The duly authorised inspectors of an inspecting State shall have the authority to inspect the vessel, its licence, gear, equipment, records, facilities, fish and fish products and any relevant documents necessary to verify compliance with the relevant conservation and management measures.

Inspection and monitoring of fishing vessels and their activities

Member States shall undertake inspection of all fishing vessels carrying Dissostichus spp. which enter their ports.

To that end, they may set up joint inspection programmes to allow the inspection of Community fishing vessels in the waters referred to in paragraphs 1 and 3.

The special fishing permit referred to in Article 3, or an authenticated copy thereof, shall be carried on board fishing vessels and shall be available at all times for inspection by a CCAMLR inspector.

It shall inspect fishing vessels and investigate all activities thus enabling verification of the implementation of this Regulation, including the activities of landing, selling, transporting and storing fish and recording landings and sales.

Other vessel inspections are scheduled throughout the year under the regular fisheries inspection programme.

The competent authority for issuing health certificates for fishery products is the 'State Fisheries Committee of the Russian Federation', assisted by the 'National Centre of Quality and Safety of Fishery Products' (National Fish Quality) as inspection service for the approval and registration of establishments and vessels.

Whereas the Committee of Fisheries of the Russian Federation has the responsibility to draw up the list of establishments, factory vessels and freezer vessels approved for the export of fishery products to the European Union, and has delegated to the State Committee for Sanitary and Epidemiological Surveillance (Goskomsanepidnadzor) the responsibility for the health inspections and for monitoring the conditions of hygiene and cleanliness pertaining to production;

whereas it is necessary to intensify the inspection and surveillance of landings by vessels flying the flag of a third country and particularly, following the steps taken by certain regional (fisheries organisations to increase the effectiveness of measures for the conservation of fishery resources on the high seas, catches taken in the zones concerned;

Following a restructuring of the Russian administration, the Commission adopted Decision 2002/808/EC of 16 October 2002 amending Decision 97/102/EC laying down special conditions governing imports of fishery and aquaculture products originating in Russia (4), to modify the name of the competent authority for issuing health certificates for fishery products and to identify the authority responsible for the inspection and approval of the establishments and vessels.

For example, in the case of hygiene/sanitary conditions, describe the i nfrastructure, focusing on the area around the work rooms, the state of the sanitary facilities, the volume of the drinking water and the supply conditions, monitoring of the sewage and drainage systems, and the other points provided for in the RIGQ for vessels (Articles 39, 40 and 41), land-based establishments (Articles 28, 29, 30, 31 and 38), fishing ports and refrigerated warehouses (Articles 38, 42 and 43) and means of transport (Article 44).

Inspections of fishing vessels carried out at sea

Obligations of masters of fishing vessels during the inspection procedure

When conducting inspections on board fishing vessels, inspectors shall not carry firearms;

On the basis of appointments by Member States communicated to the Commission, the Commission shall establish, in accordance with the procedure laid down in Article 30(2), a list of Community inspectors, inspection vessels and inspection aircraft and other means of inspection authorised to carry out inspections under this Chapter in Community waters and on Community fishing vessels.

Whereas Article 1 of Regulation (EEC) No 2057/82 requires Member States to inspect fishing vessels in connection with conservation and control measures and to take penal or administrative action where infringements are observed;

Provisions on control, inspection and enforcement concern, on the one hand, obligations for the masters of fishing vessels and operators in the marketing chain and, on the other hand, spell out the different responsibilities for the Member States and the Commission.

Whereas it is appropriate to establish detailed rules for the application of new provisions of the said scheme particularly those concerning the inspection of community fishing vessels operating in the NAFO zone and presumed to have committed a major apparent infringement;

For these purposes, the Commission may carry out inspections on fishing vessels as well as on the premises of businesses and other bodies with activities relating to the Common Fisheries Policy and shall have access to all information and documents needed to exercise its responsibility.

Inspections by the Commission carried out of its own accord and without the assistance of inspectors of the Member State concerned shall take place only on fishing vessels and places of first landing or first sales, and shall be limited to areas or stocks subject to a specific monitoring programme decided under Article 34c of Regulation (EEC) No 2847/93.

When drawing up operational surveillance and inspection programmes the Commission shall ensure that, where, at any time, more than 10 Community fishing vessels are engaged in fishing activities targeted at regulated resources in the Regulatory Area, an inspection vessel from a Member State is present in the area or that an agreement has been concluded with another Contracting Party to ensure the presence of an inspection vessel.

Whereas, with the objective of improving control and enforcement in the NAFO Regulatory Area and complementing the existing Scheme of Joint International Inspection and Surveillance, the Community has agreed, in the framework of the NAFO and the Agreement on Fisheries with Canada, to deploy Community observers on board Community fishing vessels while engaged in fishing activities in the said NAFO Regulatory Area;
