All quarantine costs occasioned by the application of the present Decision shall be borne by the importer.

Council Directive 92/65/EEC of 13 July 1992 laying down animal health requirements governing trade in and imports into the Community of animals, semen, ova and embryos not subject to animal health requirements laid down in specific Community rules referred to in Annex A(I) to Directive 90/425/EEC(2), as last amended by Commission Decision 2001/298/EC(3), provides for an alternative system to quarantine for the entry of certain domestic carnivores into the territory of certain Member States free from rabies.

'Quarantine' refers to Decision 2000/666/EC for birds and Directive 92/65/EC for birds and cats and dogs.

Bird quarantine facilities or centres approved in accordance with Article 18(1) fourth indent of Directive 92/65/EEC and Decision 2000/666/EC.

it is convenient and appropriate to broaden the scope of that Decision in order to include the approved quarantine facilities or centres for imported birds other than poultry.

Commission Decision 2000/666/EC (3), as last amended by Decision 2001/383/EC (4), laid down the animal health and certification requirements for the imports of birds other than poultry, and the conditions for their quarantine.

Member States communicate the list of approval numbers of the approved quarantine facilities or centres and the name and ANIMO-number of the responsible Local Veterinary Unit to the other Member States and to the Commission as well as changes to that list, in accordance with the provisions of Decision 2001/ 106/EC.

(7) However, the importation of birds other than poultry, including pet birds accompanying their owners has also been suspended from the United States of America by Decision 2004/187/EC as an additional measure in order to exclude any possible risk for disease occurrence in quarantine stations under the authority of the Member States.

(6) In accordance with Commission Decision 2000/666/EC fn importation of birds other than poultry is authorised from all member countries of the OIE (World Organisation for Animal Health) subject to animal health guarantees provided by the country of origin, and to strict post-import quarantine measures implemented in the Member States.

Member States shall provide the Commission and the other Member States, before 1 August 2005, with the information on quantities imported prior to that date pursuant to this Decision and with a detailed technical report of the examination and/or tests carried out on these plants during the quarantine period referred to in point 10 of the Annex.

(6) In accordance to Commission Decision 2000/666/EC fn (4) importation of birds other than poultry is authorised from all member countries of the OIE (World Organisation for Animal Health) and subject to animal health guarantees provided by the country of origin and to strict post-import quarantine measures in the Member States, thus preventing the possible introduction of poultry diseases into Community poultry flocks.

Whereas Article 1 of Commission Decision 97/427/EC of 25 June 1997 laying down special conditions for the import of live bivalve molluscs, echinoderms, tunicates and marine gastropods originating in Australia(3), states that the Department of Primary Industries and Energy - Australian Quarantine and Inspection Service (AQIS) shall be the competent authority in Australia for verifying and certifying compliance of fishery and aquaculture products with the requirements of Directive 91/492/EEC;

(17) However, given the exceptional disease situation in several Asian countries and the potential serious consequences related to the specific avian influenza virus strains involved, as an additional precautionary measure the importation of birds other than poultry, and also of pet birds accompanying their owners into the Community from Cambodia, Indonesia, Japan, Laos, Pakistan, People's Republic of China including the territory of Hong Kong, South Korea, Thailand and Vietnam has been suspended by Commission Decision 2004/93/EC fn in order to exclude any possible risk for disease occurrence in quarantine stations under the authority of the Member States.

Certain Member States have requested additional time to fully prepare for the implementation of the requirements for the quarantine laid down in the above decision.

Pursuant to Commission Decision 2000/86/EC(3), the State Administration for Entry/Exit Inspection and Quarantine (CIQ SA) is the competent authority in China for verifying and certifying compliance of fishery and aquaculture products in accordance with the requirements of Directive 91/493/EEC.

In accordance with Commission Decision 2000/666/EC(5) importation of birds other than poultry is authorised from all member countries of the OIE (World Organisation for Animal Health) subject to animal health guarantees provided by the country of origin, and to strict post-import quarantine measures implemented in the Member States.

For the material referred to in point 1, the testing method for Pseudomonas solanacearum (Smith) Smith shall be the interim test scheme set out in the Annex to the Commission decision to be taken in order to replace the quarantine procedure No 26 for Pseudomonas solanacearum (Smith) Smith as established by the European and Mediterranean Plant Protection Organization (EPPO).

Whereas Article 1 of Commission Decision 94/766/EC of 21 November 1994 laying down special conditions governing the import of fishery and aquaculture products originating in Taiwan(3) as last amended by Decision 96/255/EC(4), which states that the Bureau of Commodity Inspection and Quarantine (BCIQ) shall be the Competent Authority in Taiwan for verifying and certifying compliance of fishery and aquaculture products with the requirements of Directive 91/493/EEC;

In accordance with Commission Decision 2000/666/EC(13), importation of birds other than poultry was authorised from all member countries of the OIE (World Organisation for Animal Health), subject to animal health guarantees provided by the country of origin and to strict post-import quarantine measures in the Member States, thus preventing the possible introduction of poultry diseases into Community poultry flocks.

However, given the exceptional disease situation in several Asian countries and the potential serious consequences related to the specific avian influenza virus strains involved, as an additional precautionary measure the importation of birds other than poultry, and also of pet birds accompanying their owners into the Community from Cambodia, Indonesia, Japan, Laos, Pakistan, People's Republic of China including the territory of Hong Kong, South Korea, Thailand and Vietnam has been suspended by Commission Decision 2004/93/EC(14) in order to exclude any possible risk for disease occurrence in quarantine stations under the authority of the Member States.
