If the high court has passed a decision on a means of ordinary judicial review by an unanimous vote, a note on deliberation and voting shall be made on the script of the challenged decision instead of drawing up of a record.

(5) Data from records may be processed for a period of five years of the day decisions become final by misdemeanour authorities, courts, state prosecutor's offices, the police, other state authorities within the limits of their jurisdiction, parties and other participants, who on the basis of procedural acts are entitled to examine and copy court records applying to individual cases; other users may use this data only if they are legally authorised for using it.

Where the Commission, after a preliminary examination, finds that the notified measure does not constitute aid, it shall record that finding by way of a decision.

Where it concludes that the concentration notified does not fall within the scope of this Regulation, it shall record that finding by means of a decision.

"Decision to implement a joint public contract" shall mean a decision adopted by the Joint Public Procurement Operator on the basis of the authorisation given by Contracting Authorities for easier recording of joint public contracts.

(2) If the Office finds that the concentration notified does not fall within the scope of the provisions of this Act, it shall record that finding by means of a special decision.
