(1) Prior to the issue of an operating license, the Administration shall require proof of good repute of the persons who will continuously and effectively manage the operations of the undertaking, or proof that they are not in bankruptcy or proof that a license has not been suspended or revoked because of serious professional misconduct or a criminal offence.

Moreover, in keeping with the institutions` fraud prevention commitments, when officials or other servants learn of evidence giving cause to suppose that cases of fraud, corruption or any other illegal activity, or serious professional misconduct may have occurred, they must inform their immediate superior without delay or, if they consider it useful, the Secretary-General or the Anti-fraud Office directly (Bureau decision of 25 October 1999).

Therefore, on the basis of their administrative autonomy, all the institutions, bodies and offices and agencies should entrust to the Office the task of conducting internal administrative investigations with a view to bringing to light serious situations relating to the discharge of professional duties which may constitute a failure to comply with the obligations of officials and servants of the Communities, as referred to in Articles 11, 12, second and third paragraphs, 13, 14, 16 and 17, first paragraph, of the Staff Regulations of Officials and the Conditions of Employment of Other Servants of the European Communities (hereinafter referred to as 'the Staff Regulations'), detrimental to the interests of those Communities and liable to result in disciplinary or, in appropriate cases, criminal proceedings, or serious misconduct, as referred to in Article 22 of the Staff Regulations, or a failure to comply with the analogous obligations of the Members or staff of the European Parliament not subject to the Staff Regulations;

Whereas therefore, on the basis of their administrative autonomy, all the institutions, bodies and offices and agencies should entrust to the Office the task of conducting internal administrative investigations with a view to bringing to light serious situations relating to the discharge of professional duties which may constitute a failure to comply with the obligations of officials and servants of the Communities, as referred to in Articles 11, 12, second and third paragraphs, 13, 14, 16 and 17, first paragraph, of the Staff Regulations of Officials and the Conditions of Employment of Other Servants of the European Communities (hereinafter "the Staff Regulations"), detrimental to the interests of those Communities and liable to result in disciplinary or, where appropriate, criminal proceedings, or serious misconduct, as referred to in Article 22 of the Staff Regulations, or a failure to comply with the analogous obligations of the Members, managers or members of staff of the institutions, bodies, offices and agencies of the Communities not subject to the Staff Regulations or a failure to comply with the obligations imposed by Community Law on Members of the Council and of its bodies in the context of the professional duties they perform in that capacity;
ker morajo zato vse institucije, organi in uradi ter agencije na podlagi svoje upravne neodvisnosti uradu zaupati nalogo izvajanja notranjih upravnih preiskav, da bi se razkrile resne napake pri opravljanju poklicnih dolžnosti, ki lahko pomenijo neizpolnjevanje obveznosti uradnikov in uslužbencev Skupnosti iz členov 11, 12, drugi in tretji odstavek, 13, 14, 16 in 17, prvi odstavek, Kadrovskih predpisov za uradnike in pogojev za zaposlovanja drugih uslužbencev Evropskih skupnosti (v nadaljevanju "Kadrovski predpisi"), ki škodijo interesom teh Skupnosti in pri katerih obstaja možnost uvedbe disciplinskega in v nekaterih primerih kazenskega postopka, ali grobo kršitev delovnih obveznosti iz člena 22 Kadrovskih predpisov, ali neizpolnjevanje podobnih obveznosti članov Sveta, vodilnih delavcev ali članov osebja institucij, organov, uradov in agencij Skupnosti, za katere ne veljajo Kadrovski predpisi, ali neizpolnjevanje obveznosti, ki jih predpisuje zakonodaja Skupnosti za člane Sveta in njegova telesa glede poklicnih dolžnosti, ki jih opravljajo v tej funkciji;

Komisija mora zato na podlagi svoje upravne neodvisnosti uradu zaupati nalogo izvajanja notranjih upravnih preiskav, da bi se razkrile resne napake pri opravljanju poklicnih dolžnosti, ki lahko pomenijo neizpolnjevanje obveznosti uradnikov in uslužbencev Skupnosti iz členov 11, 12, drugi in tretji odstavek, 13, 14, 16 in 17, prvi odstavek, Kadrovskega predpisa za uradnike Evropskih skupnosti in pogojev za zaposlovanja drugih uslužbencev (v nadaljevanju "Kadrovski predpis"), ki škodijo interesom teh Skupnosti in pri katerih obstaja možnost uvedbe disciplinskega in v določenih primerih kazenskega postopka, ali grobo kršitev delovnih obveznosti iz člena 22 Kadrovskega predpisa, ali neizpolnjevanje podobnih obveznosti članov Komisije ali članov osebja Komisije, za katere ne velja Kadrovski predpis.
