Pri popolni ali delni izgubi blaga mora prevoznik plačati le odškodnino, ki se izračuna na podlagi borzne cene, ali če je primerno, cene na trgu, če pa nobena od teh dveh vrst cen ni na razpolago, na podlagi običajne vrednosti blaga iste vrste in kakovosti na dan in v kraju, v katerem je bilo blago prevzeto.

(5) It appears that the most suitable solution is to decrease strongly the intervention price and to create, as a compensation an income payment per farm and a crop specific aid reflecting the role of rice production in traditional production areas.
(5) Zdi se, da je najustreznejša rešitev znatno znižati intervencijsko ceno in kot nadomestilo oblikovati plačilo prihodka po kmetiji in pomoč glede na proizvod, ki bosta odražala pomen proizvodnje riža na tradicionalnih pridelovalnih območjih.

Member States may set a maximum level for the compensation or supplement but the amount of the supplement thus fixed added to the amount of the Community withdrawal compensation may not exceed the maximum level of withdrawal prices applying in the 1995/1996 marketing year in accordance with Article 16 (3) (a), Article 16 (a), Article 16 (b) and the first indent of Article 18 (1) (a) of Regulation (EEC) No 1035/72.
Države članice lahko določijo za nadomestilo ali dodatek najvišjo raven, vendar višina zneska tako določenega dodatka, prištetega k znesku za nadomestilo Skupnosti za umik s trga, ne sme biti višja od najvišje ravni cen za umik s trga, ki so se uporabljale v tržnem letu 1995/1996 v skladu s členom 16(3)(a), 16(b) in s prvo alineo člena 18(1) Uredbe (EGS) št. 1035/72.
