Execution of the following projects:

In action plans will be defined in greater detail specific goals of individual projects, tasks of the performers of projects, the methods of financing the projects, and the deadlines for their execution.

Consequently, the Executing Agency is the contracting party for service and supply contracts in the framework of approved Projects.

When a specific form of co-operation is identified an Implementing Arrangement will be concluded pursuant to this MOU which will define task objectives; agency of primary interest and project authorities; intellectual property rights and the degree of classification of technical data; cost share and any other financial arrangements; audit arrangements and procedures; contractual arrangements; liability; the frequency and types of reports to be submitted; and other provisions that may be required.

(3) The Ministry shall also keep records of public-private partnership projects and monitor them, and shall offer expert assistance to other public partners on the national (sectoral units) or local levels in formulating documents serving to determine the fulfilment of the economic, legal and other conditions for the creation and operation of public-private partnerships, in seeking technical solutions for public-private partnerships and in all other issues relating to the formation of relationships or carrying out the procedure for selecting private partners.

The design was performed according to the Slovenian construction regulations, for which purpose a design for construction permit (PGD) was granted, supported later on for construction purposes with the corresponding design for construction performance (PZI) documents.

This manifold background calls for the setting-up of a coherent trans-European implementation plan for ERTMS (ETCS and GSM-R) that should contribute to an harmonious development of the whole of the trans-European rail network in compliance with the EU strategy for the TEN-transport network. Such a plan should build upon the corresponding national implementation plans and should provide an appropriate knowledge base for decision support to the different stakeholders - in particular, to the Commission in the allocation of financial support to railway infrastructure projects.

The Commission shall monitor the implementation of projects accepted for financing by the Fund.

In order to make the best possible choice of projects financed within the context of the information programmes and ensure the proper implementation of the approved projects, provision should be made for the Commission to be assisted in the selection of the projects by a scientific and technical committee.

The knowledge gained through implementation of the projects will be disseminated by the JRC itself (taking into account possible limitations due to confidentiality issues).

In the interests of sound administration of the information programmes, the projects approved by the Commission should be carried out within a specified period.

Not later than one month before the pilot projects become operational, Member States shall forward to the Commission the information specified in Annex II relating to the carrying out of their pilot projects.

In order to guarantee the proper implementation of each project financed within the context of the information programmes, it is necessary for details of the conditions of implementation to be included in the contracts concluded with the Commission.

Alternatively to budgetary support, financial assistance may be provided as support for projects or programmes when this is deemed to ensure a more effective or safer implementation.

The procedures applicable to projects and programmes financed in the context of microprojects or decentralised cooperation shall be as set out in this Decision, notably with regard to the SPD implementing provisions.

Financial and technical assistance may cover all foreign currency costs and local costs for carrying out projects and programmes, including, whenever necessary, integrated programmes and sectoral projects.

The Community has not previously required institutions participating in projects within the decentralised actions of the programme to provide information about the cost of the contribution of the staff they employ towards the realisation of the projects.

These costs are eligible if they are directly linked to the project, and are necessary for its preparation or implementation or, in the case of accounting or audit costs, if they relate to requirements by the responsible authority.

With the aim of ensuring the rapid and effective implementation of projects and programmes, an accelerated tendering procedure shall be used except as otherwise indicated by the OCT concerned, or by the Commission by way of a proposal for the agreement of the OCT concerned.
