Exceptions could be made, for instance, in the following cases:

If the court of second instance establishes that a severe violation of civil procedure provisions (Article 339) has occurred, it shall set aside the judgment of first instance by a decree and remand the case to the same court of first instance or to a competent court of first instance for a new main hearing.

- local courts as courts responsible for deciding misdemeanours in the first instance;

- higher courts as courts responsible for deciding misdemeanours in the second instance.

When a judgment of first instance is set aside and the case remanded to the court of first instance for re-examination of facts, the statement of ground shall indicate the points in which the determination of the state of facts made by the court of first instance comes short or is erroneous, as well as wherein the presentation of new facts and evidence is important for a correct decision and why such evidence and facts affect the correctness of the adjudication process.

If, prior to this Act entering into force, a ruling or a resolution was issued at the first instance in accordance with the provisions of the Administrative Disputes Act with which the procedure before the court of first instance was concluded, the procedure shall be continued in accordance with the previous Act.

If the revising court establishes a severe violation of the civil procedure provisions referred to in the first and second paragraph of Article 339 on the ground of which a revision may be lodged, except of those stated in the second and third paragraphs of the present Article, it shall by a decree set aside, in whole or in part, the judgments of the court of second instance and of the court of first instance, or only the judgment of the court of second instance, and remand the case for reconsideration to the same or a different panel of the court of first or of second instance, or to some other competent court.

In many instances, SOE boards are not granted full responsibility and the authority required for strategic guidance, monitoring of management and control over disclosure.

(1) Against a misdemeanour decision issued in the first instance by a misdemeanour authority using fast-track proceedings a request for judicial protection may be lodged.

(b) Best environmental practices such as good housekeeping, preventive maintenance programmes, or process changes such as closed systems (for instance in cokeries or use of inert electrodes for electrolysis);

The ministry responsible for spatial planning and construction matters shall be the relevant administrative body for construction matters that issues building permits for works of national importance in the first instance.

If, after this Act has entered into force, a first-instance decision as referred to in the first paragraph of this article is annulled, the procedure shall be continued in accordance with this Act.

The period of temporary importation shall not exceed six months in the first instance but may, with the agreement of the exporting country, be extended for a further period subject to the same conditions.

(1) A request for protection of legality may be lodged against any decision issued in the second instance or against any final decision, if this Act or regulation governing the misdemeanour has been violated.

In such instances the Secretary-General shall perform the duties of a depositary and shall also ensure that the dates of entry into force of such agreements or conventions are published in the Official Journal.

When a judgment of first instance is set aside for a severe violation of civil procedure provisions, the statement of ground shall also indicate which provisions have been violated and what the violation consist of..

The investor may choose to submit the dispute for resolution according to paragraph 2b only until there has been a decision concerning the same claim in the first instance in the proceedings according to paragraph 2a.

(9) If the only reason for repealing the judgement issued by the court in the first instance is a mistake in the finding of facts, and only a different assessment of the already-established facts is required for a correct judgement, where at the same time no new evidence is required, the higher court shall not repeal the judgement issued by the court in the first instance, but shall act in accordance with paragraph 7 of this article.

If the court of first instance renders the decree for suspension of the proceedings while the case is being heard in the appellate proceedings, the high court conducting these proceedings shall be advised of such decree.
