Financial asset shall mean any asset that is:

The SFRY's financial assets comprised all financial assets of the SFRY (such as cash, gold and other precious metals, deposit accounts, and securities), including in particular -

(3) In the case of financial lease, a taxable person who has acquired the tangible fixed asset on the basis of financial lease may claim a reduction of the tax basis subject to the first and second paragraphs of this Article.

The General Assembly shall decide the financial contribution of any new members on the basis of the provisions of Annexes 1 and 2 to this Agreement.

Except as otherwise specifically provided, all financial matters related to the Court and the meetings of the Assembly of States Parties, including its Bureau and subsidiary bodies, shall be governed by this Statute and the Financial Regulations and Rules adopted by the Assembly of States Parties.

Such a reduction shall not exceed 50 per cent of the annual assessed financial contribution of a State Party, but may be spread over successive years.

The financial records of SELEC, including the accounts established pursuant to the budget showing income and expenditures, and the balance sheet showing SELEC's assets and liabilities, shall be subject to an external financial audit.

The Committee referred to in paragraph 1 shall confirm that the financial statements, as well as any other financial information contained in the annual accounts drawn up by the Board of Directors, give a true and fair view of the financial position of the Bank in respect of its assets and liabilities, and of the results of its operations and its cash flows for the financial year under review.

The Council shall retain any assessments or contributions paid to the financial accounts established under Article 18 by a member that ceases to be a party to this Agreement.

(6) In the case of financial lease, the provision of the fifth paragraph of this Article shall also apply if the lessor loses the right to use the tangible fixed asset in question.

Upon the final disbursement under this Agreement, Slovenia shall submit to Switzerland a final report assessing the accomplishment of the objective of this Agreement and a final financial statement on the use of the Contribution, based on the financial audits of the Projects.

(a) allow free access to and provide copies of such records and data requested by any successor State as are in its possession and relate to the SFRY's financial assets and liabilities.

When adopting resolutions and decisions, the assemblies shall take into account the foreseeable financial implications and should avoid adopting resolutions and decisions, which might give rise to expenditure in excess of the financial limits laid down by the Plenipotentiary Conference.

(d) If the financial situation of the Union so permits, the Assembly may decide that any contributions paid under subparagraph (a) be reimbursed to the Contracting States which have paid them.

The aggregate report should provide main financial indicators including turnover, profit, cash flow from operating activities, gross investment, return on equity, equity/asset ratio and dividends.

Every member of the O.I.V shall pay a financial contribution decided each year by the General Assembly, the amount of which shall be determined by applying the provisions of Annexes 1 and 2 to this Agreement.

The Assembly may ask WIPO to grant financial assistance to facilitate the participation of delegations of Contracting Parties that are regarded as developing countries in conformity with the established practice of the General Assembly of the United Nations or that are countries in transition to a market economy.

(b) exchange information on those accounts and financial assets held by banks in third States and belonging to connected persons (as defined by the authorities which in those States regulate the banking business).

The aim of the conference is to assess and process the claim including the apportioning of financial responsibility in accordance with the principles of Article VIII of the NATO SOFA, as implemented by the PfP SOFA.

(2) The available foreign financial assets identified in paragraph (1) of this Article shall be distributed according to the following proportions, which shall be applied to items (i), (ii), (iii) and (iv) separately:

Where an asset management company is part of a financial conglomerate, any reference to the notion of regulated entity and any reference to the notion of competent authorities and relevant competent authorities shall therefore, for the purposes of this Directive, be understood as including, respectively, asset management companies and the competent authorities responsible for the supervision of asset management companies.

The General Assembly shall nominate a financial auditor, under the same conditions, on a joint proposal from the Director General and the O.I.V Steering Committee with the favourable opinion of the Executive Committee.

Before the end of each financial biennium, the Council shall approve the budget for the Administrative Account of the Organization for the following biennium and shall assess the contribution of each member to that budget.

(7) The auditing of the accounts shall be effected by one or more of the countries of the Union or by external auditors, as provided in the financial regulations. They shall be designated, with their agreement, by the Assembly.
