The flag State shall, if evidence so warrants, fulfil its obligations to take enforcement action with respect to the vessel.

In particular, each Party shall ensure, through, inter alia, an annual certification and inspection program, that vessels under its jurisdiction comply with:

The flag State shall cooperate with the coastal State in taking appropriate enforcement action in such cases and may authorise the relevant authorities of the coastal State to board and inspect the vessel on the high seas.

Alternatively, the flag State may authorise the inspecting State to take such enforcement action as the flag State may specify with respect to the vessel, consistent with the rights and obligations of the flag State under this Agreement.

(a) fulfil, without delay, its obligations under Article 19 to investigate and, if evidence so warrants, take enforcement action with respect to the vessel, in which case it shall promptly inform the inspecting State of the results of the investigation and of any enforcement action taken; or

(d) instruct its maritime inspection vessels or aircraft and other appropriate services or officials to report without delay any observed event at sea or at a sea port or oil handling facility involving a discharge of oil or the presence of oil to the competent national authority or, as the case may be, to the nearest coastal State;

The Contracting Governments to the International Convention for the Regulation of Whaling signed at Washington under date of 2nd December, 1946 which Convention is hereinafter referred to as the 1946 Whaling Convention, desiring to extend the application of that Convention to helicopters and other aircraft and to include provisions on methods of inspection among those Schedule provisions which may be amended by the Commission, agree as follows:

Inspectors shall allow the master of the vessel being inspected to comment, on the inspection report form, about any aspect of the inspection;

The master of the inspected vessel shall be invited to sign the inspection report form to acknowledge receipt of the report.

A certificate signed by the person carrying out the inspection must be carried on board.

The inspection shall be carried out so that the vessel is subject to the minimum interference and inconvenience.

Before leaving the vessel that has been inspected, the CCAMLR inspector shall give the master of that vessel a copy of the completed inspection report referred to in Article 25.

Where special grounds exist for doing so, the authority may also request the following: (a) inspection of the vessel our of the water;

The owner or his representative must present the vessel for inspection in an unladen, cleaned and equipped condition;

Therefore, the addition of new establishments or vessels to the list of establishments and vessels from which the imports from Bulgaria are authorised, will require a new inspection visit on the spot by the Commission experts.

Member States shall undertake inspection of all fishing vessels carrying Dissostichus spp. which enter their ports.

To that end, they may set up joint inspection programmes to allow the inspection of Community fishing vessels in the waters referred to in paragraphs 1 and 3.

the identification of officially designated inspectors, of inspection vessels and of such other like means of inspection as may be used by a Member State;

Inspections shall impose no undue burdens on the vessel or its crew, and shall be guided by the relevant provisions of the CCAMLR system of inspection.

whereas companies should be prevented from operating such ferries and craft if these inspections reveal dangerous non-conformity with these safety standards;

The special fishing permit referred to in Article 3, or an authenticated copy thereof, shall be carried on board fishing vessels and shall be available at all times for inspection by a CCAMLR inspector.

In the case of vessels authorised to enter port, the competent authorities in the port Member State shall carry out their inspections as rapidly as possible and at the latest within 48 hours following entry into port.

Where the owner of a vessel or his representative submits a reasoned request, the Member State which issued the certificate may extend the validity of the attestation for not more than six months without carrying out the inspection required under 8.13.

Vessels carrying CCAMLR inspectors shall fly a special flag or pennant approved by the CCAMLR to indicate that the inspectors on board are carrying out inspection duties in accordance with the CCAMLR inspection system.

whereas it therefore should be verified that companies and their ferries and craft comply with the safety standards agreed within the IMO and, where appropriate, at regional level, through a system of regular mandatory inspections by host States;

To facilitate the inspections, the Member States shall require the vessels concerned to provide advance notice of their entry into port and to declare in writing that they have not engaged in or supported illegal, unregulated and unreported fishing activities in the Convention area.

Member States shall immediately transmit to the Commission the information regarding sightings, denial of port access, landings or transhipments, and the results of all inspections conducted in their ports, and any subsequent action they have taken in respect of the vessel concerned.

When the owner of the vessel or his representative is liable for costs arising from the inspection and the issue of the certificate in accordance with a detailed schedule to be laid down by each Member State. There may be no discrimination on the grounds of country of registry, nationality or domicile of the owner.

Any Member State which receives an inspection report or any supplementary reports or information, including reports under Article 24(6), concerning a vessel flying its flag shall transmit a copy to the CCAMLR and shall also transmit a copy to the Commission without delay, enclosing a copy of any comments and/or observations it may have transmitted to the CCAMLR following receipt of such reports or information.

Vessels already in service on or laid down before 1 January 1985 but whose construction and equipment do not fully comply with the provisions of this Directive must be brought into line with them within one year of the date of the first technical inspection provided for in Article 8 (2) of the Directive, with the exception of the provisions in Table 1 below, to which the following conditions apply: (a) The requirements set out in the first column of the table must be implemented within five years of the date of the first inspection provided for in Article 8 of the Directive.

In the case of an apparent infringement or a differences between recorded catches and the inspector's estimates of the catches on board, a copy of the inspection report with supporting documentation, including second photographs taken, shall be transmitted as soon as possible to the responsible authorities of the Contracting Party for the inspected vessel, after the inspection vessel returns to port.

(iv) the vessel is observed by a national fisheries inspection service to be trans-shipping to another vessel at sea;

As an exception to Chapter IX of this Annex, prior inspections of vessels shall take place in Europe.

(b) the boarding craft shall display one inspection pennant as shown in Annex II.

The vessel may not land or tranship any catch until this inspection has been completed.

The helicopter displaying its inspection pennant shall communicate to the vessel the intention to conduct a boarding:
