Limiting one's autonomy should be understood as a stepwise, rather than abrupt all-or-nothing way of restricting one's right to self determination.

? Article 47(2) and (3) correspond to Article 6(1) of the ECHR, but the limitation to the determination of civil rights and obligations or criminal charges does not apply as regards Union law and its implementation

(6) The court may determine a fine below the prescribed limit if so determined by the law or if it establishes that special mitigating circumstances are in place, which justify the determination of a more lenient sanction.

In cases where the number of exporters, producers, importers or types of products involved is so large as to make such a determination impracticable, the authorities may limit their examination either to a reasonable number of interested parties or products by using samples which are statistically valid on the basis of information available to the authorities at the time of the selection, or to the largest percentage of the volume of the exports from the country in question which can reasonably be investigated.

The lower limit of the determination is 5 ppm.

MRLs should be fixed at the lower limit of analytical determination where there are no authorised uses.

Whereas it also seems desirable, in accordance with current international practice, to replace the maximum levels relating to amitrole, endrin and TEPP, hitherto expressed as "zero", by finite levels set at or about the lower limit of determination;

However, where the result obtained is above the limit laid down in Article 52(1) of Regulation (EC) No 1782/2003, a second determination shall be carried out per analysis sample and the mean value of the two determinations shall be taken as the result.

Where no legal use of a pesticide is allowed and where no residues can be tolerated it is appropriate that the MRL established at the appropriate lower limit of analytical determination on fresh produce, apply also on the composite and processed products.
