after acknowledgement of the agreement.

In respect of the other States, this Agreement shall enter into force on the first day of the second month following the date of deposit of the instruments of ratification, acceptance or approval, at the earliest, however, on the date of bringing into force an Accession Agreement for these States to the 1990 Convention or to the 1996 Cooperation Agreement.

The Council has approved by decision 1999/867/EC(3) on the signing, on behalf of the European Community, of an Agreement in the form of an Exchange of Letters amending the Agreement between the European Community and the Republic of Uzbekistan on trade in textile and clothing products and other market-opening measures, and authorising its provisional application.

The Council has approved by Decision 2003/453/EC(2) the signing, on behalf of the European Community, of an Agreement in the form of an Exchange of Letters amending the Agreement between the European Community and the Socialist Republic of Vietnam on trade in textile and clothing products and other market-opening measures, and authorising its provisional application.

Whereas it is desirable to take into account the technical requirements adopted by the UN Economic Commission for Europe in its Regulations No 1 ("Uniform provisions for the approval of motor vehicle headlights emitting an asymmetrical passing beam or a driving beam or both") (5) and No 2 ("Uniform provisions concerning approval of incandescent electrical lamps for headlights emitting an asymmetrical passing beam or a driving beam or both") (5), which are annexed to the Agreement of 20 March 1958 concerning the adoption of uniform conditions for approval and reciprocal recognition of approval for motor vehicles equipment and parts;

Except where otherwise provided for in specific bilateral agreements, the representation arrangement shall not apply to visas issued to persons intending to take up paid employment or an activity which is subject to the prior approval of the State where it will take place.

Each Member State in which an application following paragraph 1 has been submitted shall adopt a decision in conformity with the approved assessment report, summary of product characteristics, labelling and package leaflet within 30 days after acknowledgement of the agreement.

The Agreement in the form of an Exchange of Letters extending for the period from 1 July 2003 to 30 June 2004 the validity of the Protocol setting fishing opportunities and a financial contribution as provided for in the Agreement between the European Economic Community and the Republic of Côte d'Ivoire on fishing off the coast of Côte d'Ivoire is hereby approved on behalf of the European Community.

The Agreement in the form of an Exchange of Letters between the European Community and Norway concerning the extension of the common communications network/common systems interface (CCN/CSI) within the framework of the Convention on a common transit procedure is hereby approved on behalf of the Community.
