(a) Establishing the necessary facilities to participate in these verification measures and establishing the necessary communication;

MEASURES IN RELATION TO VERIFICATION OF NON-DIVERSION

The States Parties undertake to promote cooperation among themselves to facilitate and participate in the fullest possible exchange relating to technologies used in the verification of this Treaty in order to enable all States Parties to strengthen their national implementation of verification measures and to benefit from the application of such technologies for peaceful purposes.

(2) Verification of mitigating measures under the preceding paragraph includes:

For verification purposes, the interpretation of measurement results in relation to the limit value must also take into account the inaccuracy of the measurement method.

Each State Party undertakes to cooperate with the Organization and with other States Parties in the improvement of the verification regime, and in the examination of the verification potential of additional monitoring technologies such as electromagnetic pulse monitoring or satellite monitoring, with a view to developing, when appropriate, specific measures to enhance the efficient and cost-effective verification of this Treaty.

The Agency's verification shall include inter alia independent measurements and observations conducted by the Agency in accordance with the procedures specified in this Agreement.

Moreover, all necessary measures shall be taken to protect the confidentiality of any information related to civil and military activities and facilities obtained during verification activities.

In the case of a searching according to article 3 of the Treaty, for verification purposes, national contact points of the Parties shall take appropriate measures in compliance with their national law.

3 When the age of the victim is uncertain and there are reasons to believe that the victim is a child, he or she shall be presumed to be a child and shall be accorded special protection measures pending verification of his/her age.

Verifications may be limited to selected measures and sub-measures and to samples of transactions provided that an audit plan ensures that all significant areas, including the departments and bodies responsible for authorisation and those departments and bodies to which functions have been delegated, are covered over a period not exceeding three years.

If the customs authorities of the importing country decide to suspend the granting of preferential treatment to the products concerned while awaiting the results of the verification, release of the products shall be offered to the importer subject to any precautionary measures judged necessary.

(b) the effectiveness of the Community's safeguards, including the extent to which the operators of facilities are functionally independent of the Community's safeguards; the extent to which the measures specified in Article 32 have been implemented by the Community; the promptness of reports provided to the Agency; their consistency with the Agency's independent verification; and the amount and accuracy of the material unaccounted for, as verified by the Agency;

WHEREAS the Agency's international safeguards system referred to in the Treaty comprises, in particular, provisions for the submission of design information to the Agency, the maintenance of records, the submission of reports on all nuclear material subject to safeguards to the Agency, inspections carried out by the Agency's inspectors, requirements for the establishment and maintenance of a system of accounting for and control of nuclear material by a State, and measures in relation to verification of non-diversion;

The control and verification measures shall ensure compliance with the following obligations on the part of the vessel owners and/or masters:

In parallel with the taking of measurements, verification calculations are automatically performed to detect questionable results.

Member States shall attach the same value to EEC pattern approval and initial verification as to the corresponding national measures.

(1) As a public service, the Republic shall guarantee the verification of the quality of environmental monitoring including verification of the quality of measurements, the execution of methodologies, the qualifications of staff, and the quality of equipment used.

The maximum permissible error for measures in service shall be equal to twice the maximum permissible error in the initial verification fixed in paragraph 7.1.

In addition to the verification visits undertaken at the companies mentioned in recital 6 of the provisional Regulation, it should be noted that after the imposition of provisional measures, on-spot verification visits were carried out at the premises of the following companies and Associations:

The security measures included in the SSP should be in place when the initial verification for compliance with the requirements of chapter XI-2 and part A of this Code will be carried out.

No Member State may refuse, prohibit or restrict the placing on the market or entry into service of material measures of length bearing the EEC pattern approval symbol and the EEC initial verification mark.

provisions allowing verification that the investments supported in the context of the measure 'Implementation of binding standards' are not eligible for support under Chapter I of Title II of Regulation (EC) No 1257/1999,

On-the-spot checks of areas, as a general rule, consist of two parts, the first of which relates to verifications and measurements of declared agricultural parcels on the basis of graphic material, aerial photography and so forth.

Following that verification the Commission shall transmit to the Member State concerned an evaluation report on the programme and, if appropriate, recommend control measures in order to improve the application of control by that Member State.

These measures shall provide, inter alia, for permanent and effective verification of compliance with the obligations imposed on undertakings by this Regulation and the national provisions adopted in implementation thereof, and for appropriate penalties in the event of infringement.

If they have the requisite equipment, Member States shall carry out EEC initial verification of instruments submitted as having the measurement characteristics and satisfying the technical construction and functioning requirements laid down by the separate directive on this category of instruments.

During verification, it must be small enough to ensure a measurement inaccuracy of not more than 0.5 % (allowing for a possible reading error of not more than half the length of the smallest scale division) and small enough so that at the minimum flowrate the test does not take more than 1 1/2 hours.

In EEC initial verification of measures of length, the maximum permissible error, plus or minus on the nominal length or on the distance between any two scale marks of a measure of length, shall be expressed as a function of the length in question by a formula in the form (a + b L) millimetres in which:

Member States shall take the necessary measures to ensure monitoring of the catches of species made by their vessels operating in waters subject to the sovereignty or jurisdiction of third countries and on the high seas, and to ensure verification and recording of transshipments and landings of such catches.

Every measure of length shall be constructed in such a way that it is able to receive the verification marks laid down by the Council Directive of 26 July 1971, on the approximation of the laws of the Member States relating to common provisions, for both measuring instruments and methods of metrological control.

The following sentence is added to the second subparagraph of point 6(ii): "Appropriate measures must be taken to avoid a conflict of interests where a person occupying a position of responsibility or a sensitive position with regard to the verification, authorisation and payment of claims on the Fund also fulfils other functions outside the paying agency."

Certificate verification, as defined in paragraph 1.1 of regulation 9 (Control of ships in port) of the special measures to enhance maritime security of the SOLAS Convention, shall be carried out in the port either by the competent authority for maritime security defined in Article 2(7) of this Regulation or by the inspectors defined in Article 2(5) of Directive 95/21/EC.

Where the officer conducting the certificate verification referred to in paragraph 1 has clear grounds for believing that the ship is not in compliance with the requirements of the special measures to enhance maritime security of the SOLAS Convention and of the ISPS Code, but does not belong to an authority which in that Member State is responsible for carrying out the measures provided for in paragraphs 1.2 and 1.3 of regulation 9 of the special measures to enhance maritime security of the SOLAS Convention, s/he shall immediately refer the matter to the said authority.

Member States shall take appropriate measures to verify the accuracy of the information received under paragraphs 1 and 2, and shall, where appropriate, inform the Member State or Member States in which the receiving vessel and the fishing vessel transshipping to the receiving vessel are registered, or whose flag they are flying, of such information and of the results of verification.
