The purpose of this Protocol is to prevent and combat the smuggling of migrants, as well as to promote cooperation among States Parties to that end, while protecting the rights of smuggled migrants.

The Government of the Republic of Slovenia and the International Organization for Migration (hereinafter referred to as the Contracting Parties),

do hereby establish the International Organization for Migration, hereinafter called the Organization, and accept this Constitution.

Convinced of the need to provide migrants with humane treatment and full protection of their rights,

recalling the Resolution adopted on 5 December 1951 by the Migration Conference in Brussels,

Migrants shall not become liable to criminal prosecution under this Protocol for the fact of having been the object of conduct set forth in article 6 of this Protocol.

Convinced that an assisted voluntary return programme would contribute to attaining the objectives of the Slovenian migration policy;

Considering the complexity of the challenges posed by migration flows and the need to ensure orderly management of migration;

In accordance with Article 1 of the Agreement on Cooperation between the Government of the Republic of Slovenia and the International Organization for Migration (hereinafter referred to as the Agreement), which was signed on 19 December 2001, and in accordance with the purposes and functions that are defined in the Constitution of the International Organization for Migration;

Migration shall be the subject of in-depth political dialogue, reflecting the importance the Parties attach to this topic.

that there should be close co-operation and co-ordination among States, international organizations, governmental and non-governmental, on migration and refugee matters,

recognizing that the provision of migration services at an international level is often required to ensure the orderly flow of migration movements throughout the world and to facilitate, under the most favourable conditions, the settlement and integration of the migrants into the economic and social structure of the country of reception,

MEMORANDUM BETWEEN THE GOVERNMENT OF THE REPUBLIC OF SLOVENIA AND THE INTERNATIONAL ORGANIZATION FOR MIGRATION (IOM) ON COOPERATION IN THE PROGRAMME OF VOLUNTARY RETURN OF MIGRANTS

In the framework of the cooperation to prevent and control illegal immigration, the Parties also agree to readmit their illegal migrants.

PROTOCOL AGAINST THE SMUGGLING OF MIGRANTS BY LAND, SEA AND AIR, SUPPLEMENTING THE UNITED NATIONS CONVENTION AGAINST TRANSNATIONAL ORGANIZED CRIME

Each State Party shall afford appropriate assistance to migrants whose lives or safety are endangered by reason of being the object of conduct set forth in article 6 of this Protocol.
