In particular where undertakings are deprived of access to viable alternatives because of the need to protect the environment, public health, public security or to meet town and country planning objectives, Member States may impose the sharing of facilities or property (including physical co-location) on an undertaking operating an electronic communications network or take measures to facilitate the coordination of public works only after an appropriate period of public consultation during which all interested parties must be given an opportunity to express their views.

Without prejudice to Article 31 of Directive 2002/22/EC of the European Parliament and of the Council of 7 March 2002 on universal service and users' rights relating to electronic communications networks and services (Universal Service Directive)(16), Member States shall not maintain legal or administrative measures which oblige operators, when granting access or interconnection, to offer different terms and conditions to different undertakings for equivalent services and/or imposing obligations that are not related to the actual access and interconnection services provided without prejudice to the conditions fixed in the Annex of Directive 2002/20/EC (Authorisation Directive).

It is considered necessary to ensure the continued application of the existing provisions relating to the minimum set of leased line services in Community telecommunications legislation, in particular in Council Directive 92/44/EEC of 5 June 1992 on the application of open network provision to leased lines(6), until such time as national regulatory authorities determine, in accordance with the market analysis procedures laid down in Directive 2002/21/EC of the European Parliament and of the Council of 7 March 2002 on a common regulatory framework for electronic communications networks and services (Framework Directive)(7), that such provisions are no longer needed because a sufficiently competitive market has developed in their territory.
Za potrebno se šteje zagotovitev nadaljnje uporabe veljavnih predpisov v zvezi z minimalnim naborom storitev zakupljenih vodov v zakonodaji Skupnosti o telekomunikacijah, zlasti v Direktivi Sveta 92/44/EGS z dne 5. junija 1992 o uporabi sistema zagotavljanja odprtosti omrežja pri zakupljenih vodih, dokler nacionalni regulativni organi ne presodijo, da v skladu s postopki tržne analize, določenimi v Direktivi 2002/21/ES Evropskega parlamenta in Sveta z dne 7. marca 2002 o skupnem regulativnem okviru za elektronska komunikacijska omrežja in storitve (Okvirna direktiva), taki predpisi niso več potrebni, ker se je na njihovem ozemlju razvilo dovolj konkurenčno tržišče.
