The disclosure of information to and the consultation of representatives of the employees of the offeror and the offeree company should be governed by the relevant national provisions, in particular those adopted pursuant to Council Directive 94/45/EC of 22 September 1994 on the establishment of a European Works Council or a procedure in Community-scale undertakings and Community-scale groups of undertakings for the purposes of informing and consulting employees(4), Council Directive 98/59/EC of 20 July 1998 on the approximation of the laws of the Member States relating to collective redundancies(5), Council Directive 2001/86/EC of 8 October 2001 supplementing the statute for a European Company with regard to the involvement of employees(6) and Directive 2002/14/EC of the European Parliament and of the Council of 11 March 2002 establishing a general framework for informing and consulting employees in the European Community - Joint declaration of the European Parliament, the Council and the Commission on employee representation(7).
Razkritje informacij in posvetovanje med predstavniki zaposlenih ponudnika in ciljne družbe urejajo ustrezne nacionalne določbe, zlasti tiste, ki so sprejete skladno z Direktivo Sveta 94/45/ES z dne 22. septembra 1994 o ustanovitvi Evropskega sveta delavcev ali uvedbi postopka obveščanja in posvetovanja z delavci v podjetjih ali povezanih podjetjih na območju Skupnosti [4], Direktivo Sveta 98/59/ES z dne 20. julija 1998 o približevanju zakonodaje držav članic v zvezi s kolektivnimi odpusti [5], Direktivo Sveta 2001/86/ES z dne 8. oktobra 2001 o dopolnitvi Statuta evropske družbe glede udeležbe delavcev [6] in Direktivo Evropskega parlamenta in Sveta 2002/14/ES z dne 11. marca 2002 o določitvi splošnega okvira za obveščanje in posvetovanje z delavci v Evropski skupnosti – Skupno deklaracijo Evropskega parlamenta, Sveta in Komisije o zastopanju delavcev [7].
