(f) to assemble, publish or disseminate information regarding exploitable living marine resources and fisheries based on these resources;

Such measures shall remain in force until there are sufficient data to allow assessment of the impact of the fisheries on the long-term sustainability of the stocks, whereupon conservation and management measures based on that assessment shall be implemented.

States shall also collect where appropriate and provide to the relevant subregional or regional fisheries management organisation or arrangement information to support stock assessment, including:

(b) ensure that data are collected in sufficient detail to facilitate effective stock assessment and are provided in a timely manner to fulfil the requirements of subregional or regional fisheries management organisations or arrangements, and

States shall collect and make available to the relevant subregional or regional fisheries management organisation or arrangement the following types of data in sufficient detail to facilitate effective stock assessment in accordance with agreed procedures:

Request the IATTC to initiate investigations to assess whether the fishing capacity of vessels fishing in the Agreement Area poses a threat to the sustainability of tuna stocks and other living marine resources associated with the fishery and, if so, examine possible measures and recommend their adoption whenever appropriate.

A strategic environmental assessment shall be carried out for plans and programmes which are prepared for agriculture, forestry, fisheries, energy, industry including mining, transport, regional development, waste management, water management, telecommunications, tourism, town and country planning or land use, and which set the framework for future development consent for projects listed in annex I and any other project listed in annex II that requires an environmental impact assessment under national legislation.

c) require impact assessments to be carried out in order to provide a basis for either allowing or prohibiting the continuation or the future development of activities that may affect cetaceans or their habitat in the Agreement area, including fisheries, offshore exploration and exploitation, nautical sports, tourism and cetacean-watching, as well as establishing the conditions under which such activities may be conducted;

Take measures, according to their capacities, to assess the catch and bycatch of juvenile yellowfin tuna and other stocks of living marine resources related to the purse-seine tuna fishery in the Agreement Area and establish measures in accordance with Article VI to, inter alia, avoid, reduce and minimize the bycatch of juvenile yellowfin tuna and bycatch of non-target species, in order to ensure long-term sustainability of all these species, taking into consideration the interrelationships among species in the ecosystem.

Council Regulation (EEC) No 3760/92 of 20 December 1992 establishing a Community system for fisheries and aquaculture(3) provides for regular assessments by the Scientific, Technical and Economic Committee for Fisheries (hereinafter referred to as the STECF) of the situation as regards fishery resources, and its economic implications.

Whereas, to ensure proper use of scientific, technical and economic data for assessing the situation with regard to fisheries and foreseeable developments therein, a committee of an advisory nature should be set up;

Having regard to the fishery management responsibilities of the Commission, the Council agrees to provide the Commission with all relevant reports of its Working Groups on stock assessment and of its Advisory Committee on Fishery Management.

For vessels exempt from the obligation to keep a logbook the flag Member State shall carry out checks by sampling to assess the overall effort deployed in a fishery.

(b) allocate the level of fishing effort assessed conforming to subparagraph (a) in each ICES area or CECAF division, with regard to each of the fisheries mentioned in subparagraph (a).

In the area defined in paragraph 1, Member States shall assess the levels of fishing effort exerted by vessels equal to or more than 10 metres in length overall, as an annual average of the period 1998 to 2002, for demersal fisheries, excluding those covered by Regulation (EC) No 2347/2002, and fisheries for scallops, edible crab and spider crab, and allocate the level of fishing effort thus assessed for each of those fisheries.

The fishing effort of fishing vessels equal to or less than 15 metres in length overall shall be assessed globally for each fishery and area or division referred to in Article 3(1) during the period 1998 to 2002.

for specific stocks additional measuring units apart from those defined in Appendix V, may be used on condition that they comply with the specifications established by the regional fisheries organisations involved in the assessment of these stocks.

(4) The Commission needs to be informed by the Member States of the progress and the results of the pilot projects, in particular in order to assess the cost-effectiveness of the technologies to be used for improving the effectiveness of fisheries control.

(a) assess the levels of fishing effort exerted by vessels equal to or more than 15 metres in length overall, as an annual average of the period 1998 to 2002, in each of the ICES areas and CECAF divisions referred to in Article 1 for demersal fisheries, excluding demersal fisheries, those covered by Council Regulation (EC) No 2347/2002 of 16 December 2002 establishing specific access requirements and associated conditions applicable to fishing for deep-sea stocks(9) and fisheries for scallops, edible crab and spider crab, as laid down in the Annex to this Regulation.

Whereas the principal aims of the common marketing standards for fishery products are to improve products quality and thus make marketing easier to the benefit of both producers and consumers; whereas, since fishery products are unprocessed and are marketed fresh or chilled, their quality is determined largely by their freshness, which is assessed on the basis of objective criteria by organoleptic examination; whereas, if batches of fishery products are to be uniformly fresh, they must consist of products of the same species, and may come from the same fishing grounds and the same vessel only;

Whereas, in view of normal practice in most Member States, it is advisable that the industry should grade fishery products for freshness and size; whereas, with a view in particular to assessing freshness on the basis of organoleptic criteria, provision should be made for the collaboration of experts appointed for this purpose by the trade organizations concerned;

The Commission shall consider all notified infringements committed by third-country vessels, assessing the seriousness of each case in the light of judicial and administrative decisions by the competent authorities in the Member States and in particular of the commercial benefits which the vessel owner may have enjoyed and the impact of the infringement on fishery resources.

to assess the impact, including the social and the economic impact, on the processing industry of measures taken on behalf of the CFP such as measures envisaged by Council Regulation (EEC) No 3759/92 (1), Council Regulation (EC) No 2792/1999 (2), and specific measures adopted for the fisheries and aquaculture sector of the most remote regions (programme of options specific to remoteness and to insularity, POSEI).

The evaluation of the sector's resources and economic situation requires biological data to be collected covering all catches, including discards, fish stock evaluations independent of the commercial fisheries for a set of resources, the collection of information on catch capacities and the fishing efforts used, and data explaining price formation and enabling the economic situation of fishing enterprises and the processing industry to be assessed, as well as job trends in these sectors.

The fishing effort of vessels below that limit shall be assessed globally for each fishery.

In order to assess the effects of cod by-catches in the redfish and flatfish fisheries on the Flemish Cap:

assess information provided by members and relevant fisheries organisations or programmes on catches, fishing effort, and other data relevant to the conservation and management of fisheries;

to assemble, publish or disseminate information regarding exploitable living marine resources and fisheries based on these resources;

Whereas the implementation of a policy for the conservation and management of fishery resources is becoming more and more vital in the Mediterranean region in order to preserve its fishery assets and to turn them to good account for the benefit, in particular, of the coastal populations;

allocate the level of fishing effort assessed conforming to subparagraph (a) in each ICES area or CECAF division, with regard to each of the fisheries mentioned in subparagraph (a).

Whereas, pursuant to Article 5 of the said Regulation, the Member States have submitted to the Commission lists of named vessels for each fishery, an assessment of the necessary fishing effort for each fishery and, where appropriate, details of the proposed arrangements for regulating fishing effort;

A special financial contribution of up to 50 % of eligible expenditure per Member State per year may be granted for implementing a system to assess expenditure incurred in controlling the common fisheries policy.

whereas, since fishery products are unprocessed and are marketed fresh or chilled, their quality is determined largely by their freshness, which is assessed on the basis of objective criteria by organoleptic examination;

With regard to each fishery for the catching of demersal species as defined in Annex I, the Member States shall assess the fishing effort necessary, on the basis of Community criteria for assessing the fishing efforts defined in Annex II.

The Commission needs to be informed by the Member States of the progress and the results of the pilot projects, in particular in order to assess the cost-effectiveness of the technologies to be used for improving the effectiveness of fisheries control.

Article 16 of Council Regulation (EEC) No 3760/92 of 20 December 1992 establishing a Community system for fisheries and aquaculture(3), provides that the situation as regards fishery resources, and its economic implications, needs to be assessed regularly.

assess the levels of fishing effort exerted by vessels equal to or more than 15 metres in length overall, as an annual average of the period 1998 to 2002, in each of the ICES areas and CECAF divisions referred to in Article 1 for demersal fisheries, excluding demersal fisheries, those covered by Council Regulation (EC) No 2347/2002 of 16 December 2002 establishing specific access requirements and associated conditions applicable to fishing for deep-sea stocks(9) and fisheries for scallops, edible crab and spider crab, as laid down in the Annex to this Regulation.

note that Canada will request annually that the NAFO Scientific Council carry out an assessment of the stock taking into account all relevant scientific evidence including the findings and supporting data of the Canadian Atlantic Fisheries Scientific Advisory Committee;

Unprocessed fishery products belonging to the species categories listed in Annex I shall be regarded as unfit for human consumption where, organoleptic assessment having raised doubts as to their freshness, chemical checks reveal that the following TVB-N limits are exceeded:

request the ITTC to initiate investigations to assess whether the fishing capacity of vessels fishing in the Agreement Area poses a threat to the sustainability of tuna stocks and other living marine resources associated with the fishery and, if so, examine possible measures and recommend their adoption whenever appropriate.

Specific provisions that do not contain discretionary elements, allowing for example tax to be determined on a fixed basis (for example, in the agriculture or fisheries sectors), may be justified by the nature and general scheme of the system where, for example, they take account of specific accounting requirements or of the importance of land in assets which are specific to certain sectors;

to assess the impact, including the social and the economic impact, on the processing industry of measures taken on behalf of the CFP such as measures envisaged by Council Regulation (EEC) No 3759/92(9), Council Regulation (EC) No 2792/1999(10), and specific measures adopted for the fisheries and aquaculture sector of the most remote regions (programme of options specific to remoteness and to insularity, POSEI).

Commission Regulation (EC) No 1886/2000 of 6 September 2000 laying down detailed rules for the application of Council Regulation (EC) No 104/2000 as regards the extension to non-members of certain rules adopted by producers' organisations in the fisheries sector(3) contains in particular criteria for assessing the degree of representativeness of producers' organisations in the catch sector that are not suitable for the aquaculture sector.

take measures, according to their capacities, to assess the catch and by-catches of juvenile yellowfin tuna and other stocks of living marine resources related to the purse-seine tuna fishery in the Agreement Area and establish measures in accordance with Article VI, inter alia, to avoid, reduce and minimise the by-catches of juvenile yellowfin tuna and by-catches of non-target species, in order to ensure long-term sustainability of all these species, taking into consideration the interrelationships among species in the ecosystem.

Before 31 December 1997, the Council shall take a decision on a proposal submitted by the Commission, by 30 June 1997 at the latest, for amendments to Council Regulation (EEC) No 2847/93 of 12 October 1993 establishing a control system applicable to the common fisheries policy (7) and in particular as regards Title IIa on the recording of data on fishing effort in the logbook, the procedures for forwarding the lists of named vessels to the Commission, the collection of data on fishing effort by the Member States and the forwarding of the assembled data on fishing effort to the Commission, in order to ensure compliance with the arrangements for the management of fishing effort referred to in this Regulation.

While the EFTA States will not take over the 'acquis communautaire` concerning the fishery policy, it is understood that, where reference is made to aid granted through State resources, any distortion of competition is to be assessed by the Contracting Parties in the context of Articles 92 and 93 of the EEC Treaty and in relation to relevant provisions of the 'acquis communautaire` concerning the fishery policy and the content of the Joint Declaration regarding Article 61(3)(c) of the Agreement.

While the EFTA States will not take over the 'acquis communautaire` concerning the fishery policy, it is understood that, where reference is made to legislation relating to the organization of the market, any distortion of competition caused by such legislation is to be assessed in relation to the principles of the 'acquis communautaire` concerning the common organization of the market.
