(3) For works orders awarded by a concessionaire that is not a public client, the deadline for receipt of applications for participation shall be at least 37 days from the day of submitting a request for publication of the public tender notice in the official journal of the Republic of Slovenia and/or the European Union, while the deadline for receipt of bids shall be at least 40 days from the day of submitting a request for the publication of a public tender notice in the official journal of the Republic of Slovenia and/or the European Union or a call for bids.

On the occasion of new amendments being made to Council Directives 92/50/EEC of 18 June 1992 relating to the coordination of procedures for the award of public service contracts(5), 93/36/EEC of 14 June 1993 coordinating procedures for the award of public supply contracts(6) and 93/37/EEC of 14 June 1993 concerning the coordination of procedures for the award of public works contracts(7), which are necessary to meet requests for simplification and modernisation made by contracting authorities and economic operators alike in their responses to the Green Paper adopted by the Commission on 27 November 1996, the Directives should, in the interests of clarity, be recast.

In the case of public contracts relating to the design and construction of a subsidised housing scheme the size and complexity of which, and the estimated duration of the work involved require that planning be based from the outset on close collaboration within a team comprising representatives of the contracting authorities, experts and the contractor to be responsible for carrying out the works, a special award procedure may be adopted for selecting the contractor most suitable for integration into the team.

Taking into account the further opening up of Community postal services to competition and the fact that such services are provided through a network by contracting authorities, public undertakings and other undertakings, contracts awarded by contracting entities providing postal services should be subject to the rules of this Directive, including those in Article 30, which, safeguarding the application of the principles referred to in recital 9, create a framework for sound commercial practice and allow greater flexibility than is offered by Directive 2004/18/EC of the European Parliament and of the Council of 31 March 2004 on the coordination of procedures for the award of public works contracts, public supply contracts and public service contracts(11).

The Member States shall take the necessary measures to ensure that public works concessionaires which are not contracting authorities apply the advertising rules defined in Article 64 when awarding works contracts to third parties where the value of such contracts is equal to or greater than EUR 6242000.

In works contracts awarded by a works concessionaire which is not a contracting authority, the time limit for the receipt of requests to participate, fixed by the concessionaire, shall be not less than 37 days from the date on which the contract notice was dispatched and the time limit for the receipt of tenders not less than 40 days from the date on which the contract notice or the invitation to tender was dispatched.

Pri novih spremembah direktiv Sveta 92/50/EGS z dne 18. junija 1992 o usklajevanju postopkov za oddajo javnih naročil storitev [5], 93/36/EGS z dne 14. junija 1993 o usklajevanju postopkov za oddajo javnih naročil blaga [6] in 93/37/EGS z dne 14. junija 1993 o usklajevanju postopkov za oddajo javnih naročil gradenj [7], potrebnih zaradi izpolnjevanja zahtev v zvezi s poenostavitvami in modernizacijo, kar izvajajo naročniki in gospodarski subjekti v okviru svojega odgovora na Zeleno knjigo, ki jo je Komisija sprejela 27. novembra 1996, bi bilo treba te direktive zaradi jasnosti preoblikovati.
On the occasion of new amendments being made to Council Directives 92/50/EEC of 18 June 1992 relating to the coordination of procedures for the award of public service contracts(5), 93/36/EEC of 14 June 1993 coordinating procedures for the award of public supply contracts(6) and 93/37/EEC of 14 June 1993 concerning the coordination of procedures for the award of public works contracts(7), which are necessary to meet requests for simplification and modernisation made by contracting authorities and economic operators alike in their responses to the Green Paper adopted by the Commission on 27 November 1996, the Directives should, in the interests of clarity, be recast.

In the case of public contracts relating to the design and construction of a subsidised housing scheme the size and complexity of which, and the estimated duration of the work involved require that planning be based from the outset on close collaboration within a team comprising representatives of the contracting authorities, experts and the contractor to be responsible for carrying out the works, a special award procedure may be adopted for selecting the contractor most suitable for integration into the team.
