(1) Interest on loans, excluding the cases involving borrowers - banks and insurance undertakings, received from a shareholder or partner who, at any point in the tax period, directly or indirectly holds no less than 25% of shares or holdings in the capital or voting rights of the taxable person, provided that the loans in question exceed, at any point in the tax period, the fourfold of the amount of the holding of the shareholder or partner in the taxable person's capital (hereinafter: surplus of loans), established with regard to the amount and the duration of the surplus of loans in the tax period, shall not be recognised as expenditure.

Until 31 December 2006, the competent authorities of the Member State may also authorise their credit institutions to apply a 50% risk weighting to the part of the loans fully and completely secured to their satisfaction by shares in Finnish housing companies operating in accordance with the Finnish Housing Company Act of 1991 or subsequent equivalent legislation, provided that the conditions laid down in this paragraph are fulfilled.
Do 31. decembra 2006 lahko pristojni organi v državi članici dovolijo svojim kreditnim institucijam, da 50 % tehtajo tveganje pri delu posojila, ki je v celoti in povsem zavarovano v njihovo korist z deleži v finskih stanovanjskih podjetjih, ki poslujejo v skladu s finskim Zakonom o stanovanjskih podjetjih iz leta 1991 ali naknadno sprejeto enakovredno zakonodajo, če so izpolnjeni pogoji iz tega odstavka.

Member States or the competent authorities may include fixed-term cumulative preferential shares referred to in point (8) of Article 34(2) and subordinated loan capital referred to in that provision in own funds, if binding agreements exist under which, in the event of the bankruptcy or liquidation of the credit institution, they rank after the claims of all other creditors and are not to be repaid until all other debts outstanding at the time have been settled.
Države članice ali pristojni organi lahko kumulativne prednostne delnice s fiksno dividendo iz točke (8) člena 34(2) in podrejeni dolžniški kapital iz navedene določbe vključijo v lastne vire sredstev, če obstajajo zavezujoče pogodbe, v skladu s katerimi so pri stečaju ali likvidaciji kreditne institucije te postavke uvrščene za terjatve vseh drugih upnikov in se ne poplačajo, dokler niso poravnani vsi drugi takrat neplačani dolgovi.
