Right of verification and compulsory collection of statistical information

For the verification and the compulsory collection of statistical information, national procedures shall be followed.

EC verification may, at the choice of the manufacturer, be carried out by checking and testing each appliance as specified in point 5.3 or by checking and testing the appliance on a statistical basis as specified in point 5.4.

Whereas, for the verification of the statistical data which it has to present under the protocol on the Excessive Deficit Procedure, the Commission is informed about and must assess certain specific transactions which have an impact on GDP or GNP;

Whereas, in 1980 and 1985 the Statistical Office of the European Communities carried out a verification of the weightings for all Member States in accordance with the method for adjusting the remuneration of officials and other servants of the European Communities;

The ECB or the competent national central bank shall notify the reporting agent in writing of its decision to verify statistical information or to collect it compulsorily, specifying the time limit for compliance with the verification request, the sanctions applicable in the case of non-compliance and the right to review.

However, should the statistical information concerned be necessary in order to demonstrate compliance with minimum reserve requirements, the verification should be carried out in accordance with Article 6 of Council Regulation (EC) No 2531/ 98 of 23 November 1998 concerning the application of minimum reserves by the European Central Bank (1).

Whereas the provisions of this Regulation can be effectively applied only if participating Member States in their entirety have adopted the necessary measures with a view to ensuring that their authorities have the powers to assist and collaborate fully with the ECB in carrying out the verification and compulsory collection of statistical information, in conformity with Article 5 of the Treaty,

When a reporting agent opposes or obstructs the verification process or the compulsory collection of the required statistical information, the participating Member State in which the reporting agent's premises are located shall afford the necessary assistance, including ensuring access to the reporting agent's premises by the ECB or the national central bank so that the rights mentioned in paragraph 1 can be exercised.

Whereas it is the task of the Governing Council of the ECB to specify the division of tasks between the ECB and the national central banks concerning the collection and verification of statistical information and their enforcement, taking into account the principle laid down in Article 5.2 of the Statute, as well as the tasks which will be assumed by national authorities within the limits of their competence, for the purposes of obtaining statistics of a consistently high quality,

When carrying out statistical verification according to section 6, the notified body has to decide when statistical procedures for lot-by-lot inspection or isolated lot inspection have to be applied.

If justified on practical grounds, the manufacturer may affix the CE mark during manufacture, under the responsability of the notified body, in accordance with Article 12, accompanied by the identifying logo of the notified body responsible for statistical verification.

The notified body shall carry out EC verification by controls and tests on the products on a statistical basis as specified in 5.

The statistical interpretation of the verification of the sulphur content of the gas oils used shall be carried out in accordance with ISO standard 4259 (1992).

After verification, and in accordance with the utilization programme defined by the Commission, they shall forward the results of the survey, including the data declared confidential by the Member States pursuant to domestic legislation or practice concerning statistical confidentiality, in accordance with the provisions of Council Regulation (Euratom, EEC) No 1588/90 of 11 June 1990 on the transmission of data subject to statistical confidentiality to the Statistical Office of the European Communities (1).

Whereas the actual concept of the system resides in the use of related administrative networks, and in particular that of the value added tax (VAT) authorities, to provide the statistical services with a minimum degree of indirect verification without thereby increasing the burden on taxpayers;

When the measures of length are manufactured in series and the person responsible for submitting them for EEC initial verification states that they have already been adequately inspected, at his request the lots submitted shall undergo a statistical check by attributes under the following conditions.

Whereas the framework Directive 71/316/EEC has been adapted to technical progress in the manufacture of measuring instruments and accordingly permits statistical checks to be carried out for the purposes of EEC initial verification in accordance with the procedure laid down in the separate Directives;

However, should the statistical information concerned be necessary in order to demonstrate compliance with minimum reserve requirements, the verification should be carried out in accordance with Article 6 of Council Regulation (EC) No 2531/98 of 23 November 1998 concerning the application of minimum reserves by the European Central Bank (8).

Whereas it is the task of the Governing Council of the ECB to specify the division of tasks between the ECB and the national central banks concerning the collection and verification of statistical information and their enforcement, taking into account the principle laid down in Article 5.2 of the Statute, as well as the tasks which will be assumed by national authorities within the limits of their competence, for the purposes of obtaining statistics of a consistently high quality;
