1. He acts as the responsible land surveyor but fails to fulfil the conditions for the responsible land surveyor (third paragraph of Article 45).

1. As responsible land surveyor it appoints an individual that fails to fulfil the conditions for the responsible land surveyor (third paragraph of Article 45).

(2) The status of a responsible land surveyor shall be defined by regulations on land surveying activities.

6. The base section for land surveyors

5.4.1.3 Of relevance to the port State control officer or the surveyor authorized by the port State Administration is the following:

.3 has served at least 2 years as a flag State surveyor dealing with surveys and certification in accordance with the relevant instruments.

When an officer of the Administration, a nominated surveyor or recognized organization has notified the appropriate authorities of the port State, the Government of the port State concerned shall give such officer, surveyor or organization any necessary assistance to carry out their obligations under this Regulation.

3. The marking-out is carried out by a land surveyor that fails to fulfil the conditions stipulated by land surveying regulations (third paragraph of Article 80).

A fine of SIT 20,000 to 120,000 for a misdemeanour shall be imposed upon an individual that is acting as the responsible land surveyor pursuant to the provisions of this act if:

If the residue quantities cannot be reduced by alternative measures the port State control officer or the surveyor authorized by the port State Administration will inform his Administration.

A responsible land surveyor shall be appointed for the formulation of land surveying plans that make up project documentation in accordance with the regulations governing land surveying activities.

5.4.1.16 The port State control officer or the surveyor authorized by the port State Administration must be aware that certain ` oil like` noxious liquid substances may be carried on product carriers.

(6) The marking-out plan shall be signed by the responsible land surveyor and the contractor, and may also be signed by the authorised representative of the municipality if such is present at the marking-out.

5.4.1.7 On boarding and introduction to the master or responsible ship officer's, the port State control officer or the surveyor authorized by the port State Administration will examine the necessary documentation.

In this case the port State control officer or the surveyor authorized by the port State Administration must endorse in the Cargo Record Book under section K whenever the required residual concentration has been achieved.

5.4.1.4 When tank washing is required without the use of water the port State control officer or the surveyor authorized by the port State Administration is to be informed about the tank washing procedure and disposal of residues.

A properly qualified port State control officer must have completed a minimum of one year` s service as a flag State surveyor dealing with surveys and certification in accordance with the relevant instruments and be in possession of:

.1 due account has been given to the requirements contained in Regulation I/11(c) of SOLAS 74 regarding notification to the flag State Administration, the nominated surveyor or the recognized organization responsible for issuing the relevant certificate;

The marking-out of the works shall be carried out as a land surveying service pursuant to the regulations on land surveying activities. The marking-out shall be carried out by a land surveyor that fulfils the conditions stipulated by land surveying regulations.

A fine of SIT 300,000 to 2,000,000 for a misdemeanour shall be imposed upon a sole trader that when acting as the land surveyor pursuant to the provisions of regulations on land surveying activities commits any of the offences specified in the previous paragraph.

(6) When a nominated surveyor or recognized organization determines that the condition of the equipment does not correspond substantially with the particulars of the certificate, they shall ensure that corrective action is taken and shall in due course notify the Administration.

9. It shall ensure the provision of professional examinations for responsible land surveyors.

5.4.1.15 In addition to 5.4.1.13 of this Annex, the port State control officer or the surveyor authorized by the port State Administration must endorse the Cargo Record Book whenever the unloading, stripping or prewash of category B, C and D substances, in accordance with the P and A Manual, has actually been witnessed.

For the control of ships carrying such substances, the Control Procedures under Annex I to MARPOL 73/78 apply. The port State control officer or the surveyor authorized by the port State Administration exercising control in accordance with Regulation 8 of Annex II to MARPOL 73/78 must be thoroughly acquainted with Annex I to MARPOL 73/78.

5.4.1.10 The port State control officer or the surveyor authorized by the port State Administration, in accordance with Regulation 8 of Annex II to MARPOL 73/78, will ascertain that unloading, stripping and/or prewash operations are carried out in conformance with the information obtained in accordance with 5.4.1.2 of this Annex (Documentation).

(8) Whenever an accident occurs to a ship or a defect is discovered, which substantially affects the efficiency or completeness of its equipment covered by this Annex, the master or owner of the ship shall report at the earliest opportunity to the Administration, a nominated surveyor, or recognized organization responsible for issuing the relevant certificate.

5.4.1.1 The port State control officer or the surveyor authorized by the port State Administration exercising control in accordance with Regulation 8 of Annex II to MARPOL 73/78 must be thoroughly acquainted with Annex II to MARPOL 73/78 and the custom of the port as of relevance to cargo handling, tank washing, cleaning berths, prohibition of lighters alongside, etc.

5.4.1.13 The port State control officer or the surveyor authorized by the port State Administration must endorse the Cargo Record Book under section J whenever an exemption referred to under 5.4.1.12.3, 5.4.1.12.4 and 5.4.1.12.5 of this Annex has been granted, or whenever a tank having unloaded category A substances has been prewashed in accordance with the P and A Manual.

The Administration may, however, entrust the surveys either to surveyors nominated for the purpose or to organizations recognized by it.

The IZS shall provide professional examinations for responsible land surveyors in accordance with the rules specified in the fifth paragraph of the previous article.

These inspections may be carried out by their own inspection service, nominated surveyors, recognized organizations, or by other Parties upon request of the Administration.

The standards of knowledge and the programme for the professional examination for responsible land surveyors in the provision of land surveying services, and the manner in which it is held, shall be set out by rules adopted pursuant to the act of law governing land surveying activities.

Individuals that in accordance with this act fulfil the conditions for responsible project designers in construction and other project design, responsible auditors, responsible works managers and responsible supervisors, individuals that in accordance with land surveying regulations fulfil the conditions for responsible land surveyors in the provision of land surveying services and, if so stipulated by law, other engineers may associate together within the IZS.

The ZAPS may be demerged from the IZS/97 and commence performing functions in accordance with the provisions of this act when representatives of the base section for architects, landscape architects and urban planners at the IZS/97 on one side and representatives of the base sections for civil engineers, mechanical engineers, electrical engineers, engineering technologists, mining and geotechnology engineers and land surveyors at the IZS/97 on the other side conclude an agreement on demerger among themselves.

Where the competent authorities have well-founded reasons to doubt that the vessel covered by the application for the scrapping premium is in good working order, they may request a surveyor to certify that the vessel concerned is in a technical condition to carry goods.

fees for agricultural consultants, surveyors, accountants, tax consultants, lawyers, etc.;

purchases of services connected with the acquisition of ownership of land, buildings and other existing fixed capital goods, such as fees for intermediaries, solicitors, surveyors, engineers, etc. as well as fees for entries in the land register (cf. ESA 95, 3.111).

(f) for surveyors:

Conditions of nationality for publicly appointed surveyors.

Wherever there is a need for qualitative assessment of the fulfilment of class-related provisions, host States shall ensure the necessary expertise is included in the team, where appropriate by including a surveyor of a recognised organisation.

Access to profession of surveyors and geologists through natural persons only.

As a minimum, 100 exclusive surveyors are needed to meet the requirements in paragraph 2.

This incompatibility shall also apply to surveyors employed by the recognised organisation.

the requirements of the statutory work for which the organisation is authorised are only carried out by its exclusive surveyors or by exclusive surveyors of other recognised organisations;

(c) fees for agricultural consultants, surveyors, accountants, tax consultants, lawyers, etc.;

professional charges or commissions incurred, such as fees paid to surveyors, engineers, lawyers, valuers, etc., and commissions paid to estate agents, auctioneers, etc.;

a supervisory system is in place which monitors the actions and work carried out by surveyors and technical and administrative staff employed directly by the organisation;
