Every member of crew, who possess one of the document mentioned in Article 12 of this Agreement and visa, if required, is entitled to transit trough State territory of the other Contracting Party in the cases as follows:

(2) Each Contracting Party shall within its territory and in accordance with the law in force facilitate the issuance of transit documents for temporary imports and exports of scientific equipment and samples to be used for research using the Company's facilities.

Subject to the provisions of Article 2, in a case coming within the immediately preceding paragraph, transit of the person in custody through the territory of a third State, Party to this Convention, shall be granted on application, accompanied by all necessary documents, addressed by the Ministry of Justice of the requesting Party to the Ministry of Justice of the Party through whose territory transit is requested.

With regard to consignments imported or in transit, the competent authority shall carry out documentary checks at regular intervals, and at least twice a year, on the channelling chain from the border inspection posts of first entry to the approved technical plant in case of import, and to the border inspection post of exit in case of transit, for the purpose of reconciliation of the quantities of animal by-products imported, used and disposed of, ensuring compliance with this Regulation and with Regulation (EC) No 1774/2002.

Where the T5 control copy or the national document proving that the products have left the customs territory of the Community has been endorsed by the competent authorities, the products concerned may not, except in cases of force majeure, return to such territory other than for the purpose of a transit operation and for not more than 28 days.

The transitional provisions for the border inspection posts between the Member States and the new Member States which are due to be abolished on accession are not made sufficiently clear in Article 8 of Regulation (EC) No 282/2004 introducing a document for the declaration of, and veterinary checks on, animals from third countries entering the Community(2) and should be reworded to avoid any ambiguity.
