(3) Lastnik objekta oziroma njegovega dela, ki se je uporabljal v nasprotju s pogoji iz gradbenega dovoljenja in je zato pristojni gradbeni inšpektor prepovedal njegovo uporabo, mora za spremembo gradbenega dovoljenja zaprositi v enem mesecu po izrečenem ukrepu, z uporabo takšnega objekta oziroma njegovega dela pa lahko začne šele, ko zanj pridobi dokončno uporabno dovoljenje. Če lastnik objekta oziroma dela objekta za spremembo gradbenega dovoljenja ne zaprosi v enem mesecu po izrečenem ukrepu, in če lastnik objekta oziroma dela objekta sicer pridobi spremenjeno gradbeno dovoljenje, ne pridobi pa novega uporabnega dovoljenja, ali če pristojni upravni organ za gradbene zadeve zahtevo za spremembo gradbenega dovoljenja pravnomočno zavrne ali zavrže, odredi pristojni gradbeni inšpektor, da se v tistem delu objekta, ki se je uporabljal v nasprotju s pogoji iz gradbenega dovoljenja, na lastnikove stroške vzpostavi stanje, določeno v gradbenem dovoljenju.
The owner of a works or a part thereof used in contravention of the conditions specified in the building permit whose use has therefore been prohibited by the relevant building inspector must request the amendment of the building permit within one month of the measure being sentenced, and may only commence the use of the works or part thereof when a permit of use no longer subject to ordinary legal measures is obtained for it. If the owner of the works or part thereof fails to request amendment within one month of the measure being sentenced, if the owner of the works or part thereof acquires an amended building permit but fails to acquire a new permit of use, or if the relevant administrative body for construction matters finally denies or dismisses the request for amendment of the building permit, the relevant building inspector shall order that in the part of the works used in contravention of the conditions specified in the building permit the situation defined in the building permit be restored at the owner's expense.
