The rule prohibiting cumulation refers to cumulation of two penalties of the same kind, that is to say criminal law penalties.

The cumulation provided for in this Article may only be applied to materials and products which have acquired originating status by the application of rules of origin identical to those given in this Protocol.

The Commission of the European Communities shall publish in the Official Journal of the European Communities (C series) the date on which the cumulation provided for in this Article may be applied by those countries listed in paragraph 1 which have fulfilled the necessary requirements.

In respect of investments in projects except those in infrastructure of a type not generating substantial net revenue, the SAPARD Agency shall ensure that the cumulation of public aid granted under the Programme from all sources does not exceed 50% of total eligible cost of any project.

The Commission of the European Communities shall publish in the Official Journal of the European Communities (C series) the date on which the cumulation, provided for in this Article may be applied by those countries listed in paragraph 1 which have fulfilled the necessary requirements.

Avoidance of cumulation of aid measures to a single enterprise.

The following provisions shall apply to the cumulation of public aids to the fishing fleet:

Bilateral cumulation

In order to avoid any cumulation, it should not be possible for grants to be awarded to finance twice the same action or for operating expenditure for the same year.

Pursuant to Decision 2001/822/EC, ACP/OCT or EC/OCT cumulation of origin is allowed for the quantities laid down in that Decision for the products falling within CN Chapter 17 and CN codes 1806 10 30 and 1806 10 90.

Article 4(c) of Commission Regulation (EC) No 192/2002 of 31 January 2002 laying down detailed rules for issuing import licences for sugar and sugar and cocoa mixtures with ACP/OCT or EC/OCT cumulation of origin(2), contains certain entries in all the languages of the Member States.

Importation of products falling within CN Chapter 17 and CN codes 1806 10 30 and 1806 10 90 with ACP/OCT or EC/OCT cumulation of origin shall be subject to production of an import licence issued in accordance with Regulation (EC) No 1291/2000, save where this Regulation provides otherwise.

For such measures, and unless the Member State undertakes that these enterprises will receive no other State aid other than de minimis aid, the Member State should propose to the Commission for examination and approval a reasonable evaluation of the aid element of the measure which will be used for applying the cumulation rules.

cross-checks on declared agricultural parcels and animals in order to avoid undue multiple granting of the same aid in respect of the same calendar or marketing year and to prevent any undue cumulation of aid granted under Community aid schemes involving declarations of areas as referred to in Article 9a of Regulation (EEC) No 3508/92;

This Regulation should not exempt aid cumulated with other State aid, including aid granted by national, regional or local authorities, with public support granted within the framework of Regulation (EC) No 1257/1999 or with Community assistance, in relation to the same eligible costs, when such cumulation exceeds the thresholds fixed in this Regulation.

Whereas a new point should be added to section "G. IRELAND" and another to section "O. UNITED KINGDOM" of Annex VI in order to take into account the specific rules of priority in the event of cumulation of entitlement to family allowances under United Kingdom and Irish legislation through the exercising of a professional activity in the territory of one of those two Member States;
