Where the trade mark contains an element which is not distinctive, and where the inclusion of said element in the trade mark could give rise to doubts as to the scope of protection of the trade mark, the Office may request, as a condition for registration of said trade mark, that the applicant state that he disclaims any exclusive right to such element.

The proprietor of a trade mark may invoke the rights conferred by that trade mark against a licensee who contravenes any provision in his licensing contract with regard to its duration, the form covered by the registration in which the trade mark may be used, the scope of the goods or services for which the licence is granted, the territory in which the trade mark may be affixed, or the quality of the goods manufactured or of the services provided by the licensee.
Imetnik znamke lahko uveljavi pravice iz znamke proti pridobitelju licence, ki ravna v nasprotju s katerokoli določbo v licenčni pogodbi v zvezi s trajanjem, z obliko, zajeto v registraciji, v kateri se lahko uporablja znamka, obsegom blaga ali storitev, za katerega je podeljena licenca, ozemljem, na katerem se znamka lahko uporabi, ali kakovostjo proizvedenega blaga oziroma opravljenih storitev, ki jih opravlja pridobitelj licence.
