The Council declared that the instruction of Europol to deal with `` fraud` as one of the forms of crime referred to in the Annex to the Europol Convention confers, as far as tax fraud and customs fraud is concerned, competences to Europol only in the field of improvement of the effectiveness and cooperation of the competent authorities of the Member States responsible for the functioning of the criminal law enforcement system and not their authorities responsible for ensuring the levying of taxes and customs duties.
Svet je sklenil, da se z navodilom Europolu pri obravnavi ` goljufije` kot oblike kaznivega dejanja, navedene v prilogi h Konvenciji o Europolu, in sicer glede davčnih utaj in carinskih goljufij, dodeli pristojnost samo na področju izboljšanja učinkovitosti in sodelovanja pristojnih organov držav članic, ki so odgovorni za delovanje sistema kazenskega pregona, in ne njihovih organov, ki so odgovorni za pobiranje davkov in carinskih dajatev.

When the constitutional law of the importing Member does not permit the levying of anti dumping duties on such a basis, the importing Member may levy the anti dumping duties without limitation only if (a) the exporters shall have been given an opportunity to cease exporting at dumped prices to the area concerned or otherwise give assurances pursuant to Article 8 and adequate assurances in this regard have not been promptly given, and (b) such duties cannot be levied only on products of specific producers which supply the area in question.

For the purposes of this Agreement, the term ` expropriation` shall also include interventions or regulatory measures by a Contracting Party that have a de facto expropriatory effect, in that their effect results in depriving the investor in fact from his ownership, control or substantial benefits over his investment or which may result in loss or damage to the economic value of the investment, such as the freezing or blocking of the investment, levying of arbitrary or excessive taxes on the investment, compulsory sale of all or part of the investment, or other comparable measures.

If a municipality fails to harmonise an ordinance on compensation for the use of construction land with the provisions of this article by the deadline specified in the previous paragraph, after the deadline specified in the previous paragraph passes the levying of compensation for the use of construction land shall begin on the occupied and vacant construction land stipulated by this article, whereby in stipulating the amount of compensation for the use of vacant construction land the point value stipulated by the ordinance on compensation for the use of occupied construction land adopted prior to the entry into force of this act shall apply as if buildings specified in the third paragraph of this article had already been constructed on the area with vacant construction land.
(5) Če občina v roku iz prejšnjega odstavka odloka o nadomestilu za uporabo stavbnega zemljišča ne uskladi z določbami tega člena, se po preteku roka iz prejšnjega odstavka začne z odmerjanjem nadomestila za uporabo stavbnega zemljišča od tistih zazidanih in nezazidanih stavbnih zemljišč, ki jih določa ta člen, pri določanju višine nadomestila za uporabo nezazidanega stavbnega zemljišča pa uporablja vrednost točke, določene z odlokom o nadomestilu za uporabo zazidanega stavbnega zemljišča, sprejetim pred uveljavitvijo tega zakona, kot da bi bile na območju z nezazidanim stavbnim zemljiščem stavbe iz tretjega odstavka tega člena že zgrajene.
