The person subject to inspection shall pay the compensation for environmental degradation and usurpation on the basis of a ruling issued ex officio by the relevant administrative body for construction matters, if it is found in the procedure for issuing the building permit or amending the building permit that it relates to a specific type of unallowable construction, or when the relevant building inspector sends the person subject to inspection a ruling issued pursuant to the provisions of Articles 152 to 155 of this act.

If during a phytosanitary inspection a quarantine pest is found, or some other violations of the plant quarantine regulations of the importing country are ascertained, then competent bodies of the Contracting Parties are entitled to refuse the import of such commodity of plant origin, or to destroy it or to perform other urgent phytosanitary measure.

If, despite an executable ruling on the rectification of the deficiencies identified, the investor fails to rectify the deficiencies, the relevant administrative body for construction matters shall via a ruling deny the issue of a permit of use and shall inform the relevant building inspector of such.
(3) Če pristojni upravni organ za gradbene zadeve po ponovnem tehničnem pregledu ugotovi, da investitor ni odpravil vseh ugotovljenih pomanjkljivosti, se investitorju znova izda odločba, da mora v določenem roku odpraviti ugotovljene pomanjkljivosti. Če pa investitor, kljub izvršljivi odločbi o odpravi ugotovljenih pomanjkljivosti, teh pomanjkljivosti ne odpravi, pristojni upravni organ za gradbene zadeve z odločbo zavrne izdajo uporabnega dovoljenja in o tem seznani pristojnega gradbenega inšpektorja.

If, in a procedure for issuing a permit of use that commenced prior to the entry into force of this act, the administrative body responsible for construction matters has not yet appointed a technical inspection commission, the procedure may at the request of the investor continue pursuant to the provisions of this act if the investor appends a project for the operation and maintenance of the works formulated in accordance with the provisions of this act to the request.
(4) Če v postopku za izdajo uporabnega dovoljenja, ki se je začel pred uveljavitvijo tega zakona, upravni organ, pristojen za gradbene zadeve, še ni imenoval komisije za tehnični pregled, se lahko takšen postopek na zahtevo investitorja nadaljuje po določbah tega zakona, če investitor zahtevi priloži projekt za obratovanje in vzdrževanje objekta, izdelan v skladu z določbami tega zakona.

(6) If an official body referred to in the previous paragraph or an aviation inspector finds that implementation of basic security inspections or the security of controlled and security clear areas is not ensured in compliance with Article 125 of this Act, the minister responsible for internal affairs, in agreement with the minister responsible for transport, shall determine the extent and manner of security and the deadline for introducing such works or shall order secutity by the police until the remedying of the deficiencies.

If by the entry into force of this act the constructions or works specified in the second paragraph of the previous article have not acquired a location permit in accordance with the ZUN or a building permit or a standard permit for construction in accordance with the ZGO, the construction inspection measures defined by this act shall begin to be applied two years after the entry into force of this act, if the owners fail to lodge the request prescribed by this act for the issue of a building permit with the relevant construction body.

Following the final technical inspection, which may also be conducted by a single member of the commission, only those inbuilt installations, technological appliances and equipment for which the quality of the works performed and the material built in is being determined, and the parameters achieved by the technological process shall be inspected, and it shall be verified whether the parameters achieved by the technological process ensure health and safety at work and fire safety and do not exceed the environmental impact permitted by regulations. On this basis the relevant administrative body for construction matters shall then issue a permit of use.
(2) Po zaključnem tehničnem pregledu, ki ga lahko opravi tudi posamezen član komisije, se pregledajo le tiste vgrajene inštalacije, tehnološke naprave oziroma oprema, pri katerih se je v poskusnem obratovanju ugotavljala kvaliteta opravljenih del, vgrajenega materiala ter doseženi parametri tehnološkega procesa in preverjalo, ali doseženi parametri tehnološkega procesa zagotavljajo varnost in zdravje pri delu ter varstvo pred požarom in ne presegajo s predpisi dovoljenih vplivov na okolje. Na tej podlagi nato pristojni upravni organ za gradbene zadeve izda uporabno dovoljenje.
