Periodical payments to standard beneficiaries

The benefit shall be a periodical payment calculated as follows:

The SAPARD Agency shall ensure timely treatment of payment requests by beneficiaries.

The Republic of Slovenia shall ensure that payments from the SAPARD Agency to the beneficiary are:

Where the benefit consists of a periodical payment, it shall be granted throughout the contingency.

(5) A place of establishment shall be deemed a beneficial owner of the interest payments and the payments relating to property rights use, provided that:

(6) Where a place of establishment of a company of an EU Member State is deemed a paying agent or a beneficial owner of the interest payments or the payments relating to property rights use, no other part of the company concerned shall be deemed a paying agent or a beneficial owner of that interest payments or that payments relating to property rights use under this Article.

The benefit shall be: periodical payment granted to any person protected having completed the prescribed qualifying period; or

(4) The beneficial owner of the interest payments and the payments relating to property rights use referred to in the first paragraph of this Article shall be a company of the EU Member State other than Slovenia which is the recipient of the interest payments and the payments relating to property rights use for its own benefit.

Payment of benefits shall be made in accordance with Articles 83 and 84 of these Staff Regulations and with Article 28 of Annex VI.

The price actually paid or payable is the total payment made or to be made by the buyer to or for the benefit of the seller for the imported goods.

(b) amounts owed by beneficiaries for failing to respect conditions attached to payments made previously to them under the Programme by the SAPARD Agency.

Member States participating in the Agency shall jointly guarantee payment of such benefits in accordance with the scale laid down for financing such expenditure.

The relevant date for payments shall be the date on which the SAPARD Agency has sent the payment order to a financial institute or beneficiary or their assignee.

For the purposes of assessing a person's degree of disability or the person's ability to work where this is relevant for a claim for a benefit or for continued payment of a benefit, the Competent Institution of a Party shall apply the legislation of that Party.

No provision of this Agreement shall confer on a person any right to receive payment of a benefit in relation to a period before the date on which this Agreement comes into force.

Payment shall resume if, before the expiry of that period, the former member of the temporary staff again fulfils the said conditions and is not entitled to national unemployment benefit.

Payment shall be resumed if, before the expiry of that period, the former member of the contract staff again fulfils the said conditions and is not entitled to national unemployment benefit.

The payments and benefits provided for in this Section shall be suspended if the remuneration which a member of such staff receives in respect of his employment is suspended under these Staff Regulations.

1 Where classes of employees are protected, the benefit shall be a periodical payment calculated in such a manner as to comply either with the requirements of Article 65 or with the requirements of Article 66.

The payments and benefits provided for in this Section shall be suspended if the remuneration which a member of the temporary staff receives in respect of his employment, is suspended pursuant to these Staff Regulations.

The costs referred to in points 2 and 3 of the second paragraph of this Article shall be recognised. provided that the services or benefits in question are paid, however not exceeding the amount of such payment or reimbursement.

The beneficiary Member States shall submit, no later than six months after expiry of the three-year deadline, a comprehensive report on the financial execution of the lump-sum grant payments with a statement justifying the expenditure.

(6) Before the commencement of compliance detention, the perpetrator may propose to the court to substitute the payment of fine for the performance of a specific generally beneficial task or task to the benefit of the locally governed community.

On the lifting of the restrictions by the other Party and the payment of arrears by that other Party then the first Party shall also pay arrears of its benefits in relation to the entire time during which the first Party's restrictions were imposed.

If, when awarding or reviewing benefits in respect of invalidity, old-age or death pursuant to the Convention, the competent institution of one of the Contracting Parties has paid to a recipient of benefits a sum in excess of that to which he is entitled, that institution may request the competent institution of the other Party responsible for the payment of corresponding benefits to that recipient to deduct the amount overpaid from the arrears which it pays to the said recipient.

1 Where classes of employees or classes of the economically active population are protected, the benefit shall be a periodical payment calculated in such a manner as to comply with the requirements of Article 65 or with the requirements of Article 66.

Activities undertaken by the buyer on the buyer's own account, other than those for which an adjustment is provided in Article 8, are not considered to be an indirect payment to the seller, even though they might be regarded as of benefit to the seller.

The pertinent key control objectives include the correct and timely posting of all debtors' transactions to a debtors' ledger; debt offset from other SAPARD payments to beneficiaries which are in debt; and the correct posting of all receipts from debtors.

2 Where all residents whose means during the contingency do not exceed prescribed limits are protected, the benefit shall be a periodical payment calculated in such a manner as to comply with the requirements of Article 67; provided that a prescribed benefit shall be guaranteed, without means test, to the prescribed classes of employees determined in accordance with Article 21.a.

The Competent Institutions will exchange statistics on an annual basis regarding the payments which each has made under the Agreement; these statistics will include data on the number of beneficiaries and the cash value of benefits paid, by the type of benefits.

2 Where all residents whose means during the contingency do not exceed prescribed limits are protected, the benefit shall be a periodical payment calculated in such a manner as to comply with the requirements of Article 67; provided that a prescribed benefit shall be guaranteed, without means test, to the prescribed classes of persons determined in accordance with Article 15.a or b.

(f) where required by contractual obligations between the SAPARD Agency and the beneficiary or by provisions of the Programme, controls on beneficiaries after payment of aid to establish whether the terms and eligibility conditions of the grants continue to be respected.

(ii) the payment to the International Bureau, within the same time limit, of a fee of 23 Swiss francs, which shall be transferred by the International Bureau to the Office of the successor State, and of a fee of 41 Swiss francs for the benefit of the International Bureau.

In respect of suspension of earnings resulting from pregnancy and from confinement and their consequences, the benefit shall be a periodical payment calculated in such a manner as to comply either with the requirements of Article 65 or with the requirements of Article 66. The amount of the periodical payment may vary in the course of the contingency, subject to the average rate thereof complying with these requirements.

The Governing Body may, from time to time, review the levels of payment with a view to achieving fair and equitable sharing of benefits, and it may also assess, within a period of five years from the entry into force of this Treaty, whether the mandatory payment requirement in the MTA shall apply also in cases where such commercialized products are available without restriction to others for further research and breeding.

2 In case of partial loss of earning capacity likely to be permanent, or corresponding loss of faculty, the benefit, where payable, shall be a periodical payment representing a suitable proportion of that specified for total loss of earning capacity or corresponding loss of faculty.

While the measures in paragraph 6 are being implemented, the Party not imposing the restrictions set out in paragraph 6 may impose restrictions on the payment of its benefits paid under the Agreement in the territory of the other Party, until the other Party has lifted all such restrictions.

1 In the case of a periodical payment to which this article applies, the rate of the benefit, increased by the amount of any family allowances payable during the contingency, shall be such as to attain, in respect of the contingency in question, for the standard beneficiary indicated in the Schedule appended to this part, at least the percentage indicated therein of the total of the previous earnings of the beneficiary or his breadwinner and of the amount of any family allowances payable to a person protected with the same family responsibilities as the standard beneficiary.
