The Guarantors are parties to the Guarantee Agreement concluded with the Bank (hereafter called the “Guarantee Agreement” or “Guarantee”) in respect of the Loans made by the Bank from its own resources under the Internal Agreement of 17 July 2006 (hereafter called the “Cotonou Internal Agreement II”) relating to the financing of Community aid under the multi-annual financial framework for the period 2008 to 2013 in accordance with the Partnership Agreement signed in Cotonou (Benin) on 23 June 2000 between the European Community and its Member States and the African, Caribbean and Pacific States as revised in Luxembourg on 25 June 2005 (hereafter called the “Cotonou Partnership Agreement II”) and on the allocation of financial assistance for the Overseas Countries and Territories to which part four of the EC Treaty applies under Council Decision 2001/822/EC of 27 November 2001 on the association of the Overseas Countries and Territories (hereafter called the “Association Decision”) (together referred to herein as the “Cotonou Framework”).

Pursuant to Article 96 of the Partnership Agreement between the African, Caribbean and Pacific Group of States, of the one part, and the European Community and its Member States, of the other part, signed in Cotonou on 23 June 2000 (hereinafter referred to as `the Partnership Agreement` ), the Party which considers that another Party has failed to fulfil an obligation in respect of one of the essential elements referred to in Article 9 may invite the other Party to hold consultations and, in certain circumstances, take appropriate measures, including where necessary, the partial or full suspension of application of the Partnership Agreement to the party concerned.

Ker bodo opravljene nadaljnje spremembe, je treba zaradi jasnosti in učinkovitosti navedeno uredbo prenoviti, da se vključijo tudi določbe Uredbe Komisije (EGS) št. 2967/79 z dne 18. decembra 1979 o pogojih, na podlagi katerih bodo predelani nekateri siri, za katere velja preferencialna uvozna obravnava fn, kakor je bila nazadnje spremenjena z Uredbo (ES) št. 1599/95 fn, Uredbe Komisije (ES) št. 2508/97 z dne 15. decembra 1997 o podrobnih pravilih za uporabo programov za mleko in mlečne proizvode, predvidenih v evropskih sporazumih med Skupnostjo in Republiko Madžarsko, Republiko Poljsko, Češko republiko, Slovaško republiko, Bolgarijo, Romunijo in Slovenijo ter sporazumih o prosti trgovini med Skupnostjo in baltiškimi državami fn, kakor je bila nazadnje spremenjena z Uredbo (ES) št. 2856/2000 fn, ter Uredbe Komisije (ES) št. 2414/98 z dne 9. novembra 1998 o podrobnih pravilih za uporabo režimov, ki se uporabljajo za izvoz mlečnih proizvodov s poreklom iz afriških, karibskih in pacifiških držav (države AKP) in o razveljavitvi Uredbe (EGS) št. 1150/90 fn.
Since further amendments are to be made, in the interests of clarity and efficiency the said Regulation should be recast to include also the provisions of Commission Regulation (EEC) No 2967/79 of 18 December 1979 laying down the conditions under which certain cheeses benefiting from preferential import treatment are to be processed (5), as last amended by Regulation (EC) No 1599/95 (6), Commission Regulation (EC) No 2508/97 of 15 December 1997 laying down detailed rules for the application to milk and milk products of the schemes provided for in the Europe Agreements between the Community and the Republic of Hungary, the Republic of Poland, the Czech Republic, the Slovak Republic, Bulgaria, Romania and Slovenia and the Agreements on free trade between the Community and the Baltic States (7), as last amended by Regulation (EC) No 2856/2000 (8), and Commission Regulation (EC) No 2414/98 of 9 November 1998 laying down detailed rules for the application of the arrangements applicable to imports of milk products originating in the African, Caribbean and Pacific States (ACP States) and repealing Regulation (EEC) No 1150/ 90 (9).
